According to Xinhua News Agency, the practice of signing the operation by the patient's family will change. From September 1 ST, whether or not to accept surgical treatment must be signed and agreed by the patient himself. This is a new regulation made by the Ministry of Health in the "Basic Specification for Medical Record Writing (Trial)" recently. Medical disputes caused by "the relatives of patients sign and agree to medical activities" have occurred frequently recently. Some patients said that they didn't know to remove important organs beforehand and that the operation might lead to serious complications. Or the patient's spouse does not agree with the child's signature, which causes the operation to be delayed. Relevant persons have repeatedly called for changing the signature of family members to the signature of the patient himself in accordance with international practice.
The new regulations have unified regulations on the writing of medical records. Among them, the "patient's signature" is defined in the writing of "consent for operation", "consent for special examination and special treatment" and other clauses. When the patient does not have full capacity for civil conduct, it should be signed by his legal representative; When the patient is unable to sign due to illness, it should be signed by his close relatives, or if there is no close relatives, it should be signed by his related person; In order to rescue the patient, the person in charge of the medical institution or the authorized person in charge may sign it if the legal representative or close relatives or related parties cannot sign it in time. In addition, if it is not appropriate to explain the situation to the patient due to the implementation of protective medical measures, the medical staff should inform the patient's close relatives of the relevant situation, and the close relatives of the patient will sign the consent form and record it in time.
It will be implemented on September 1st
