According to the newly revised Notice of Tianjin Municipal People's Government on Printing and Distributing the Measures for the Administration of Residence Permit in Tianjin (J.Z.G. [2021] No.6), Tianjin Public Security Bureau drafted the Detailed Rules for Handling Residence Permit in Tianjin and the Detailed Rules for the Administration of Settlement of Residence Permit Points in Tianjin (hereinafter referred to as the Detailed Rules). We are now openly soliciting opinions from all walks of life. The time for soliciting opinions is from August 20th to August 26th.

Detailed rules for the implementation of Tianjin residence permit

Chapter one? general rule

Rule number one In order to do a good job in citizens' application for Tianjin Residence Permit (hereinafter referred to as residence permit), these rules are formulated in accordance with the Notice of Tianjin Municipal People's Government on Printing and Distributing the Measures for the Administration of Tianjin Residence Permit (J.F.F. [2021] No.6).

Rule number two Citizens who leave their permanent residence and come to this Municipality (hereinafter referred to as Tianjin citizens) shall apply for residence registration and residence permit within the administrative area of this Municipality.

Rule three. The public security organ is responsible for the acceptance, issuance, production, endorsement and cancellation of residence registration and residence permit applications. The community service agencies entrusted by the police station or the public security organs (hereinafter referred to as the accepting units) are specifically responsible for undertaking the application, endorsement, replacement and cancellation of residence registration and residence permit. Sub-district offices (Township People's governments) shall organize residents' committees (villagers' committees) to assist the police station to do a good job in the residence registration and service management of floating population.

District public security organs are responsible for issuing residence permits. The certification institution of the Municipal Public Security Bureau is responsible for the production of residence permits.

Article 4? Citizens who come to Tianjin do not charge household registration fees. The first application for residence permit is free; If the residence permit is renewed or reissued, each certificate shall be paid 10 yuan in accordance with the relevant provisions of this Municipality.

Article 5 The accepting entity and its staff shall keep confidential the information of citizens coming to Tianjin that they have learned in the service management of residence registration and residence permit of floating population. No unit or individual may disclose or illegally inquire about or use the information of residence registration managers and residence permit holders.

Chapter two? Residence registration

Article 6 Citizens coming to Tianjin who intend to live in this city for more than 7 days shall report their residence registration to the residential acceptance unit or through the Internet with their resident identity cards or other legal and valid identity documents. /kloc-minors under the age of 0/6, elderly people with mobility difficulties, disabled people, etc. Their guardians or close relatives may apply for residence registration on their behalf.

Article 7 The lessor and the employing unit shall, within 7 days after signing the contract and agreement, submit the information of citizens from Tianjin to the local police station where the rented house and dormitory are located, and at the same time lead citizens from Tianjin to go through residence registration at the accepting unit of residence.

Article 8? Citizens who come to Tianjin to stay in hotels, hotels, inns and other hotels, and to rent houses, homestays, farmhouses, baths, pedicures, massages and other business places that provide accommodation services, seek medical treatment in medical institutions, receive assistance in rescue management institutions, and register for accommodation, hospitalization or assistance in accordance with relevant regulations, may not apply for residence registration.

Article 9? Citizens who come to Tianjin to apply for residence registration shall submit their resident identity cards or other legal and valid identity documents and proof of legal residence to the accepting unit of residence or through the Internet.

Legal residence certificate:

(1) For self-occupation, provide the original or photocopy of the certificate of immovable property right (commercial house sales contract or stock house sales agreement) of my residence address in Tianjin;

(2) if you live in a rented house, provide the original or copy of the house lease contract;

(3) If you live in a resident's home, provide the original or photocopy of the immovable property certificate (commercial housing sales contract or stock house sales agreement) and the original or photocopy of the confirmation letter of the owner's consent to live;

(4) If you live in a unit (school), provide the original proof of accommodation issued by the unit (school);

(5) Other legal residence certificates.

Article 10? The accepting unit shall review the certification materials of citizens' declaration of residence registration, and accept them on the spot if they meet the declaration conditions and the certification materials are complete, and input the basic information of the applicant into the information system, print the "Residence Registration Certificate of Floating Population" and hand it over to the applicant for safekeeping. If the residence registration is handled through the Internet, the applicant can download and print the Residence Registration Certificate of Floating Population through the Internet after the acceptance unit has passed the examination.

