Chapter 1 Definitions and Concepts
Article 1 Definition of terms in this contract
1. Travel agency refers to an enterprise legal person that has obtained the "Travel Agency Business License" and the "Enterprise Legal Person Business License" and engages in tourism business.
2. Tourists refer to mainland residents or groups who sign domestic travel contracts with travel agencies and participate in domestic travel activities.
3. Domestic tourism services refer to travel agencies that organize tourists to travel within the territory of the People's Republic of China (excluding Hong Kong, Macao and Taiwan) and book on their behalf in accordance with the "Travel Agency Regulations" and other laws and regulations. Public transportation tickets, arrangements for catering, accommodation, sightseeing and other service activities.
4. Tourism expenses refer to the expenses paid by tourists to travel agencies to purchase domestic tourism services.
Travel expenses include:
(1) Transportation expenses;
(2) Accommodation expenses;

(4) The first ticket fee for scenic spots arranged by the travel agency;
(5) Other project fees arranged in the itinerary;
(6) Tour guide service fees and other service fees of travel agencies (including travel agencies that pick up tourists at tourist destinations).
Travel expenses do not include:
(1) Personal travel insurance fees purchased by tourists;
(2) Items stipulated in the contract that require tourists to pay separately Expenses;
(3) Expenses not stipulated in the contract to be paid by the travel agency, including but not limited to expenses required for non-contracted activities other than the itinerary and expenses incurred during self-arranged activities;
(4) Tourist personal expenses incurred during the trip, including but not limited to non-free meals on transportation, overweight baggage fees, laundry, phone calls, beverages and alcohol fees during the stay, personal entertainment expenses, personal injuries Medical expenses, costs and remuneration for finding personal lost items, and compensation expenses due to personal reasons.
(5) Shopping places refer to places arranged in the "Travel Itinerary" that are dedicated to or mainly focused on shopping.
(6) Free activities refer to the free activities arranged in the "Travel Itinerary".
(7) The period of self-arranged activities refers to the period of free activities arranged in the "Travel Itinerary", the period when the tourist does not participate in the travel itinerary activities, before the start of the daily itinerary, and after the tourist leaves the accommodation facility. During the personal activity period, the tourist temporarily leaves the group with the consent of the tour guide.
(8) Travel agency liability insurance refers to the insurance subject matter that is based on the compensation liability that a travel agency shall bear to tourists and the persons appointed by it and providing services to tourists in accordance with the law for the tourism activities it organizes.
(9) Personal travel insurance insured by tourists refers to the insurance purchased by tourists themselves or through insurance agencies such as travel agencies, air ticket agencies, scenic spots, etc. to cover their own life, body, property or Short-term insurance with relevant interests as the subject of insurance includes but is not limited to aviation accident insurance, travel accident insurance, emergency rescue insurance, and special project accident insurance.
(10) Leaving the group refers to the behavior of a group tourist not to complete the agreed itinerary with the group with the consent of the tour guide.
(11) Departure from the group refers to the behavior of group tourists who leave the tour group without the consent of the tour guide and do not complete the agreed itinerary with the group.
(12) Group transfer refers to the act of a travel agency obtaining written consent from tourists to transfer tourists to domestic tour groups organized by other travel agencies before departure due to the lower number of people in the group.
(13) Group sharing means that the travel agency, on the premise of ensuring that the service content and standards promised remain unchanged, and with the consent of the tourists when signing the contract, form a group with tourists solicited by other travel agencies. (14) Force majeure refers to objective circumstances that cannot be foreseen, avoided and cannot be overcome, including but not limited to those caused by natural causes and social reasons, such as natural disasters, wars, terrorist activities, unrest, and riots , strikes, public health emergencies, government actions.
(15) Accidents refer to incidents caused by accidental factors other than intentionality or negligence of the parties, including but not limited to traffic jams caused by major concierge events, delayed trains and flights, and temporary closure of scenic spots.
(16) Business loss expenses refer to the economic losses incurred by travel agencies due to tourists withdrawing from the group before departure, including the cost of transportation such as airplanes (cars, boats) (including reservation fees), hotel accommodation Actual expenses incurred such as fees (including reservation deposit), car rental per capita for sightseeing cars, etc. For example, if a travel agency purchases group air tickets, it will implement a group preferential price with strict restrictions on use (cannot be changed, transferred, or refunded). Chapter 2 Signing of Contract
Article 2 Travel Itinerary Arrangement Form
The travel agency shall provide the "Travel Itinerary Arrangement Form" with the group number (hereinafter referred to as "Itinerary") shall become an integral part of this contract after being signed or stamped by both parties. The "Itinerary" should clearly explain the following contents:
(1) The starting point, passing places and destination of the travel itinerary, the route time and specific arrangements (calculated on a natural day basis, including flights) , cars, boats, etc., less than 24 hours will be counted as one day);
(2) Name, address, contact person and contact number of the travel agency at the tourist destination;
(3) Transportation service arrangements and their standards (clarify the means of transportation and class, departure time and whether transfer is required);
(4) Accommodation service arrangements and their standards (clarify the name of the accommodation hotel , location, star rating, non-star hotels should indicate whether they have air conditioning, hot water, independent toilets and other related service facilities);
(5) Dining (breakfast and dinner) service arrangements and standards ( Clarify the number of meals, locations, and standards);
(6) The specific content and time of the tour items uniformly arranged by the travel agency (clear the content of the tour route including the names of scenic spots and tour items, etc., and the minimum time to stay at the scenic spots) );
(7) Time and number of free activities;
(8) Shopping arrangements (list the number of shopping arrangements arranged by the travel agency, the name of the shopping place, the maximum time of stay and the main products, etc.);
(9) Entertainment activities arranged in the itinerary (clear the time, location and project content of the entertainment activities);

