The construction of ecological civilization as mentioned in these Regulations refers to all kinds of construction activities and related activities for the realization of ecological civilization. Article 4 Activities such as economic construction, political construction, cultural construction and social construction within the administrative area of this province shall be coordinated with the construction of ecological civilization and shall not conflict with the requirements of the construction of ecological civilization. Article 5 The construction of ecological civilization shall adhere to the principles of giving priority to conservation, protection and natural restoration, and the principles of combining government guidance with social participation, combining regional differentiation with overall optimization, and combining market incentives with legal protection, so as to realize the improvement of resource utilization efficiency, the reduction of pollutant production, the rational mode of economic and social development, the optimization of industrial structure and the safety of ecological system. Article 6 The people's government of the province shall lead, organize and coordinate the construction of ecological civilization in the whole province in a unified way, and the people's governments at or above the county level shall be responsible for the construction of ecological civilization in their respective administrative areas and incorporate the construction of ecological civilization into the national economic and social development plan and annual plan.
The people's governments at or above the county level shall be responsible for the guidance, coordination, supervision and management of the construction of ecological civilization in their respective administrative areas.
The relevant departments of the people's governments at or above the county level shall do a good job in the construction of ecological civilization in accordance with their respective responsibilities. Article 7 Citizens, legal persons and other organizations are encouraged to participate in the construction of ecological civilization, and their rights to know, participate, express and supervise are guaranteed. Citizens, legal persons and other organizations have the right to report, complain and accuse acts that endanger the construction of ecological civilization. Article 8 People's governments at all levels shall strengthen the propaganda of ecological civilization, popularize the knowledge of ecological civilization, advocate the behavior of ecological civilization, and raise the awareness of ecological civilization of the whole society by carrying out thematic publicity activities such as World Earth Day, Environment Day, Wetland Day, Low Carbon Day, Water Saving Day and National Energy Conservation Publicity Week.
June every year is the ecological civilization publicity month in this province. Article 9 People's governments at all levels shall commend and reward units and individuals that have made remarkable achievements in building ecological civilization. Chapter II Planning and Construction Article 10 The provincial people's government shall formulate plans for the construction of ecological civilization, and the people's governments of cities, prefectures and counties may, according to the plans of the people's governments at higher levels, formulate plans for the construction of ecological civilization in their respective administrative regions, which shall be implemented after being approved by the Standing Committee of the National People's Congress at the same level.
The planning of ecological civilization construction mainly includes: the overall goal, index system, key fields and key projects, key tasks, guarantee mechanism and measures of ecological civilization construction.
The ecological civilization construction plan approved according to law shall not be modified by any unit or individual without legal procedures. Article 11 The provincial people's government shall delimit the red line of ecological protection according to the main functional area planning and ecological civilization construction planning of this province and relevant technical specifications, determine the red line area of ecological protection, the upper limit of natural resources utilization and the bottom line of environmental quality and safety, and announce it to the public.
The term "ecological protection red line" as mentioned in these Regulations refers to the spatial boundaries and management boundaries that need to be strictly protected in terms of natural ecological function protection, environmental quality and safety, and natural resource utilization in order to protect national and regional ecological security and sustainable economic and social development, and to protect public health.
The red line area of ecological protection includes key ecological function areas such as forbidden development zones, concentrated contiguous high-quality cultivated land, public welfare forest land, drinking water source protection areas, ecologically sensitive areas, ecologically fragile areas and other areas with important ecological protection value.
The red line of ecological protection shall be observed when compiling or adjusting the overall land use planning, urban and rural planning, environmental protection planning, forest land protection and utilization planning and soil and water conservation planning.
Citizens, legal persons and other organizations engaged in various activities in the red line area of ecological protection shall strictly abide by the relevant requirements and maintain ecological safety. Twelfth people's governments at or above the county level shall compile the index system of ecological civilization construction.
The index system of ecological civilization construction includes ecological security, ecological economy, ecological environment, ecological human settlement, ecological culture and ecosystem. Thirteenth people's governments at or above the county level shall gradually establish a natural ecological space planning system, delimit the control boundaries of production, life and ecological space development, and implement use control.
People's governments at all levels should optimize the structure of land use, establish a system for the protection of land space development, delimit the red line for the protection of cultivated land and forest land, and economize and intensively use land resources. Article 14 The relevant departments of the people's governments at or above the county level shall, according to the ecological civilization construction plan of the people's governments at the corresponding level or the people's governments at higher levels, formulate plans or action plans for clean production, circular economy development, response to climate change, ecological agriculture and ecological forestry development, urban and rural green traffic construction, eco-tourism development, green buildings and green eco-city development, etc., and report them to the people's governments at the same level for approval before implementation.
