Legal analysis
The law stipulates that the indictment should be sent to the defendant by the court. However, in practice, the court generally does not send staff to deliver documents to the defendant, but will call the defendant to come to the court to get them. If the respondent is unable to notify, it shall be delivered by post and the respondent shall be required to sign for confirmation. If the respondent's address changes or other reasons lead to the failure to serve the indictment, the court shall make an announcement in the local media and the court bulletin board, and the announcement shall be deemed as automatic service after 60 days. In civil and administrative cases, the plaintiff may entrust a lawyer to submit an indictment to the court, and the lawyer will represent the lawsuit. It is not necessary to write the indictment himself or file a case in the court. In criminal cases, the procuratorate shall transfer the case to the court for prosecution. The people's court shall complete the examination of criminal private prosecution cases within fifteen days. After examination, if it meets the acceptance conditions, it shall decide to file a case, and notify the private prosecutor in writing or inform the person on his behalf. If a civil case meets the conditions for prosecution, it shall be filed within seven days and the parties concerned shall be notified; Those who do not meet the conditions for prosecution shall make a ruling within seven days and will not be accepted. After the indictment is submitted to the court, there will be a specific filing time. If you haven't heard from the court by then, you can personally ask the specific reasons.
