The complainant Lv Qing and others were recruited by the "City Talent Exchange Center" or selected by the government to work in various branches of Bengbu Land and Resources Bureau around 1998 ~ 2003, and once served as all administrative work such as annual land transfer fee collection, land, cadastre and mine management. At present, he works in Longzihu Branch, Bangshan Branch and Yu Hui Branch of Bengbu Land and Resources Bureau respectively. A group of us, during our working hours, worked hard and diligently, holding the minimum living wage in Bengbu, just to wait for the Land and Resources Bureau to set up a branch office. After the system is perfect, we can consider our recruitment first, and the relevant leaders also verbally promised: "Do a good job. As long as you can set up a branch office in the future, the Municipal Bureau will give priority to your recruitment as long as there is a preparation. " We hold the belief that even if the salary is lower and there is no other treatment, we have no regrets. We have worked hard for more than ten years, and now we have set up a branch, and the land management is gradually standardized. At this time, the city bureau is going to arrange our establishment and arrange it for other personnel.

On June 8, 20 10, without any warning, we suddenly informed the directors of the three sub-bureaus to stop working immediately on the grounds that the Bengbu municipal government revoked the document 1998 100. We were as stunned as a blow. Have we violated the law or discipline? Director Han Qinghua said that our group of people are illegal. We are even more puzzled. Why is it illegal for us to engage in land management for many years now, but the identity of the personnel after the buyout of the enterprise is legalized? As far as we know, the Land and Resources Bureau dismissed us and prepared to arrange other personnel. In fact, the deeper problem is that Han Qinghua reported the establishment to the above in the name of our group of people, but the establishment to be done was not used to resettle our group of people, but to resettle some new people through various relationships, and these new people's work ability and business ability are not the same as those of our group of workers who have worked for more than ten years. To this end, we asked Director Han Qinghua for information many times, but Director Han Qinghua avoided it and arranged for other leaders in the bureau to receive us. These leaders who receive us can only put on airs, speak Mandarin and come up with different ideas. They didn't really have the sincerity to solve the problem, so we found the Municipal Letters and Calls Office many times, but it was fruitless. Instead, we were retaliated by Director Han Qinghua: we immediately stopped paying wages, dismissed and went home, and so on. In desperation, we have to reflect our situation to the central leadership.

1. We were recruited through due process, and after a three-month probation period, we entered the branches of Bengbu Land and Resources Bureau.

Up to now, except the directors of the branches of the Bureau of Land and Resources are civil servants, the rest are our recruiters. We work hard in the front line and at the grassroots level, but we get the lowest salary. Every year, dozens of goals and tasks assigned by the Municipal Bureau are completed by our staff. We have shed sweat and tears for the management of land and resources, and now we are bleeding? Our youth is dedicated to the Bureau of Land and Resources. Ten years have passed in an instant, and we are over forty years old. At this age, we will be fired, so where can we find a job to make a living? Where is the harmony and stability advocated by the state reflected?

Second, since I arrived at the Bureau of Land and Resources, I signed a labor contract with us several years ago, but since 2006, I have never signed a labor contract. As an employer, the Land and Resources Bureau has not signed a written labor contract with us for a long time, and unilaterally notified us to terminate the labor contract without authorization, which is illegal and is depriving us of our labor rights.

Now the Municipal Bureau of Land and Resources has announced the cancellation of the document requirements of Bengbu Municipal People's Government (No.2009125) according to the Notice on Publishing the Results of Normative Document Cleaning. According to Item 14 of Article 19 of the Regulations for the Implementation of the Labor Contract Law of the People's Republic of China, we want to collectively dismiss these people, but in our research,

Article 14 of the Labor Contract Law stipulates that an employee who has worked in an employer continuously for ten years shall conclude an open-ended labor contract, unless the employee proposes to conclude a fixed-term labor contract; If the employer fails to conclude a written labor contract with the employee within one year from the date of employment, it shall be deemed that the employer has concluded an open-ended labor contract with the employee. Then, according to the provisions of the Labor Contract Law, we have formed a labor contract relationship with the Land and Resources Bureau without a fixed term, and the Land and Resources Bureau has no right to dismiss us without authorization.

3. In Jindi Company, the former Land and Resources Bureau, all employees were laid off and went home for a period of time, and each employee had certain economic compensation. As far as we know, Director Han Qinghua has arranged for those people who have bought services and connections for a period of time to come back, and arranged for some children of relatives of relevant leaders in the city to come in, and arranged those people with the posts and establishment originally arranged by us. We have worked in our posts for more than ten years, being conscientious and proficient in business. We are on-the-job and skilled in business. Aren't we insignificant little people? Is this fair? This makes us feel extremely unfair and loses fairness. Is power for the people or for money?

In addition, some of these people have unknown origins, poor quality and violate the law and discipline. For example, Xu Tao, the former administrator of Yanshan Tuguan Institute, was arrested for rape only half a year after editing; Wang Zhenyuan, director of Yanshan Tuguan Institute, was hired as a driver (temporary worker) by Huaishang District. Zhao Yu, a branch of Benshan Branch, privately carved the financial official seal, falsely invoiced and collected fees, and privately issued the land use right certificate to the applicant for personal economic benefits. Yao Nannan of the Yu Hui branch took over the other four positions. Why do these people who violate the law and discipline become legal after black-box operation? Those of us who are legal, have made great contributions to the municipal finance in the annual land transfer fee collection post for many years, and have devoted our youth to the land and resources management post, but now they are illegal and will be laid off. What is fairness? Where is justice? Where is justice? Where is the law and discipline? With such leading cadres in society, how can society be harmonious? How can society be stable?

In order to safeguard our legitimate rights and interests, we ask the central leadership to pay attention to our survival and work issues during their busy schedules and safeguard our legitimate rights and interests. Our appeal is:

2. We are old people before the establishment of the Bureau of Land and Resources, and we have been engaged in land management for more than ten years, so we should give priority to career establishment. The personnel of Gemdale Company simply do not have the entry requirements. Now they are illegally employed, and we will never allow them.

3. We demand equal pay for equal work and the same treatment as other people in the Bureau of Land and Resources.
