Electronic seal refers to the official seal in the form of electronic data and the personal name seal with legal effect. It can be used for electronic documents, such as online signing and off-site signing of multi-party electronic contracts and agreements, internal examination and approval of enterprises, signing of labor contracts and filing of documents, issuing documents by government departments and daily government affairs handling.
The seal making unit shall comply with the following provisions:
1. Collect the basic information of the unit or institution using the seal, the valid ID information and contact information of the legal representative, operator and handler, the on-site image information of the handler, and the electronic seal making information;
2. Within 24 hours after the electronic seal is made, the required information shall be filed with the public security organ;
3. The electronic seal should be stored in special equipment that meets the requirements of national password management and kept strictly;
4. Do not change or delete the information of electronic seal making without authorization;
5. Shall not disclose or illegally use the relevant information of units or institutions or individuals obtained due to business activities;
6. The archival materials of electronic seals shall be kept for at least five years for inspection;
7. The video surveillance data of the business premises shall be kept for at least 90 days, and shall not be deleted, copied or leaked without authorization;
8. Electronic seals that have not been collected for more than three months shall be registered for cancellation and filed with the public security organ;
9. When issuing an electronic seal, it shall issue an electronic seal production certificate to the unit or institution.
Legitimacy and reliability of electronic seal
Article 13 of Chapter III of People's Republic of China (PRC) Electronic Signature Law shall be deemed as a reliable electronic signature if it meets the following conditions:
(1) When the electronic signature production data is used for electronic signature, it belongs to the exclusive rights of the electronic signer;
(2) When signing, the electronic signature production data is only controlled by the electronic signer;
(3) Any changes to the electronic signature after signature can be found;
(4) Any changes to the content and form of the data message after signature can be found.
Article 14 of Chapter III of People's Republic of China (PRC) Electronic Signature Law stipulates: "A reliable electronic signature has the same legal effect as a handwritten signature or seal."
