The term "agricultural machinery" as mentioned in these Regulations refers to the machinery and equipment used for agricultural production, primary processing of products and other related agricultural activities. Article 3 These Regulations shall apply to personnel engaged in scientific research, promotion, production, sale, use, maintenance, education, training and management of agricultural machinery within the administrative area of the autonomous region. Article 4 The people's governments at or above the county level shall strengthen their leadership over the management of agricultural machinery, incorporate the promotion of agricultural mechanization into the national economic and social development plan, and increase investment in agricultural mechanization; Encourage and support the scientific research and production of agricultural machinery, popularize new tools and technologies of agricultural machinery, accelerate the transformation of scientific research results, and improve the management and service system of agricultural mechanization. Fifth administrative departments of agricultural machinery of the people's governments at or above the county level shall be responsible for the management of agricultural machinery and the promotion of agricultural mechanization within their respective administrative areas.
Agricultural mechanization technology popularization institutions under the administrative departments of agricultural machinery of the people's governments at or above the county level shall be responsible for the development and popularization of new agricultural machinery and technologies within their respective administrative areas. Agricultural machinery appraisal and inspection institutions shall be responsible for the inspection and appraisal of agricultural machinery within their respective administrative areas.
Industrial and commercial administration, quality and technical supervision, supervision and management of production safety, public security, transportation, forestry, water conservancy, land reclamation and other relevant departments and units shall, according to their respective functions and duties, do a good job in promoting agricultural mechanization. Sixth people's governments at all levels should guide and support the development of various forms of agricultural mechanization service organizations, and do a good job in the promotion and service of agricultural machinery. Chapter II Promotion of Scientific Research Article 7 The administrative department of agricultural machinery of the people's government at or above the county level shall organize the preparation of the development plan of agricultural mechanization in this area, which shall be implemented after being approved by the people's government at the same level. Eighth people's governments at or above the county level shall establish agricultural mechanization demonstration bases in different agricultural planting areas; Encourage agricultural machinery producers, operators and promoters to establish agricultural machinery demonstration sites, carry out agricultural machinery applicability tests and advanced demonstrations, and guide farmers and agricultural production and operation organizations to use advanced and applicable agricultural machinery. Ninth new products and technologies of agricultural machinery should be advanced, applicable, safe and reliable. Promoters should be responsible for the promotion. Article 10 The popularization of new products and technologies of agricultural machinery shall be carried out in accordance with the procedures of introduction, testing, demonstration and popularization. Eleventh autonomous region people's government administrative departments of agricultural machinery shall, jointly with relevant departments, according to the development plan of agricultural mechanization in the autonomous region, timely determine and publish the catalogue of agricultural machinery products supported and promoted by the autonomous region.
Products listed in the catalogue of agricultural machinery products supported and promoted by the autonomous region shall be voluntarily applied by agricultural machinery producers, and their advanced nature, applicability, safety and reliability shall be appraised by agricultural machinery appraisal institutions. Chapter III Quality Assurance Article 12 Producers and sellers of agricultural machinery shall be responsible for the quality of the agricultural machinery products they produce and sell.
It is forbidden to produce and sell fake and shoddy agricultural machinery products and those explicitly eliminated by the state. Thirteenth agricultural machinery producers and sellers should undertake spare parts supply, training, consulting and other after-sales services to ensure the quality of products sold. Fourteenth agricultural machinery production, maintenance and operation quality standards should implement national standards or industry standards; Where there is no national standard or industry standard, local standards shall be implemented. Fifteenth engaged in agricultural machinery maintenance business activities, should meet the following conditions:
(1) Having a site, equipment and testing instruments suitable for the maintenance business;
(two) technical personnel who have obtained the professional skill qualification certificate of agricultural machinery maintenance;
(three) to obtain the corresponding category and grade of agricultural machinery maintenance technical qualification certificate;
(four) for industrial and commercial registration;
(5) Other conditions stipulated by laws and regulations. Sixteenth engaged in agricultural machinery maintenance business activities, shall not have the following acts:
(a) beyond the approved maintenance level or scope to undertake maintenance projects;
(two) the sale or use of agricultural machinery maintenance parts that do not meet the mandatory requirements of national standards or technical specifications;
(three) the use of maintenance parts, scrapped mechanical parts or defective parts to modify and assemble agricultural machinery;
(4) passing off fake, shoddy and unqualified agricultural machinery products as qualified ones, or using unqualified parts to repair agricultural machinery;
(five) to undertake the maintenance business of scrapped agricultural machinery;
(six) other acts prohibited by laws and regulations. Article 17 The administrative department of agricultural machinery, the quality and technical supervision department and the administrative department for industry and commerce shall strengthen the supervision and management of the quality, maintenance quality, safety production and operation quality of agricultural machinery products, and promptly accept complaints about the quality, maintenance quality, safety production and operation quality of agricultural machinery products; Complaints that do not fall within the scope of responsibilities of this department shall be transferred to departments with acceptance authority and the complainant shall be informed.
