Detailed Rules for the Implementation of Measures for the Administration of Emergency Plans for Production Safety Accidents in Hebei Province

Chapter I General Provisions

Article 1 In order to standardize and strengthen the administration of emergency plans for production safety accidents and further improve the emergency plan system, in accordance with the Law of the People's Republic of China on Work Safety and the Measures for the Administration of Emergency Plans for Production Safety Accidents,

article 2 these rules shall apply to the preparation, review, release, filing, training, drills, revisions, rewards and punishments of emergency plans for production safety accidents within the administrative area of this province.

if there are other provisions in laws, regulations and rules, such provisions shall prevail.

article 3 the management of emergency plans shall follow the principles of comprehensive coordination, classified management, graded responsibility and territorial priority.

Article 4 The Provincial Administration of Work Safety shall be responsible for the comprehensive management and coordination of the emergency plans for work safety in the whole province. Other departments of the provincial government responsible for the supervision and administration of production safety shall be responsible for the management of emergency plans in their respective industries and fields.

the safety production supervision and management departments of the people's governments at or above the county level are responsible for the comprehensive management and coordination of emergency plans within their respective administrative areas. Other departments of the people's governments at or above the county level responsible for the supervision and administration of production safety shall be responsible for the management of emergency plans in their respective industries and fields.

the principal responsible persons of people's governments at all levels and relevant departments, central units in Hebei and production and business units are the first responsible persons of their respective regions and units for emergency management of production safety, and are responsible for organizing and leading the preparation, review, filing, publicity, training and drills of emergency plans for production safety, and implementing various measures determined in emergency plans.

Chapter II Preparation of Emergency Plan

Article 5 The preparation of emergency plan shall meet the following basic requirements:

(1) It shall comply with the provisions of relevant laws, regulations, rules and standards;

(2) combining the actual situation of production safety in the local area, departments and units;

(3) combining the risk analysis of the local area, the department and the unit;

(4) define the division of responsibilities between emergency organizations and personnel, and have specific implementation measures;

(5) Having clear and specific accident prevention measures and emergency procedures, which are compatible with their emergency response capabilities;

(6) There are clear emergency safeguard measures, which can meet the emergency work requirements of the local area, departments and units;

(7) The basic elements of the plan are complete and complete, and the attachment information is accurate and updated in time;

(8) The contents of the plan are connected with relevant emergency plans.

article 6 the compilation of special emergency plans and departmental emergency plans of people's governments at or above the county level and relevant departments shall comply with the relevant requirements of laws, regulations and rules, and be compiled in accordance with the requirements of the overall emergency plan of the people's government of Hebei province and the emergency plan of production safety accidents and disasters in Hebei province. The emergency plan should include the following basic elements:

(1) General rules. Including the purpose, basis, concept and classification, scope of application and working principles.

(2) Organization and responsibilities. Including emergency response leading institutions, organizational systems, offices and related working institutions and corresponding job responsibilities.

(3) Early warning mechanism. Including information monitoring and reporting, forecasting and early warning actions, emergency handling and other operational mechanisms, and should be based on the degree of harm, urgency and development trend that accidents may cause, divide early warning levels and establish an early warning information release mechanism.

(4) emergency response. Including grading response, response procedures, command and coordination, on-site emergency treatment, information release and emergency procedures and measures.

(5) Post-treatment. Including after-care disposal, social assistance, insurance, accident investigation and summary.

(6) safeguard mechanism. Including human resources, financial resources, materials, communications, publicity, training and exercises, supervision and inspection.

(7) supplementary provisions. Including terminology, plan management and update, rewards and punishments and accountability, formulation and interpretation departments, plan implementation time, etc.

(8) attachments. Including work flow chart, address book of relevant units, emergency resource situation table, etc.

article 7 the preparation of emergency plans of production and business operation entities shall be carried out in accordance with the requirements of relevant laws, regulations and standards and the guidelines for the preparation of emergency plans for production safety of production and business operation entities (AQ/T92-26) (hereinafter referred to as the "guidelines"), in combination with the hazard situation, risk analysis and characteristics of possible accidents of the entity.

according to different situations, the emergency plans of production and business units are divided into comprehensive emergency plans, special emergency plans and on-site disposal plans.

if a production and business operation entity has many risks and may have many types of accidents, it shall organize the preparation of its comprehensive emergency plan. The comprehensive emergency plan shall include the hazard situation of the unit, the emergency organization and its responsibilities, accident prevention and early warning, emergency response, post-treatment and emergency support, emergency training and emergency plan drills.

