Being mentally ill
The root cause of being mentally ill is the abuse of power and wanton expansion.
——Cheng Lei, associate professor at the School of Law, Renmin University of China
There are two normal situations in compulsory psychiatric treatment: patients who should be admitted are turned away because they have no money for treatment, and patients who should not be admitted are Individuals who were admitted were forced to undergo treatment. The direct consequence of this misallocation of scarce medical resources is that everyone may become a victim and face dual threats from mental hospitals and untreated patients.
——Zhang Zanning, professor at Southeast University School of Law and director of the Institute of Health Law
According to the provisions of the General Principles of Civil Law, relatives need to apply to the court before sending a mental patient to hospital for treatment. The court made a declaration. Only after a court declaration is made public, the relevant relatives are qualified as guardians of the mental patient and can the patient be sent to a mental hospital for treatment. The reality is that most suspected mental patients are sent directly to treatment. However, existing laws cannot effectively circumvent cases of medical treatment with bad intentions.
