The bid evaluation report is a report compiled by the bid evaluation committee according to the original bid evaluation records and the bid evaluation results signed by all bid evaluation members. After completing the bid evaluation, the bid evaluation committee shall submit a written bid evaluation report to the tenderer and recommend qualified candidates for winning the bid. The tenderer shall determine the winning bidder according to the written bid evaluation report put forward by the bid evaluation committee and the recommended candidate winning bidders. The tenderer may also authorize the bid evaluation committee to directly determine the winning bidder.
According to Article 42 of the Interim Provisions on the Bid Evaluation Committee and Bid Evaluation Methods (promulgated by DecreeNo. 12 of the State Planning Commission, the State Economic and Trade Commission, the Ministry of Construction, the Ministry of Railways, the Ministry of Communications, the Ministry of Information Industry and the Ministry of Water Resources in July 2006), after the bid evaluation, the bid evaluation committee shall submit a written bid evaluation report to the tenderer and send a copy to the relevant administrative supervision departments. The bid evaluation report shall truthfully record the following contents:
(1) Basic information and data table;
(2) List of members of the bid evaluation committee;
(3) Record of bid opening;
(4) Bidding list that meets the requirements;
(five) a description of the situation of the waste standard;
(6) Bid evaluation criteria, bid evaluation methods or list of bid evaluation factors;
(seven) after the review of the price or score comparison list;
(eight) the ranking of the evaluated bidders;
(nine) the list of recommended candidates for winning the bid and the matters that should be dealt with before signing the contract;
(10) minutes of clarification, explanation and correction.
Article 43 The bid evaluation report shall be signed by all members of the bid evaluation committee. Members of the bid evaluation committee who disagree with the bid evaluation conclusion may explain their different opinions and reasons in writing. If a member of the bid evaluation committee refuses to sign the bid evaluation report without explaining different opinions and reasons, it shall be deemed as agreeing with the bid evaluation conclusion. The bid evaluation committee shall make a written explanation and put it on record.
What should I pay attention to when forming a bid evaluation report?
According to different bid evaluation methods, according to Article 41 of the Bidding Law, the bid of the winning bidder shall meet one of the following conditions:
(1) can meet the comprehensive evaluation criteria specified in the tender documents to the maximum extent;
(two) to meet the substantive requirements of the tender documents, and the evaluated bid price is the lowest; Only the bid price is lower than the cost. "
The bid evaluation report shall be submitted in accordance with the provisions of Article 40 of the Bidding Law: "After the bid evaluation is completed, the bid evaluation committee shall submit a written bid evaluation report to the tenderer, and recommend qualified candidates for winning the bid", and send a copy to the relevant administrative supervision departments. Article 53 of the Implementation Regulations further stipulates: "After the bid evaluation, the bid evaluation committee shall submit a written bid evaluation report and a list of successful candidates to the tenderer. There should be no more than three successful candidates, and the ranking should be indicated. " The specific requirements for the judges are: "The bid evaluation report shall be signed by all members of the bid evaluation committee. If members of the bid evaluation committee have different opinions on the bid evaluation results, they shall explain their different opinions and reasons in writing, and the bid evaluation report shall indicate the different opinions. If a member of the bid evaluation committee refuses to sign the bid evaluation report and fails to explain different opinions and reasons in writing, it shall be deemed as agreeing with the bid evaluation result. "
Regarding the publicity of bid evaluation results, Article 54 of the Implementation Regulations stipulates: "For a project that must be subject to tender according to law, the tenderer shall publicize the successful candidate within 3 days from the date of receiving the bid evaluation report, and the publicity period shall not be less than 3 days. Bidders or other interested parties who have objections to the bid evaluation results of projects that must be subject to tender according to law shall raise them within the publicity period of the successful candidate. The tenderer shall make a reply within 3 days from the date of receiving the objection; Before giving a reply, the tendering and bidding activities should be suspended. "
