Although there are vagrants and beggars, those who do not meet the requirements of the preceding paragraph do not belong to the object of assistance.
Helping vagrants and beggars is a temporary social assistance measure, following the principle of free and open assistance. Vagrants and beggars should respect their wishes whether they accept assistance or not. Article 3 The government, society and families have the responsibility to educate and help vagrants and beggars return to normal life and earn a living by honest labor. Grass-roots organizations should help vulnerable groups solve major difficulties in their survival and life; Guardians and other family members should try their best to support, care (help) and support; The government should make arrangements for those who have no ability to work, no source of income, no dependents and no dependents. Article 4 The establishment, alteration and cancellation of the rescue management station for vagrants and beggars (hereinafter referred to as the rescue station) shall be decided by the people's government at or above the county level (including the districts of county-level cities and cities under provincial jurisdiction, the same below) and reported to the Provincial Civil Affairs Department for the record. Where there is no rescue station, there should be a special person responsible for rescue management. The establishment and staffing of rescue stations at all levels shall be implemented in accordance with the relevant provisions of the province. Article 5 People's governments at all levels shall strengthen their leadership over the rescue work, coordinate and solve problems in the rescue work, and take active measures to timely rescue and resettle vagrants and beggars. All relevant departments should perform their duties and do a good job in the rescue and management of vagrants and beggars. Article 6 The financial department at or above the county level shall incorporate the relief funds into the fiscal budget at the corresponding level, and timely allocate funds according to the actual relief situation in that year to ensure the necessary expenses of the relief work and the normal operation of the relief station. Where there is no rescue station, the financial department shall arrange special funds for temporary assistance to help vagrants and beggars who meet the conditions of assistance.
The relief station can accept social donations, and the welfare funds raised by issuing welfare lottery tickets can be used for relief. Seventh public security, urban management departments and other relevant administrative organs staff found vagrants and beggars in the performance of official duties, should inform them to the rescue station for help; Persons with disabilities, minors, the elderly and other persons with mobility difficulties among vagrants and beggars shall be guided and escorted to the rescue station.
For vagrants and beggars who violate the regulations on public security administration, the public security organ shall take measures according to the provisions of the Law on Public Security Administration Punishment.
Community neighborhood committees shall educate and persuade vagrants and beggars in the community. Article 8 The health department shall be responsible for receiving critically ill patients, mental patients and patients with infectious diseases among vagrants and beggars to designated medical institutions for treatment, and the medical expenses shall be settled from the medical assistance funds for major poverty diseases in urban and rural areas arranged at all levels.
If the public security and urban management departments find that there are critically ill patients, mental patients and patients with infectious diseases among street vagrants and beggars, they shall promptly notify the medical institutions to implement treatment. Article 9 Departments of transportation such as roads, railways and water transport shall, within the scope of their respective duties and according to the requirements of the rescue station, provide necessary convenience for the aided persons to enter and leave the station (port) and take the car (boat). Tenth civil affairs departments are responsible for the rescue work of vagrants and beggars, and are in charge of rescue stations to perform the following duties:
(a) to supervise the rescue station to carry out and implement the laws, regulations, rules and management measures related to rescue;
(two) to guide and inspect the rescue work;
(three) education and training of rescue management personnel;
(four) to investigate and deal with violations of law and discipline of the rescue station and its staff;
(five) to provide necessary facilities and working conditions for relief and help solve major problems in relief work;
(six) other duties that should be performed according to law. Eleventh city (autonomous prefecture, the same below) above the rescue station should set up a rescue and protection center for street children, responsible for the rescue and education of street children. Twelfth docks, stations and other public places where vagrants and beggars are active shall assist the rescue station to set up guiding signs in a prominent position, indicating the location and contact telephone number of the rescue station. The public contact number of the rescue station should be answered 24 hours a day. Thirteenth help-seeking personnel in any of the following circumstances, the rescue station shall not be rescued:
(1) Refusing to provide true information (except for reasons such as old age, youth and disability);
(2) The person seeking help has been rescued by the same rescue unit for more than three times within one year. Fourteenth rescue station staff should warmly receive help-seeking personnel and use civilized and standardized language. After careful inquiry, the help-seeking personnel are required to truthfully fill out the "Registration Form for Help-seeking for Vagrants and Beggars without Urban Life in Hubei Province". If the help-seeking personnel cannot fill in the registration form, the staff shall fill it out on their behalf according to the dictation of the help-seeking personnel.
Belong to the rescue object, the rescue station shall timely rescue; Do not belong to the object of assistance, the staff should patiently explain the reasons for not giving assistance and give a written reply. Because of old age, young age, disability and other reasons can not provide personal information, the rescue station should provide assistance first, and then provide it after finding out the situation.
