Full text of the regulations on the protection of power facilities
In order to ensure the smooth progress of electric power production and construction and ensure public safety, these regulations are formulated. The following is the full text of the 20 17 Regulations on the Protection of Power Facilities, which I carefully compiled for your reference only.

Chapter I General Provisions Article 1. In order to ensure the smooth progress of electric power production and construction and ensure public safety, these regulations are formulated.

Article 2 These Regulations shall apply to the electric power facilities built and under construction in People's Republic of China (PRC) (including power generation facilities, substation facilities, power line facilities and related auxiliary facilities, the same below).

Third, the protection of power facilities is based on the principle of combining power management departments, public security departments, power enterprises and the masses.

Article 4. Power facilities are protected by state laws, and any unit or individual is prohibited from engaging in acts that endanger power facilities. All units and individuals have the obligation to protect power facilities, and have the right to stop acts that endanger power facilities and report to the electric power management department and the public security department.

Electric power enterprises should strengthen the protection of power facilities and take corresponding measures to stop acts that endanger the safety of power facilities.

Fifth the State Council electric power management department is responsible for the supervision, inspection, guidance and coordination of power facilities protection.

Sixth, local electric power administrative departments at or above the county level are responsible for the protection of power facilities:

(a) to supervise and inspect the implementation of these regulations and the rules formulated in accordance with these regulations;

(two) to carry out publicity and education on the protection of power facilities;

(three) in conjunction with the relevant departments and units along the power line, establish mass organizations and improve the responsibility system;

(four) in conjunction with the local public security department, responsible for the safety and security of power facilities within the jurisdiction.

Seventh, public security departments at all levels are responsible for investigating and handling cases of destroying power facilities or looting or stealing power facilities and equipment according to law.

Chapter II Protection Scope and Protected Areas of Power Facilities Article 8 Protection scope of power generation facilities and substation facilities:

(a) power plants, substations, converter stations, switching stations and other plant and station facilities;

(2) Various special pipelines (ditches), ash storage yards, wells, pumping stations, cooling towers, oil depots, dams, railways, roads, bridges, docks, fuel handling facilities, lightning protection devices, fire fighting facilities and related auxiliary facilities other than power plants and substations;

(3) Reservoirs, dams, water intakes, diversion tunnels (including branch tunnels), diversion channels, surge shafts (towers), open-air high-pressure pipelines, power houses, tail water, communication facilities between power houses and dams, and related auxiliary facilities used by hydropower stations.

Article 9 The scope of protection of power line facilities:

(1) Overhead power lines: towers, foundations, stay wires, grounding devices, conductors, lightning wires, fittings, insulators, ladders and feet for climbing towers, protective facilities for conducting wires to cross waterways, patrol (protection) stations, patrol roads, ships and bridges, signs and related auxiliary facilities;

(2) Power cable lines: overhead, underground and underwater power cables and cable connecting devices, cable ducts, cable tunnels, cable trenches, cable bridges, cable shafts, cover plates, manholes, landmarks, waterline marks and related auxiliary facilities;

(3) Transformers, capacitors, reactors, circuit breakers, disconnectors, lightning arresters, transformers, fuses, metering devices, distribution rooms, box-type transformers and related auxiliary facilities on power lines.

Article 10 Power line protection zones:

(1) Overhead power line protection zone: the area in two parallel planes formed by the conductor sideline extending horizontally outward and perpendicular to the ground. In general, the sideline extension distance of voltage conductors at all levels is as follows:

1- 10KV 5m 35- 1 10KV 10m

In densely populated areas such as factories, mines and towns, the area of overhead power line protection zones may be slightly smaller than the above provisions. However, the extension distance of voltage conductor sideline at all levels should not be less than the sum of the maximum calculated sag and the maximum calculated horizontal distance of conductor sideline after wind deviation and the safe distance from the building after wind deviation;

(2) Power cable line protection area: the underground cable is the area within two parallel lines formed by 0.75m on both sides of the cable line pile; Submarine cables are generally 2 nautical miles on both sides of the line (both sides in the harbor 100 m), and river cables are generally not less than both sides of the line 100 m (small and medium rivers are generally not less than 50 m).

