I. Provisions on Employee Vacation System
(1) Personal leave
1. Employees who take personal leave will not receive attendance bonus this month;
2. With the approval of the company, employees can take unpaid personal leave, but it does not exceed ten working days per year; Personal leave exceeding 5 days must be submitted one week in advance;
3. If the employee's personal leave exceeds the maximum period stipulated by the company, it will affect the normal work of the company, and the company will consider him to leave the company automatically.
4. The salary deduction formula is (basic salary+subsidy) ÷2 1 and 75× days of personal leave.
(2) Sick leave:
1. The sick leave certificate must be issued by a regular hospital designated by the company;
2. The sick leave certificate recovered by employees must include:
(1) The medical certificate of the doctor in the designated hospital above Grade II;
(2) Sick leave for doctors in designated hospitals at or above the second level.
3. If the company finds that the sick leave certificate is unqualified, it will be regarded as personal leave, and the corresponding salary and attendance award of the employee on that day will be deducted; If there is fraud, if the circumstances are serious, it will be expelled from the company;
4. The monthly review period of employee sick leave is from this month 18 to next month 17:
(1) The monthly sick leave cannot exceed 1 day.
(2) Accumulated sick leave per month > 1≤2, deducting attendance award 100 yuan.
(3) cumulative sick leave per month > 2. Deduct the attendance award 200 yuan.
The rest of the wages are strictly in accordance with the deduction rate of sick pay stipulated in the Employee Code and the Employee Manual of the Company's Personnel Department (see the Employee Code and Employee Manual for details).
Operating rules: employees must submit the leave form to the administrative staff for registration within one week after their leave. If it's more than a week (referring to coming back from vacation)
Companies that fail to pay holidays will be regarded as personal holidays and deducted from the salary of the month.
(3) Annual leave:
The company will give employees annual leave so that they can have enough rest time after work. The company encourages everyone to make full use of annual leave to rest.
The conditions for enjoying paid annual leave are as follows:
1. All employees of the company can enjoy 12 working days of annual leave after one year of service. Every year of service, the annual leave can be increased by one working day on the original basis, and the maximum annual leave is no more than 20 working days. During the probation period, employees do not enjoy annual leave.
2. In the first year of service, the annual leave that employees can enjoy is calculated according to the proportion of employment time in that year:
Working days ÷365 days × 12 days
3. When the employee's employment relationship is terminated, the average salary of unused annual leave shall be calculated in proportion to the employment period of the current year:
Monthly basic salary ÷2 1. 75× remaining annual leave days
Annual leave must be applied in advance:
(1) Leave application ≤ 1 must be submitted 1 working days in advance;
(2) Applications for leave for less than five consecutive days must be submitted three working days in advance;
(3) Applications for leave for five consecutive days must be submitted one week in advance;
(4) Leave applications for more than ten consecutive working days must be submitted two weeks in advance.
Operating rules: Any employee taking annual leave must fill in a formal annual leave application form, submit it to the department manager for approval, and then submit it to the administrative staff for registration. The company does not accept any form of leave application (except in special circumstances). (The employee's annual leave form is submitted by the supervisor and the supervisor's annual leave form manager. )
(4) Examination leave
Employees who have completed the probation period can apply for no more than five days' examination leave within one year, and they are only allowed to take the examination leave when the examination day conflicts with the working day, and the examination subjects must be related to the work they are engaged in when applying for the examination leave.
Employees should explain their intention to apply for examination leave to their immediate supervisor at least 30 days before the examination leave, fill in the leave application form, and submit it to the Human Resources Department together with a copy of the admission ticket after being signed by the supervisor. Employees should also report the inspection results to the company.
When the employee leaves the company within 12 months after the examination results are announced, the company reserves the right to demand full payment of the employee's salary for each day of examination leave.
(5) Marriage leave
After the probation period, employees can enjoy marriage leave if they get married legally for the first time with certificates. Marriage leave should be applied at least one month in advance, and employees can enjoy normal salary during marriage leave.
(6) Maternity leave
Female workers enjoy maternity leave stipulated by family planning:
1. Female employees are entitled to half a day's paid maternity leave every month after three months of pregnancy;
2. After six months of pregnancy, it is not appropriate to arrange night shift, and the post should be temporarily adjusted when necessary;
3. Female employees can enjoy ***90 days maternity leave with full pay, including prenatal 15 days;
4. Female employees whose babies are less than one year old can enjoy 1 hour paid breastfeeding leave every day;
5. Maternity leave must be taken continuously at one time within the specified time.
Pregnant female employees should discuss the schedule and plan related to pregnancy with their immediate supervisor so as to make appropriate arrangements in advance.
(7) bereavement leave
Employees who have passed the probation period can enjoy 5 days of funeral leave when their spouses, parents or children die; When their grandparents die, they can enjoy two days' funeral leave. Funeral leave should be approved in advance (it can be exempted if there are justified reasons).
Funeral leave is only valid for five days after the incident and should be taken within these five days. If the funeral of the above-mentioned relatives is not held at the employee's workplace, the travel leave shall be increased for no more than three days according to the distance. Employees will enjoy normal wages during the above holidays.
Second, is it legal for employees to take leave without approval?
For personal leave, there are not many legal provisions; It is within the scope of negotiation between the two parties. You have reason to ask for leave. If the other party does not give you leave without corresponding reasons, it is illegal to treat it as absenteeism directly. If the other party terminates the labor contract by this, it may apply for labor arbitration and claim compensation; Work 1 year, with 2 months' salary.
If an employee asks for personal leave within the system working days, the calculation of his/her daily salary: under normal circumstances, 70% of his/her monthly take-home salary is divided by the monthly system working days. The deduction of the salary part shall be calculated by multiplying the number of days of personal leave by the daily salary. Deduction of the bonus part shall be implemented in accordance with the provisions of the bonus plan and payment method of the unit.
Third, the employee leave process
All leave should be submitted to the clerk in writing. The application for leave is in quadruplicate, which should be filled in for more than three days, submitted to the shift supervisor and signed by the manager.
Any employee who asks for leave, goes to work before the holiday or exceeds the holiday must go to the department to cancel or renew his leave. Those who have not gone through the formalities of terminating their leave will not be paid to work during the holiday, and those who have gone beyond the leave but have not gone through the formalities of renewing their leave will be regarded as absenteeism.
If an employee asks for personal leave within the system working days, the calculation of his/her daily salary: under normal circumstances, 70% of his/her monthly take-home salary is divided by the monthly system working days. The deduction of the salary part shall be calculated by multiplying the number of days of personal leave by the daily salary. Deduction of the bonus part shall be implemented in accordance with the provisions of the bonus plan and payment method of the unit. If an employee stops working for more than 6 months due to illness during the medical treatment period, his sick pay shall be calculated and paid according to the following methods:
(1) If the continuous length of service is less than 10 years, it will be paid at 60% of my salary;
(two) continuous service 10 years less than 20 years, according to my salary of 65%;
(three) continuous service for more than 20 years, according to 70% of my salary.
Workers who used to be national model workers, provincial (ministerial) model workers and units at or above the military level who awarded war heroes or won first-class merit and have always maintained honor are paid as usual during sick leave.
The sick pay received by employees during medical treatment shall not be less than 80% of the local minimum wage.
Employees have the right to enjoy sick leave, marriage leave, annual leave and other benefits. If personal leave is required, the corresponding salary shall be deducted according to the daily salary calculation method.
