The difference between the legal symbol of the court and the national emblem
The name of the court, the layout of the trial activity area and the hanging of the national emblem have been discussed and adopted at the 597th meeting of the the Supreme People's Court Judicial Committee. We hereby notify you as follows, and hope to implement it.

I. Name of the Tribunal

The trial court is the legal place for people's courts to hear all kinds of cases in strict accordance with legal procedures. The whole building of the people's court for trial work is called "trial court", and the rooms dedicated to hearing cases are called "courts", which are arranged in ordinal number, namely, the first court and the second court.

The room in the people's court building dedicated to hearing cases is called the "court".

Second, the layout of the trial activity area

The court consists of a trial activity area and an audit area, with the trial activity area as the main area to ensure that the trial activities can be carried out smoothly according to law.

1. The people's court holds a court session to hear criminal cases, and the location arrangement of judges, prosecutors, defenders and defendants is still implemented according to the document "1985 > 1 1" issued by the Supreme People's Court and the Supreme People's Procuratorate (see attached figure 1).

2. When trying civil, economic, maritime and administrative cases, the people's courts shall arrange trial areas in accordance with the following provisions:

A legal platform is set in front of the trial activity area, and the area of the legal platform should meet the needs of trial activities, with a height of 20 to 60 cm. There are tables and chairs on the altar, which are the seats for judges. The shape of French tables and chairs should be solemn and generous, and the color should be compatible with the overall tone of French dining table and court, so as to be serious, solemn and harmonious.

The right front of the bench is the clerk's seat, which forms a 45-degree angle with the bench. The clerk's seat should be 20 to 40 centimeters lower than the judge's seat.

The left front of the trial bench is the location of witnesses and appraisers, which forms a 45-degree angle with the legal bench (see attached figures 2 and 3).

There are seats for plaintiff, defendant and agent ad litem in front of the court, which are located on opposite sides, with the plaintiff's seat on the right and the defendant's seat on the left. The distance between them is not less than 100 cm. If there are more parties and agents ad litem, two rows of seats can be arranged before and after (see attached Figure 2). You can also sit in parallel, facing the trial seat, with the plaintiff's seat on the right and the defendant's seat on the left, with a distance of not less than 50 cm (see attached figure 3).

3. Where conditions permit, the clerk's seat can be set in the center in front of the judge's seat, at an angle of 90 degrees with the judge's seat, close to the judge's seat and facing the left side of the judge's seat, and its seat height is 20 to 40 cm lower than the judge's seat (see Figure 4).

Three. Hang the national emblem

According to the provisions of the National Emblem Law, the people's court shall hang the national emblem in accordance with the following provisions;

The national emblem is hung in the middle of the back and upper part of the courtroom of the people's court and the people's court; The national emblem is hung in the middle of the main entrance of the trial court, which is relatively independent from other buildings of the court; The national emblem is hung in the center of the main entrance of the people's court and the people's court;

The national emblem is hung in an appropriate position in the meeting room of the judicial Committee of the people's court.

The national emblem is not hung in the mediation room and reception room.

The general dimensions of the diameter of the national emblem are:

Basic people's courts and people's courts: 60 cm;

Intermediate people's court: 60cm;;

Higher people's court: 80cm;;

The Supreme People's Court: 100 cm.

If the people's court needs to hang a national emblem with a non-universal scale under special circumstances, it shall submit it for approval in accordance with the provisions of the National Emblem Law.