Chapter III Protection of Power Facilities Article 11 Local power administrative departments at or above the county level shall take the following measures to protect power facilities:

(1) On the boundary of the necessary overhead power line protection zone, signs shall be set up to indicate the width and protection provisions of the protection zone;

(2) In the section where the overhead power line conductor crosses an important road or waterway, signs shall be set up to indicate the safe distance between the conductor and the crossing object;

(three) after the underground cable is laid, a permanent sign shall be set up, and the location of the underground cable shall be informed to the relevant departments in writing;

(four) after the submarine cable is laid, a permanent sign shall be set up, and the position of the submarine cable shall be informed to the relevant departments in writing.

Twelfth, any unit or individual in the surrounding power facilities blasting operations, must be in accordance with the relevant provisions of the state, to ensure the safety of power facilities.

Thirteenth any unit or individual shall not engage in the following acts that endanger power generation facilities and substation facilities:

(1) Breaking into power plants and substations, disturbing the order of production and work, moving or damaging signs;

(two) endanger the safe operation of pipelines (ditches) such as water conveyance and ash discharge;

(three) affect the use of special railways, highways, bridges and docks;

(four) in the reservoir used for hydropower generation, enter the area 300 meters away from the hydraulic structure to carry out fish frying, electric fishing, swimming, rowing and other acts that may endanger the safety of hydraulic structures;

Article 14 No unit or individual may engage in the following acts that endanger power line facilities:

(1) Shooting at power line facilities;

(2) throwing objects at wires;

(three) flying kites within 300 meters on both sides of overhead power lines;

(four) unauthorized use of electrical equipment on the wire;

(5) Climbing towers or erecting power lines, communication lines, broadcasting lines and installing loudspeakers on towers without authorization;

(six) the use of poles, towers, stay as a lifting traction ground anchor;

(7) Tying livestock, hanging articles and climbing agricultural objects on towers and stay wires;

(8) Borrowing soil, piling, drilling, excavating or dumping acid, alkali, salt and other harmful chemicals within the prescribed scope of tower and cable foundation;

(nine) in the tower (excluding the tower) or between the tower and the line to build roads;

(ten) the removal of equipment or lines on the tower, moving or damaging permanent signs or signs; ;

Fifteenth, any unit or individual in the overhead power line protection zone, must comply with the following provisions:

(a) shall not pile up grain, forage, garbage, slag, flammable, explosive and other items that affect the safe power supply;

(two) shall not burn kiln, burning;

(3) No buildings or structures shall be built;

(4) No bamboo shall be planted;

(five) with the consent of the local power department, trees can be kept or planted at a safe distance between the final height of natural growth and the conductor.

Sixteenth, any unit or individual in the power cable line protection zone, must comply with the following provisions:

(1) It is forbidden to pile up garbage, slag, inflammable and explosive articles, dump harmful chemicals such as acid, alkali and salt, build buildings and structures or plant trees and bamboo in underground cable protection zones;

(two) shall not be anchored or towed in the submarine cable protection zone;

(three) shall not anchor, drag anchor, fish, sand digging in the river cable protection zone.

Seventeenth any unit or individual must be approved by the local administrative department of electric power at or above the county level, and take safety measures before carrying out the following operations or activities:

(a) in the overhead power line protection zone for farmland water conservancy capital construction projects and piling, drilling, excavation and other operations;

(two) any part of the hoisting machinery enters the overhead power line protection zone for construction;

(three) the distance between the conductor and the jumper is less than the safe distance, and it crosses the overhead power line protection zone;

(4) Working in power cable line protection zones.

Eighteenth any unit or individual shall not engage in the following acts that endanger the construction of power facilities:

(a) illegal occupation of land requisitioned by power facilities construction projects according to law;

(2) Altering, moving, damaging or removing surveying markers and markers for the construction of power facilities;

(three) destruction, blocking construction roads, cutting off construction water or power supply.

Article 19. A commercial enterprise approved by the local administrative department for materials and commerce at or above the county level in conjunction with the administrative department for industry and commerce and the public security department may inspect, certify and register the purchase of power facilities and equipment within the approved scope.

Any unit selling power facilities and equipment must hold the certificate of its own unit; Individuals selling power facilities and equipment must hold certificates issued by their own units or residents' committees or villagers' committees and sell them to designated commercial enterprises.

No unit or individual may illegally sell or buy power facilities and equipment.

Article 20 The protection of overhead communication lines, communication cable facilities and their ancillary facilities by the competent department of electric power shall be implemented in accordance with the relevant provisions of the state.