Article 3 Signing a Contract
Tourists should carefully read and understand the terms of this contract, the "Itinerary" and the "List of Additional Paid Items", and the travel agency and tourists should sign a written contract .
Article 4 Tourism Advertisements and Promotional Materials
Travel advertisements and promotional materials of travel agencies shall follow the principle of good faith and their content shall comply with the Contract Law of the People’s Republic of China and the People’s Republic of China. Anything stipulated in the offer shall be deemed an integral part of this contract and shall be binding on both the travel agency and the tourists.
Article 5 Contract Validity
This contract is made in two copies, with each party holding one copy. It has the same legal effect and takes effect from the date of signature or seal of both parties.
Chapter 3 Rights and Obligations of the Parties to the Contract
Article 6 Rights of Tourists
1. Request the travel agency to honor the travel itinerary in accordance with the contract and "Itinerary" Serve.

3. Reject group transfers, group bookings and shopping and separately paid item arrangements other than those agreed in the contract without prior agreement.

5. Other rights granted to consumers by the "Consumer Rights and Interests Protection Law of the People's Republic of China" and relevant laws and regulations.
Article 7 Tourists’ Obligations
1. Fill in the "Tour Registration Form", tourist safety card and other contents truthfully, and take responsibility for the filled-in contents truthfully. Inform travel agency staff of the personal health information related to travel activities that they inquire about, and the contact information provided must be frequently used or can be contacted in a timely manner.
2. Pay travel expenses as agreed in the contract.
3. Take good care of your luggage, especially valuables. You are responsible for any damage or loss caused by poor care and preservation.
4. When arranging activities by yourself, you should choose activities within the scope of the risk you can control, and be responsible for your own safety.
5. Complete the travel itinerary with the group in accordance with the contract, cooperate with the unified management of the tour guides, actively cooperate with the travel agency's emergency response when an emergency occurs, and take measures to prevent the expansion of losses.
6. When disputes occur during the itinerary, they should be resolved based on the principle of equal consultation, appropriate measures should be taken to prevent the expansion of losses, and actions such as refusing to board a plane (car, boat) should not be used to delay the itinerary or leave the group.
7. Abide by national and local laws, regulations and relevant provisions, do not engage in illegal activities during travel itineraries, and do not participate in pornography, gambling and drug-related activities.
8. Observe public order and social ethics, respect local religious beliefs, ethnic habits and customs, respect the personality of tourism service personnel, behave in a civilized manner, and do not make graffiti on landscapes or buildings. , don’t spit or litter.
9. If any personal injury or property loss is caused by one’s own reasons, such as crime, negligence, illness, or misjudgment of one’s own behavior, the tourist shall bear full responsibility.
10. When legitimate rights and interests are damaged and the travel agency is required to assist in making a claim, provide legal and valid credentials.
Article 8 Rights of Travel Agencies
1. Verify the relevant information provided by tourists, and decide whether to accept tourists to sign up for group tours based on their physical health and related conditions.