Article 11? The public security organ shall collect the population information of Tianjin citizens in a timely, comprehensive and accurate manner, actively expand the channels for information declaration and collection, and make full use of information technology to facilitate citizens to declare their residence registration and relevant units to submit relevant information.

Chapter three? Residence permit application

Article 12? Those who have lived in this city for half a year and meet one of the conditions of legally stable residence, legally stable employment and continuous study can apply for a residence permit.

Article 13 The contents of the residence permit include: name, gender, nationality, date of birth, citizenship number, photo of myself, address of permanent residence, residential address, certificate issuing authority, endorsement period, etc.

Fourteenth need to apply for a residence permit, the applicant can go to the residence acceptance unit, or through the Internet. /kloc-minors under the age of 0/6, elderly people with mobility difficulties, disabled people, etc. , you can apply for a residence permit by your guardian or close relatives.

Fifteenth to apply for a residence permit, the applicant shall submit the following materials to the accepting unit or through the Internet:

(a) residence registration for 6 months, need to provide:

1. My resident ID card or household registration book.

2. My recent photo. If the accepting unit can import the recent photos of the applicant from the population information management system and meet the accreditation criteria, the applicant does not need to submit photos.

(3) Proof of legal residence as stipulated in Article 10 of these Rules.

(2) If you have lived in this city for half a year but have not applied for residence registration or have applied for residence registration for less than half a year, in addition to providing the above certification materials, the applicant also needs to fill out a letter of commitment to live in Tianjin (provided by the accepting unit).

Where a guardian or a close relative handles it on his behalf, in addition to the certification materials specified in the preceding paragraph, the guardian shall also provide his/her resident identity card and a household register or birth certificate that can prove the relationship between the guardian and the ward, and the trustee shall also provide his/her resident identity card and the power of attorney signed by the client.

The applicant and the issuer of the relevant certification materials shall be responsible for the authenticity and legality of the certification materials stipulated in this article.

Article 16 A citizen holding a residence permit in Beijing or Hebei Province who meets one of the conditions of legally stable employment, legally stable residence and continuous study can provide the supporting materials specified in Article 15 of these Detailed Rules and the residence permit in Beijing and Hebei Province, and directly apply for a residence permit, which is not restricted by living in this city for half a year.

Article 17? After receiving the materials for applying for residence permit, the accepting unit shall check the materials.

If the application for residence permit is submitted to the accepting unit on the spot, it shall be accepted in time if the materials are complete. The Registration Form of Floating Population Residence shall be printed and signed by the applicant for confirmation, and a receipt certificate shall be issued. If the applicant needs it, the accepting unit may issue a residence permit acceptance certificate. If it is necessary to change or correct the residence registration information, the accepting unit shall accept the application for residence permit after changing or correcting the residence registration information. If the materials are incomplete, the accepting unit shall inform all the materials that need to be supplemented at one time.

If an application for a residence permit is submitted through the Internet, the accepting unit shall complete the material check and certificate review at one time after receiving the application, and issue certificates to those who meet the conditions for applying for a residence permit; If the materials do not meet the requirements or the verified residential information is untrue and illegal, it will not be distributed and the applicant will be informed of the reasons at one time through the network.

Chapter four? Review and release

Article 18? The police station where the residence permit applicant resides is responsible for verifying the authenticity and legality of the proof materials for residence permit application. The accepting unit shall, on the day of accepting the application for residence permit, transfer the certification materials provided by the applicant to the local police station for verification, and the local police station shall complete the verification within 5 days and feed back the results to the accepting unit.

Nineteenth residence permit application documents are true and legal, and the accepting unit shall complete the issuance within 5 days from the date of acceptance, and upload the certificate information to the certificate making institution of the Municipal Public Security Bureau. After verification, it is found that the proof materials for applying for residence permit are untrue and illegal, and the accepting unit shall reject the application for residence permit and inform the applicant of the result.

