The people's court does not go to work during the National Day, and the National Day holiday, like other government agencies, is implemented according to the holidays arranged by the General Office of the State Council. The court belongs to the state organs, so it rests strictly according to the national statutory holidays and never works overtime.

The court is the national judicial organ. People's Republic of China (PRC) has set up special people's courts in the Supreme People's Court, local people's courts at various levels and military courts. All provinces, autonomous regions and municipalities directly under the Central Government have higher people's courts, and defendants have the right to defense. The people's courts exercise judicial power independently in accordance with the law and are not subject to interference by administrative organs, social organizations or individuals.

Algorithm of overtime pay on holidays;

Article 44 of the Labor Law stipulates that under any of the following circumstances, the employing unit shall pay wages higher than the wages of workers during normal working hours according to the following standards:

1. If workers are arranged to work longer hours, they shall be paid no less than 150% of the salary;

2. If workers are arranged to work on rest days and cannot be arranged for compensatory time off, they shall be paid no less than 200% of their wages;

3. If workers are arranged to work on legal holidays, they shall be paid no less than 300% of their wages.