for a certain kind of risk, the production and business operation entities should formulate corresponding special emergency plans according to the existing major hazard sources and possible accident types. The special emergency plan shall include risk analysis, characteristics of possible accidents, emergency organization and responsibilities, preventive measures, emergency handling procedures and emergency support.

for the key posts with greater risk, the production and business operation entity shall formulate the on-site disposal plan for the key posts. The on-site disposal plan shall include hazard analysis, characteristics of possible accidents, emergency disposal procedures, emergency disposal points and matters needing attention.

article 8 the comprehensive emergency plan, special emergency plan and on-site disposal plan compiled by production and business operation entities shall be connected with each other, and with the emergency plans of the governments involved, relevant departments and surrounding units to form a system to meet the needs of emergency rescue work.

Chapter III Evaluation of Emergency Plans

Article 9 The safety production supervision and management departments at or above the county level and other departments responsible for safety production supervision and management shall organize relevant experts to examine and approve the emergency plans prepared by their own departments; Involving the functions of relevant departments or needing the cooperation of relevant departments, it shall obtain the consent of relevant departments.

article 1 mining, metallurgy, petroleum, construction units, production, operation, storage and use units of inflammable and explosive substances, dangerous chemicals, radioactive substances and other production and business units above medium scale shall organize experts to review the emergency plans prepared by their own units. The review shall form a written summary with a list of experts.

other production and business operation entities other than those specified in the preceding paragraph shall demonstrate the emergency plan prepared by the entity.

article 11 the personnel participating in the emergency plan review shall include the emergency management department of production safety involved in the emergency plan filing, the staff of the industrial safety supervision department and more than 3 experts recognized by the safety supervision and management department.

if the reviewer has an interest in the production and business operation entity of the reviewed plan, he should withdraw.

article 12 emergency plan review adopts two methods: formal review and factor review.

Formal review is mainly used for the review of emergency plan filing. Mainly based on the Guidelines and relevant industry norms, the hierarchical structure, content format, language, annex items and preparation procedures of emergency plans are reviewed, with emphasis on the standardization and preparation procedures of emergency plans. See Annex 1 for the specific contents and requirements of formal review of emergency plans.

factor review is mainly used for emergency plan review organized by production and business units. Mainly according to the relevant national laws and regulations, the "Guidelines" and relevant industry norms, the emergency plan is reviewed from the aspects of legality, completeness, pertinence, practicality, scientificity, operability and cohesion. In the specific review process, the elements of the emergency plan are mainly reviewed by list. See Annexes 2, 3, 4 and 5 for the specific contents and requirements of the review of emergency plan elements.

article 13 the review or demonstration of emergency plans shall conform to the requirements of the guidelines for review of emergency plans for production and business units (for trial implementation) issued by the state administration of work safety (No.73 [29] of the general office of work safety), and pay attention to the legality of emergency plans, the integrity of basic elements, the pertinence of preventive measures, the scientific organizational system, the operability and feasibility of emergency response procedures and safeguard measures, and the cohesion of emergency plans.

article 14 if the emergency plan of a production and business operation entity fails to meet the relevant requirements after review or demonstration, the production and business operation entity shall revise and improve the emergency plan according to the review opinions. If the review opinions require re-organization, the production and business operation entity shall organize relevant departments and personnel to re-evaluate the emergency plan.

article 15 if the emergency plan of a production and business operation entity meets the relevant requirements after review or demonstration, it shall be signed and announced by the principal responsible person of the production and business operation entity.

Chapter IV Filing of Emergency Plans

Article 16 The emergency plans for production safety shall be filed according to the principle of classified management and graded responsibility.

Article 17 The special emergency plan for production safety formulated and issued by the people's government at or above the county level shall be reported to the people's government at the next higher level and the supervision and administration department for production safety for the record.

article 18 the emergency plan formulated and issued by the safety production supervision and administration department of the people's government at or above the county level shall be reported to the people's government at the same level and the safety production supervision and administration department at the next higher level for the record.

the emergency plans for production safety formulated by other departments responsible for production safety supervision and management shall be copied to the production safety supervision and management departments at the same level.

article 19 the comprehensive emergency plan and special emergency plan for production safety formulated by enterprises (hereinafter referred to as provincial enterprises) with the central government in Hebei and the provincial SASAC performing the responsibilities of investors shall be reported to the provincial production safety supervision and management departments for the record, and copied to the relevant competent departments and the production safety supervision and management departments of the local people's governments with districts and cities.

if the enterprises below the provincial level are involved in the implementation of the administrative license for safe production, their comprehensive emergency plans and special emergency plans should be reported to the safety production supervision and management departments of cities and districts for the record, and copied to the competent departments of industries in cities and districts. Where the administrative license for production safety is not involved, the filing of its comprehensive emergency plan and special emergency plan shall be formulated by the safety production supervision and management department of the city with districts.