2. The full travel fee will be charged to the tourist in accordance with the contract.
3. When the tourism team encounters an emergency, it can take emergency avoidance measures and require tourists to cooperate.
4. Require tourists to abide by the travel itinerary as agreed in the contract, and reject unreasonable requests from tourists that exceed the contract.
5. Stop tourists from saying and doing things that violate laws and local customs.
Article 9 Obligations of travel agencies
1. Provide services to tourists in accordance with the content and standards agreed in the contract and "Itinerary".
2. Provide tourists with legal invoices for travel expenses.
3. Issue to tourists a security card written in a fixed format and filled out by the tourist containing personal information (including the tourist's name, blood type, emergency contact information, etc.).
4. Purchase travel agency liability insurance and remind tourists to purchase personal travel insurance.

6. 7. Arrange shopping and separately paid items in accordance with the contract, and do not force or force tourists in disguise to shop or participate in separately paid items.
8. If the tourist purchases counterfeit and shoddy goods at the shopping place arranged in the "Itinerary" and the tourist files a claim, the travel agency shall actively assist the tourist in making the claim. 11. If a group is organized as a group, the travel agency will still bear the responsibilities and obligations stipulated in this contract.
12. Keep tourists’ personal information confidential in accordance with the law, and properly keep various documents submitted by tourists.

Chapter 5 Elderly and Underage Tourists
Article 11 Special Agreement for Elderly Tourists

3. Article 12 Special Agreement for Underage Tourists

2. Underage tourists must be accompanied by their family members or obtain the consent of their family members and sign a supplementary agreement.
3. Parents or other guardians of minors shall protect the safety of accompanying minor tourists.
4. Chapter 6 Changes and Transfers of the Contract
Article 13 Changes of the Contract
1. The travel agency and the tourist may change this contract through mutual agreement. The contents of the agreement shall be confirmed in writing signed and sealed by both parties. The resulting increased travel expenses and losses caused to the other party shall be borne by the party proposing the change; the travel agency shall refund the resulting reduced travel expenses to the tourists.
2. If it is impossible to perform or continue to perform the contract due to force majeure or unexpected events, the travel agency can change the corresponding content after obtaining the consent of more than 50 members of the travel team. It is unable to solicit opinions or go through due to urgent circumstances. If the consultation fails to obtain the consent of more than 50 members, the travel agency may decide to change the content, but it must provide necessary proof for the decision.
3. If force majeure or unexpected events occur before the trip, both parties can cancel the trip or postpone the trip through negotiation. If the trip is canceled, the travel agency will fully refund the travel expenses to the tourists. If travel expenses have been incurred, they shall be reasonably shared by both parties after negotiation.
4. If force majeure is encountered during the itinerary and the contract cannot be continued to be performed, the travel agency shall refund the unincurred travel expenses to the tourists after implementing the changes in accordance with item 2 of this article. 5. Article 14 Transfer of Contract

