The methods of service of summons for divorce proceedings are: (1) Direct service. The service personnel of the People’s Court will directly deliver the litigation documents and legal documents that need to be served. Give it to the person to be served or his adult family member, collector or litigation agent living with him. In divorce proceedings, the person should sign for receipt. (2) Delivery with lien. When delivering litigation documents and legal documents that need to be served to the person to be served or the person qualified to accept service, and the person being served or the person qualified to accept service refuses to sign for them, the person to be served shall transfer the litigation documents, legal documents to the person to be served in accordance with the law. The document is left at the addressee's residence. When making service with a lien, the server shall invite representatives of the relevant grassroots organizations or the unit where the recipient is located to be present as witnesses. The service personnel of the People's Court shall explain the situation to the witnesses and record the recipient's name on the service receipt. The reason for refusal by the sender and the date of delivery shall be signed or stamped on the delivery receipt by the sender and witness. (3) Delivery by entrustment. It is indeed difficult for the court receiving the lawsuit to directly serve the case, and other courts are entrusted to deliver the litigation documents and legal documents that need to be served to the recipient. In terms of procedures, the entrusting court shall issue a letter of entrustment, together with the litigation documents, legal documents and service receipts that need to be served. (4) Delivery by mail. If direct service is difficult, the People's Court of the People's Republic of China will mail the litigation documents or legal documents to be served to the recipient through the post office by registered mail. Mail delivery should be accompanied by a delivery receipt. If the receipt date stated on the registered mail receipt does not match the receipt date stated on the delivery receipt or the delivery receipt is not returned, the registered mail receipt will be used. The receipt date stated on the package is the delivery date. (5) Delivery by transfer. Based on the relevant circumstances of the recipient, the people's court receiving the lawsuit will hand over the litigation documents and legal documents that need to be served to the relevant agencies and units and forward them to the recipient. The situations where transfer of service is applicable include: the recipient is a soldier, the recipient is imprisoned, or the recipient is reeducation through labor. (6) Delivery of announcement. When the whereabouts of the person to be served are unknown or the service cannot be delivered by the above methods, the court subject to the lawsuit will announce the main contents of the litigation documents and legal documents that need to be served. After 60 days from the date of issuance of the announcement, it will be deemed to be for delivery. Legal objectivity:
Article 88 of the "Civil Procedure Law" When serving litigation documents, they shall be delivered directly to the person to be served. If the person to be served is a citizen, he or she must hand it over to his adult family member who lives with him or her. If the person to be served is a legal person or other organization, the legal representative of the legal person or the principal person in charge of the other organization or the legal person or organization shall be responsible for the receipt. The recipient shall sign for receipt; if the recipient has a litigation agent, the document may be sent to his agent for signature; if the recipient has designated a collector to the people's court, the document shall be submitted to the recipient for signature. The date on which the adult family member living with the recipient, the person responsible for receiving the document from a legal person or other organization, the litigation agent or the recipient signs on the delivery receipt shall be the date of delivery. Article 89 If the person to be served or his adult family member living with him refuses to receive the litigation document, the person who serves the person may invite representatives of the relevant grassroots organizations or units to be present, explain the situation, and record the refusal on the service receipt. The cause and date shall be signed or stamped by the person delivering the service or the witness, and the litigation documents shall be left at the residence of the person to be served; the litigation documents may also be left at the residence of the person to be served, and recorded by taking photos, videos, etc. The delivery process shall be deemed as delivery. Article 90 With the consent of the person to be served, the people's court may serve litigation documents by electronic means that can confirm receipt. For judgments, rulings, and mediation documents served through electronic means, if the recipient requests a paper document, the People's Court shall provide it. If the service is delivered by the method mentioned in the preceding paragraph, the date when the delivery information reaches the recipient's specific system shall be the date of delivery. Article 91 If it is difficult to directly serve litigation documents, you may entrust another people's court to serve them on your behalf, or you may serve them by mail. If delivered by mail, the date of receipt stated on the return receipt shall be the date of delivery. Article 92 If the recipient is a soldier, the transfer shall be made through the political organ of the unit at or above the regiment where he is serving. Article 93 If the recipient is imprisoned, the transfer shall be made through the prison where he or she is located. If the recipient is subject to compulsory education measures, the case shall be transferred through the compulsory education institution where the recipient is located. Article 94 After receiving the litigation document, the agency or unit that forwards it must immediately hand it over to the person who delivers it for signature. The date of signature on the delivery receipt shall be the date of delivery. Article 95 If the whereabouts of the addressee are unknown, or if delivery cannot be made by other means stipulated in this section, service shall be made by public announcement.
It shall be deemed to have been served thirty days from the date of issuance of the announcement. When an announcement is made, the reason and process shall be recorded in the case file.