Article 2 When applying for emergency plan filing, a production and business operation entity shall submit the following materials:

(1) An application form for emergency plan filing;

(2) emergency plan review or demonstration opinions;

(3) emergency plan text and electronic documents.

article 21 the safety production supervision and management department that accepts the filing and registration shall examine the materials that should be submitted by the production and business operation entities, and if they meet the requirements after examination, put them on record and issue an emergency plan filing and registration form; Do not meet the requirements, the feedback submitted to the unit, submitted to the unit after modification, re submitted for the record.

for the production and business operation entities that have implemented the safety production license, if the emergency plan has been filed and registered, the original registration form of the emergency plan should be provided when applying for the safety production license, and the corresponding emergency plan may not be provided.

article 22 the safety production supervision and management departments at all levels shall actively guide, supervise and inspect the production and business operation entities to do a good job in filing and registering emergency plans, and establish an emergency plan management system and an emergency plan database for easy access and use.

chapter v implementation of emergency plan

article 23 the safety production supervision and management departments at all levels are responsible for the comprehensive supervision and management of emergency plans within their respective administrative areas, and incorporate the management of emergency plans into the assessment of safety production target management, and strengthen the supervision and inspection of emergency plans.

article 24 safety production supervision and management departments at all levels, other departments responsible for safety production supervision and management, and production and business units shall carry out publicity and education on emergency plans in various forms, popularize knowledge of prevention, avoidance, self-help and mutual rescue of production safety accidents, and improve employees' safety awareness and emergency handling skills.

article 25 the safety production supervision and management departments at all levels shall incorporate the training of emergency plans into the work plan of safety production training, and organize and implement the training of emergency plans of key production and business units within their respective administrative areas.

the production and business operation entity shall regularly organize the training of its own emergency plan, so that employees can be familiar with the contents of the emergency plan, master the emergency responsibilities, emergency procedures and post emergency response plans, and pass the examination.

the key points and procedures of the emergency plan should be posted in important posts and emergency command places, with obvious signs.

article 26 the safety production supervision and management departments at all levels and the competent departments of the industry shall regularly organize emergency plan drills, and organize comprehensive or professional drills at least once a year, so as to improve the emergency handling capacity of their own departments and regions for production safety accidents.

article 27 the production and business operation entity shall, in light of the actual situation of the entity and the possible production safety accidents, formulate its own emergency plan drill plan, organize a comprehensive emergency plan drill or a special emergency plan drill at least once a year, and organize an on-site disposal plan drill at least once every six months.

article 28 after the drill of emergency plan, the organizing unit of emergency plan drill shall evaluate the effect of emergency plan drill, write a written evaluation report of emergency plan drill, summarize the drill situation, analyze the existing problems, put forward the revision opinions of emergency plan and the next work plan, and report it to the safety production supervision and management department and relevant departments within 1 working days after the drill according to the principle of hierarchical management of emergency plan.

article 29 safety production supervision and management departments at all levels shall summarize the management of emergency plans every year. The summary of emergency plan management shall be reported to the safety production supervision and management department at the next higher level.

the summary of emergency plan management of other departments responsible for safety production supervision and management shall be copied to the safety production supervision and management department at the same level.

Article 3 The emergency plans formulated by local safety production supervision and management departments at all levels and other departments with safety production supervision and management responsibilities shall be revised in a timely manner according to laws, regulations, standards, plan drills and institutional changes.

article 31 the emergency plan formulated by the production and business operation entity shall be revised at least once every three years, and the revision of the plan shall be recorded and filed.

Article 32 In case of any of the following circumstances, the emergency plan shall be revised in time:

(1) The subordinate relationship, mode of operation and legal representative of the production and business operation entity have changed due to merger, reorganization and restructuring;

(2) the production process and technology of the production and business operation entity have changed;

(3) the surrounding environment changes, forming a new weight.