Chapter five? Production and sales

Article 20? The certification institution of the Municipal Public Security Bureau shall make and issue the residence permit within 10 days from the date of examination and issuance by the accepting unit. If the payment cannot be made on schedule due to special circumstances, the payment shall be made within 30 days at the longest from the date of acceptance. After receiving the certificate, the accepting unit shall promptly notify the applicant to receive the certificate.

Article 21? The accepting unit shall check the identity information of the recipient when issuing the residence permit, and recover the receipt certificate. If the applicant for residence permit entrusts others to apply for residence permit, the trustee shall provide legal and valid identity documents and receipts.

Chapter six? Certificate management

Article 22? One-year endorsement of residence permit 1 time. Holders of residence permits who live continuously in their places of residence shall, within/months before the date of residence 1 year 1 month, go through the formalities of endorsement at the acceptance unit of their current place of residence or through the internet. If the endorsement formalities are not completed within the time limit, the use function of residence permit will be suspended; If the endorsement formalities are completed, the use function of the residence permit will be restored, and the residence period of the residence permit holder will be continuously calculated from the date of the endorsement formalities.

Article 23? If the residence address of the residence permit holder changes, it shall, within 7 days from the date of change, go to the acceptance unit of residence or go through the formalities for changing the residence permit information with the residence permit and the changed legal residence certificate.

Article 24? If the residence permit is applied for endorsement within the validity period, and the holder promises to live, work and study legally in Tianjin, the accepting unit will go through the endorsement formalities on the spot.

To apply for endorsement of change of residence address, if the applicant lives in a legal house owned by himself or his immediate family members, he shall provide residence permit, proof of legal residence and proof of kinship, and the accepting unit shall handle the endorsement on the spot.

If the residence permit is not reissued within the time limit or the residence address changes, and the residence does not belong to the applicant and his immediate family members, the public security organ at the place of residence shall verify the applicant's residence within 5 days. If the verification results meet the conditions for endorsement of residence permit, the accepting organ shall notify the applicant to go through the endorsement procedures; If the verification result does not meet the conditions for endorsement of residence permit, the accepting organ shall inform the applicant of the verification result and refuse to endorse it.

Article 25? If the residence permit is damaged or lost, the holder of the residence permit shall promptly go to the accepting unit or go through the procedures for renewal and replacement through the Internet.

If the residence permit holder's household registration information is changed or corrected, he can go through the redemption procedures at the accepting unit.

The accepting unit shall take back the original certificate when handling the redemption procedures. When renewing or renewing a new permit, the accepting department shall review the basic information of the holder of the residence permit and handle it in accordance with the working procedures and time limit for applying for the residence permit for the first time. The applicant should pay the fee for the residence permit.

Article 26? Residence permit holders have both paper residence permit and electronic residence permit. Electronic residence permit and paper residence permit have the same legal effect.

Citizens who come to Tianjin can apply for residence registration and residence permit through "Tianjin Online Service Hall", "Jin Xin Office" mobile phone application, "Tianjin Public Security" mobile phone application and "Tianjin Public Security and People's Livelihood Service Platform" WeChat official account. After Tianjin citizens apply for a residence permit successfully, they can log in to the "Tianjin Public Security" mobile phone application to automatically generate an electronic residence permit.

Article 27? In any of the following circumstances, the residence permit shall be cancelled by the public security organ after being recognized by the relevant department:

(a) the holder of the residence permit has obtained the residence permit by providing false certification materials at the time of application;

(two) the situation of the holder of the residence permit has changed and does not meet the conditions for applying for the residence permit;

(three) the holder of the residence permit has been converted into a permanent residence in this city;

(four) other circumstances that should be cancelled according to laws, regulations and rules.

If the residence permit is cancelled, it shall be recovered by the public security organ. If it cannot be recovered, it shall be cancelled by the public security organ. The cancellation information of residence permit shall be notified by the public security organ to all the accreditation units in the city.

Article 28? Residence permits recovered by public security organs at all levels shall be properly kept, registered and regularly destroyed in a centralized and unified manner.

Chapter seven? supplementary terms

Article 29? These rules shall come into force on, 2022 and shall be abolished on February, 2026.

