Chapter I General Provisions Article 1 These Measures are formulated in accordance with relevant laws and regulations for the purpose of establishing and maintaining the normal order in the field of coal circulation, maintaining the convergence of coal production, transportation and marketing and the balance between supply and demand, and meeting the needs of national economic development and people's life. Article 2 While giving full play to the fundamental role of the market mechanism in the allocation of coal resources, we should earnestly strengthen the management of coal transportation and marketing plans, do a good job in macro-control and industry management, and gradually establish a management system of coal transportation and marketing plans that meets the requirements of the market economy. Article 3 The Ministry of Coal and the competent departments of coal industry at all levels shall exercise industry management over coal transportation and marketing, and organize and maintain the total balance between coal supply and demand. Article 4 The Ministry of Coal, the Ministry of Railways and the Ministry of Communications shall, under the guidance of the national macro-plan, specifically negotiate the coal railway transportation plan and the land-water combined transport plan through major ports. The Ministry of Coal organizes the coal system to propose monthly plans for railway transportation and land-water combined transportation to the transportation department through major ports, and organizes monthly unplanned transportation of coal; Coordinate with relevant departments to deal with problems in the preparation and implementation of monthly plans; Check and supervise the implementation of coal transportation and marketing plan. Article 5 These Measures shall apply to coal mines with various channels, subordinate relations and various business forms in the coal industry. Chapter II Management of Annual and Monthly Coal Transportation and Marketing Plans Article 6 Coal included in the unified national transportation and marketing plan must be transported and sold in strict accordance with the transportation and marketing plan issued by the state. Without special reasons, it shall not be adjusted or changed without authorization. Article 7 The sale and transportation of coal not included in the unified national distribution but included in the coal transportation plan shall be handled in accordance with the provisions of these Measures.

The sale and transportation of coal other than those specified in this article shall be handled in accordance with the current relevant regulations temporarily. Article 8 Coal production enterprises shall, in accordance with the national annual coal transportation and marketing plan and relevant laws and regulations, sign standardized purchase and sale contracts with transportation and marketing units, clarify the rights, obligations and legal responsibilities of all parties, and timely record and master the performance of the contracts. 1. Changes in the national annual total distribution plan of coal-using departments, coal-using areas or coal-supplying areas shall be reported to the Ministry of Coal 35 days before the implementation month of the changes, and shall be handled by the Ministry of Coal after consultation with the State Planning Commission.

The competent department that requires the change of the unit shall, before the 35 th day of the change implementation month, negotiate with the competent departments of coal in relevant provinces, municipalities and autonomous regions and the relevant railway and transportation departments, and report to the Ministry of Coal for the record.

3. The total annual supply and demand remains unchanged, and the supply and demand plans of departments and regions remain unchanged. The advance and error of the supply and demand time in the monthly plan, as well as the change of the coal supply and demand category and quality, shall be handled by the unit requesting the change before the 35th day of the change implementation month, with the consent of the other party and the relevant railway and transportation departments, and reported to the competent coal departments of the relevant provinces, municipalities and autonomous regions for the record.

4. Any change in the throughput of railway restricted ports and ports shall be reported to the Ministry of Coal for approval.

2. The Ministry of Coal shall, 30 days before the start of each month, review the coal transportation plans of various mining bureaus (mines and districts) proposed by the competent departments of coal transportation of provinces, municipalities and autonomous regions, confirm that they meet the requirements and make adjustments, and then submit them to the competent departments of coal transportation of provinces, municipalities and autonomous regions as the basis for the preparation of monthly coal transportation plans.

3, the provinces, municipalities and autonomous regions in charge of coal, according to the preparation of the monthly coal transportation plan determined by the Ministry of Coal, guide the subordinate mining bureau (mine, district) to organize the preparation. If it needs to be changed for special reasons, it must be approved by the Ministry of Coal.

4, the monthly coal transportation plan according to the provisions of the railway department of time, by the provinces, municipalities and autonomous regions under the unified coal authorities to reach the railway and transportation departments.

5, all provinces, municipalities and autonomous regions in charge of coal, 35 days before the start of each month, must be approved by the railway and transportation departments of last month's coal transportation plan and the relevant situation reported to the Ministry of Coal.
