The parties shall collect evidence to prove that the act of signing the IOUs at the beginning was a duty act, and the debts embodied in the IOUs are the corporate debts of the enterprises where the parties are located, not the personal debts of the parties. After collecting enough evidence, advocate that the unit bear the debt.

The parties concerned may collect recordings of conversations and telephone calls with the legal representative or other senior managers, evidence proving that the ownership of the refueling vehicles involved belongs to the legal person, and other evidence proving that the refueling money reflected in the IOU is generated by the refueling of vehicles belonging to the legal person.

2. An enterprise as a legal person is responsible for the business activities of its legal representative or other personnel.

The judicial basis is Articles 36, 37, 4 1, 42 and 90 of the General Principles of Civil Law of People's Republic of China (PRC).