Detailed Rules for the Implementation of Tianjin Residence Permit Points Settlement Management

Rule number one In order to do a good job in the settlement of residence permit (hereinafter referred to as residence permit) points in Tianjin, and ensure that holders of eligible residence permit points can settle in Tianjin smoothly, these Detailed Rules, the Notice of Tianjin Municipal People's Government on Printing and Distributing the Measures for the Administration of Residence Permit in Tianjin (Jin Zheng Gui [2021] No.6) and the national and municipal regulations on household registration management are formulated in accordance with the Provisional Regulations on Residence Permit of the State Council.

Rule number two These rules apply to the procedures for the acceptance, examination and settlement of residence permit holders.

Rule three. In accordance with the relevant provisions of the Notice of Tianjin Municipal People's Government on Printing and Distributing the Measures for the Administration of Residence Permits in Tianjin, the Municipal Public Security Bureau has set up special windows in the Municipal Administrative Service Center and Binhai New Area Administrative Service Center to be responsible for the acceptance, review, supervision and inspection of the settlement of points, and the District Public Security Bureau is responsible for the registration of resident accounts and the issuance of household registration books.

Article 4? The municipal administrative service center and the public security service window of Binhai New Area Administrative Service Center shall first review the applicant's household registration status through the national population information database when accepting the application for settlement of residence permit points online. If there is no registered permanent residence and the household registration information is "wrong", the application for settlement of points will not be accepted, and the corrected information will be re-processed.

If the applicant's identity information is approved, the next step shall be carried out in accordance with the prescribed procedures. Applicants should truthfully fill in their personal information when applying for settlement of points, and upload authentic and effective original photos of the materials:

(1) The front and back of the resident ID card (within the validity period);

(2) The front and back of Tianjin residence permit (within the validity period). If the residence permits in Beijing and Hebei have been renewed, they are also needed;

(3) the first page and personal page of the household registration book;

(4) Property right certificate, for applying to settle in the house owned by my spouse, parents or children, or the house between me and my spouse, parents or children, you must also provide the identity card, property right certificate, statement of consent to settle down, marriage certificate, birth certificate and other supporting materials that can prove kinship;

(five) the purchase of housing but did not obtain the "property certificate", upload the commercial housing sales contract or stock housing sales agreement and deed tax payment certificate;

(six) to apply for a collective account of the unit, upload the homepage of the collective account of the unit (a copy of which needs to be stamped with the official seal of the unit).

Article 5? If there is no legally stable residence in this city and the unit has not set up a collective account, it can apply for a collective account in the public employment and talent service institution designated by the human resources department of the city or district where the work unit is registered.

Article 6? The Municipal Public Security Bureau shall complete the registration and review of the Certificate of Permission to Move in within 10 working days from the date when the Municipal Bureau of Human Resources and Social Security issues the list of qualified personnel who have obtained points for settlement. After verification, the Certificate of Permission to Move in will be issued within 10 working days, and sent to the place designated by the applicant by express mail.

Article 7? The applicant shall, within 40 days from the date of receiving the certificate of permission to move in issued by the public security organ, move his account out of the public security organ. Within 30 days after the account is moved out, go through the settlement formalities with the original of the following materials to the public security organ where the account is to be settled:

(1) The third copy of the immigration permit certificate;

(2) proof of household registration;

(3) my resident identity card;

(4) One-inch color photos;

(5) materials of residence. Apply for the legally owned house under the name of himself or his immediate family members, and provide the property right certificate, the certificate of kinship and the certificate of consent of the property owner; To apply for settlement in a unit collective household, provide a copy of the home page of the unit collective household and affix the official seal.

Article 8? According to the Regulations of People's Republic of China (PRC) Municipality on Household Registration, the Law of People's Republic of China (PRC) Municipality on Public Security Administration Punishment, and the Notice of the State Council Municipality on Approving the Provisions of the Ministry of Public Security on the Migration of registered permanent residence (Guo Fa [1977] 140), if the applicant for settlement of points provides false documents and materials to defraud the settlement of points, the public security organ shall punish him according to law. Those who have settled down will cancel their accounts in our city according to the policy of children relying on their parents, spouses relying on their children and parents relying on their children; If a crime is constituted, criminal responsibility shall be investigated according to law.
