Xi measures for the administration of smoking control

Eleventh indoor public places, public transport and outdoor areas of the following public places are completely prohibited from smoking:

(1) Outdoor areas of nurseries, child welfare institutions, primary and secondary schools, children's parks, activity centers, education and training institutions and other public places. Among them, minors are the main activity groups;

(two) outdoor areas of maternal and child health care institutions and medical and health care institutions that mainly provide medical services for pregnant women and children;

(3) Outdoor audience seats in sports and fitness venues and venue areas;

(four) other outdoor places where smoking is prohibited as stipulated by laws and regulations.

Smoking rooms or smoking areas shall not be set up in places where smoking is prohibited as stipulated in the preceding paragraph. Operators and managers of no-smoking places may, according to their needs, set up smoking places at appropriate positions around no-smoking areas.

Seventeenth operators and managers of smoking control places should set up smoking control signs that meet the standards in accordance with the regulations.

Tobacco control signs should be large and clear, including at least graphic warning signs prohibiting smoking, fines for illegal smoking, and complaint telephone numbers. The production standard of smoking control signs shall be uniformly stipulated by the municipal health and family planning administrative department and announced to the public.

Encourage state organs, enterprises and institutions, social organizations and other social organizations to make their own smoking control labels that meet the requirements.

Twenty-fifth whoever, in violation of the provisions of these measures, smokes in a no-smoking place shall be given a warning by the smoking control supervision and management department and fined ten yuan.

Twenty-sixth operators and managers of controlled smoking places fail to fulfill the obligations stipulated in Article 14 of these measures, and the operators and managers shall be fined more than 500 yuan 1000 yuan by the supervision and administration department of controlled smoking.

Article 27 Anyone who smokes in a no-smoking place and does not listen to dissuasion, disturbs the normal operation and work order, or hinders the relevant departments from performing their duties according to law, in violation of the Law of People's Republic of China (PRC) on Public Security Administration Punishment, shall be punished by the public security organ; If a crime is constituted, criminal responsibility shall be investigated according to law.