Chapter IV Handling of Mutual Interference between Power Facilities and Other Facilities Article 21 The construction and protection of power facilities shall avoid or reduce losses to the state, collectives and individuals.

Twenty-second, new overhead power lines shall not cross the area where inflammable and explosive articles are stored; Generally, it is not allowed to cross the house. When it is necessary to cross the house under special circumstances, the electric power construction enterprise shall take safety measures and reach an agreement with the relevant units.

Twenty-third, public works, urban greening and other projects in the new construction, renovation or expansion of power facilities, or power facilities in the new construction, renovation or expansion of public works, urban greening and other projects, the relevant units of both sides must negotiate in accordance with these regulations and the relevant provisions of the state, and reach a relocation agreement, take necessary protective measures and compensation before construction.

Article 24 The administrative department of electric power shall notify the competent department of urban and rural construction planning of the approved plans and plans for the construction, renovation and expansion of electric power facilities, and delimit protected areas.

The competent department of urban and rural construction planning shall incorporate the plans and plans for the construction, renovation and expansion of power facilities into the urban and rural construction planning.

Article 25. If it is necessary to build, rebuild or expand power plants, substations, power line facilities and ancillary facilities, and after reaching an agreement with the relevant competent departments in accordance with the provisions of Article 23 of these regulations, it is necessary to damage crops, cut down trees and bamboo or dismantle buildings and other facilities, the power construction enterprise shall give a one-time compensation in accordance with the relevant provisions of the state.

Chapter v rewards and punishments. Any unit or individual who commits one of the following acts shall be commended or given a one-time material reward by the administrative department of electric power:

(a) to report and expose acts of destroying power facilities or looting or stealing power facilities and equipment;

(2) Fighting against acts of destroying power facilities or looting or stealing power facilities and equipment to effectively prevent accidents;

(3) Striving against natural disasters for the protection of power facilities and making remarkable achievements;

(4) Maintaining the safety of power facilities and making remarkable achievements.

Twenty-seventh any unit or individual in violation of the provisions of this Ordinance thirteenth, fourteenth, fifteenth, sixteenth and seventeenth, the competent department of electric power has the right to stop and order it to make corrections within a time limit; If the circumstances are serious, a fine may be imposed. In violation of the provisions of Item (4) and Item (5) of Article 15 of this Ordinance, if no correction is made within the time limit, the competent department of electric power may also take measures of compulsory felling of trees and bamboo; If losses are caused, the competent department of electric power shall also order it to make compensation, and suggest that its superior competent department give administrative sanctions to the relevant responsible personnel.

Twenty-eighth any unit or individual who violates the provisions of these regulations and constitutes a violation of public security management shall be punished by the public security department in accordance with the Regulations of the People's Republic of China on Administrative Penalties for Public Security; If a crime is constituted, criminal responsibility shall be investigated by judicial organs according to law.

Twenty-ninth any unit or individual who violates the provisions of Article 18 of these regulations and illegally occupies the land requisitioned by electric power construction facilities according to law shall be dealt with in accordance with the relevant provisions of the state.

Article 30 Any unit or individual who illegally purchases or sells power facilities and equipment in violation of the provisions of Article 19 of these regulations shall be confiscated by the administrative department for industry and commerce in accordance with the relevant provisions of the state, and shall be fined until its business license is revoked, depending on the seriousness of the case.

Thirty-first, the power sector staff in violation of the provisions of this Ordinance, if the circumstances are serious, should be given administrative sanctions; If a crime is constituted, criminal responsibility shall be investigated by judicial organs according to law.

Article 32. If a party refuses to accept the administrative punishment given by the local power department, he may appeal to the power department at the next higher level. If he still refuses to accept the administrative punishment given by the electric power department at the next higher level, he may bring a lawsuit to the people's court within 15 days from the date of receiving the notice of punishment. If neither prosecution nor execution is carried out at the expiration of the time limit, the competent department of electric power that has made administrative punishment shall apply to the people's court for compulsory execution.

Chapter VI Supplementary Provisions Article 33 The administrative department of electric power in the State Council may, jointly with relevant departments in the State Council, formulate detailed rules for the implementation of these Regulations.

Thirty-fourth, this Ordinance shall be interpreted by the competent department of electric power in the State Council.

Thirty-fifth, this Ordinance shall come into force as of the date of promulgation.
