State administrative organs shall, in accordance with the principle of "graded responsibility and centralized handling", properly handle the collective letters and visits of the masses in a timely manner. Article 6 Cities and counties (cities, districts) shall establish a working conference system between complaint reporting agencies and departments and units such as supervision, personnel, labor, public security and the Federation of Trade Unions. The working meeting is generally convened by the petition work organization, and other relevant competent departments can also be invited to attend, * * * to study the relevant issues in the mass collective petition and put forward handling opinions. Article 7 When the masses collectively petition, they shall elect 1 to 3 representatives (no more than 5 in special circumstances) to the state administrative organ or the first-level reception place of the unit with direct handling right to reflect the problems.
The representative shall be responsible for maintaining the order of letters and visits, and shall be responsible for timely feedback to the represented letters and visits.
The represented complainant shall obey the arrangement of the receptionist of the state administrative organ and wait for his opinions or return at the designated place. Article 8 When accepting collective letters and visits from the masses, the state administrative organs shall handle them in accordance with the following provisions:
(a) the reception of collective petition representatives, listen carefully to their opinions and demands. Questions that can be answered on the spot should be answered clearly according to laws, regulations and relevant policies; There are some ways to reflect the problem, but it can't be solved at the moment according to the current policy, so we should explain it well; If further investigation is needed, the situation shall be explained, the investigation shall be organized as soon as possible, and the opinions on investigation and handling shall be fed back to the representatives in time; For those who put forward excessive or unreasonable demands, we should criticize and educate them while doing a good job of patient ideological guidance.
(two) the state administrative organs shall inform the elected representatives to reflect the problems of the people who have not elected representatives to reflect the wishes of the group. If a collective visitor refuses to elect a representative and stays at the entrance of the reception place or organ, the reception organ may notify the relevant competent department or responsible unit to meet the returning visitor at the scene.
(3) To publicize the relevant laws, regulations and policies of the state and the relevant procedures for handling and solving problems for the people who collectively petition, and guide them to reflect the problems to the state administrative organs or units with direct handling authority.
(four) when a mass petition occurs, the person in charge of the relevant state administrative organs and units shall, according to the requirements of the petition work organization, actively do a good job in the reception and guidance of the mass petition. The main person in charge of the competent authority shall personally receive the collective petitions of major people.
(5) If the problems reflected by mass collective petitions are beyond the scope of work and handling authority of the departments at the corresponding level, the reception organ shall actively explain and stabilize the work to the masses, and report the problems reflected by the masses to the superiors or relevant departments in a timely manner. When necessary, they can accompany the representatives of the mass collective petitions to the relevant departments to reflect. Contradictions should not be pushed to society or to superiors. Ninth people's collective petition shall comply with the following provisions:
(a) generally should hold the responsibility of the unit's handling opinions;
(two) truthfully reflect the situation, and shall not fabricate or distort the facts, and shall not falsely accuse or frame up;
(3) The problems required to be solved should be based on sufficient facts, policies and regulations, and excessive or unreasonable demands are not allowed;
(4) Do not sit still, contain or detain in front of the state administrative organs, do not put up banners, put up slogans, shout slogans, post or distribute small-character posters, do not attack the state administrative organs, do not besiege, abuse, insult or beat staff, do not destroy public or private property, and do not intercept official vehicles;
(5) If they are not satisfied with the handling opinions of the accepting organ, they may continue to elect their representatives and apply for reconsideration to the relevant state administrative organ at the next higher level with the written handling opinions issued by the accepting organ;
(six) shall not repeat the collective petition in the handling period and the petition reconsideration period reflected by the accepting organ. Article 10 State administrative organs shall handle mass collective petitions in accordance with the following procedures and regulations:
(a) have the right to directly deal with the problems reflected, should be placed on file, in accordance with the relevant laws, regulations and policies to make corresponding treatment in a timely manner. For major group collective petitions, there must be a person in charge to personally coordinate and deal with them. When the complainant is dissatisfied with the handling opinions of the problems reflected, the accepting organ shall issue a written handling opinion to the complainant. The problems reflected in the major mass collective petitions assigned by superiors shall be put on file and handled by themselves, and shall not be assigned by leaps and bounds.
(two) for the masses who have no direct handling authority, the higher authorities generally only consult and explain, understand the situation, and refer the problems reflected to the relevant localities or departments for handling according to the procedures for handling letters and visits. The organizer shall deal with it in time and report the result to the superior on schedule.
(three) the following organs or responsible units have been dealt with, but the masses are not satisfied and ask the higher authorities for reconsideration, and the higher authorities should seriously reconsider. If it is considered appropriate to deal with it after reconsideration, it shall support and assist the lower authorities to do a good job in mass work; If further investigation and handling by lower authorities or relevant units is needed, it shall be assigned in time. If the higher authorities confirm that the organizer has handled it improperly, they can also make a decision directly. The handling decisions made by the higher authorities shall be implemented by the lower contractors.
(four) the need for several localities and departments to cooperate with the handling of collective letters and visits, we should conscientiously do a good job in coordination. Involving more than two places or cross-systems, the superior competent department or relevant functional departments shall be responsible for coordination; Several problems related to this system are coordinated by this system.
(5) The public security organ shall maintain the normal working order of the state administrative organs. In the event of a mass petition to the state administrative organ, the relevant public security organ shall, according to the requirements of the reception organ or the relevant person in charge, rush to the scene to maintain order in time. Those who violate the law shall be dealt with in accordance with relevant laws and regulations.
(six) the problems reflected by the collective petitioners, the city and county (city, district) petition agencies have the right to assign to the state administrative organs at the same level or the next level, and supervise and inspect the handling. If it is not handled properly, it can be handled again or directly if necessary.