The third party traveling conditions, therefore, the increased expenses shall be borne by the tourists, and the reduced expenses shall be refunded to the tourists.
Article 15 Arrangements for Failure to Form a Group

1. Group transfer: The travel agency can transfer the tourist to another group with the prior written consent of the tourist on the premise of ensuring that the promised service content and standards are not reduced. If the tourist and the travel agency to whom the tour is transferred sign a separate contract, the rights and obligations of this contract will be terminated.
2. Postponing the tour and changing the route: With the written consent of the tourist, the travel agency can postpone the tour or change the route to another group. Chapter 7 Termination of the Contract

Article 17 Termination of contract before travel
Tourists and travel agencies may terminate the contract in writing before travel.
If the contract is terminated more than 7 days (excluding the 7th day) before departure (calculated as the difference between the departure date minus the natural day of the arrival date of the cancellation notice, the same below), both parties will not be liable for breach of contract. If the travel agency proposes to terminate the contract, the travel expenses shall be refunded in full; if the tourist proposes to terminate the contract, if the travel expenses have already been incurred, the incurred tourism expenses shall be deducted. The travel agency shall refund the travel expenses to the tourists within 5 working days from the date of arrival of the notice of termination of the contract.
If a tourist or travel agency proposes to terminate the contract within 7 days (including the 7th day, the same below) before departure, the party who proposes to terminate the contract shall bear the liability for breach of contract.
Article 18 Termination of contract during the itinerary
1. If the tourist fails to arrive at the agreed gathering departure point at the agreed time, and fails to join the tour group during the departure, it will be deemed that The tourist's termination of the contract shall be handled in accordance with the relevant provisions of Article 19, Item 1 of this contract;

Chapter 8 Liability for breach of contract

2. If the tourist fails to pay the travel expenses in full within the time specified in this contract, the travel agency has the right to terminate the contract and require the tourist to bear the travel agency's business losses.
3. Tourists who do not follow the advice of the travel agency and its tour guide and thus affect the group's itinerary and cause losses to the travel agency shall bear corresponding liability for compensation.
4. The tourists shall be responsible for any losses caused by personal activities beyond the scope of this contract.
5. If the travel agency suffers damage due to the fault of the tourist, the tourist shall compensate for the loss.
6. When a dispute occurs with a travel agency, tourists should take active measures to prevent the loss from expanding, otherwise they should bear responsibility for the expanded loss.
Article 20 Liability for breach of contract by travel agencies
1. If the travel agency proposes to terminate the contract within 7 days (including the 7th day, the same below) before departure, it shall refund the full amount to the tourists. Amount of travel expenses, and liquidated damages will be paid to tourists according to the following standards: 7 to 4 days before departure, a penalty of 10% of the total travel expenses will be paid;

If the above liquidated damages are insufficient to compensate the tourists for their actual losses, the travel agency shall compensate the tourists based on the actual losses.
The travel agency shall refund the full travel fee to the tourist and pay the above-mentioned liquidated damages within 5 working days from the date of arrival of the group cancellation notice.
2. The travel agency failed to provide services as agreed in the contract, or adjusted the travel itinerary without the consent of the tourists (except for the circumstances stipulated in Item 2 of Article 13 of this contract), resulting in the reduction of items, shortening of travel time, or If the standard is lowered, measures should be taken to remedy it. If no remedial measures are taken or remedial measures have been taken but they are not enough to compensate for the losses of tourists, the corresponding compensation liability should be borne.
3. If a travel agency arranges additional paid items other than those stipulated in this contract without signature confirmation from tourists, it shall bear the cost of self-paid items; if it increases the number of shopping trips without authorization, 10% of the total travel expenses will be charged each time. Tourists must pay liquidated damages; if a travel agency forces or forces tourists to shop in disguised form, it shall pay 20% of the total travel expenses as liquidated damages to the tourists each time.
4. If a travel agency violates the contract and suspends the provision of accommodation, meals, transportation and other tourism services to tourists, it shall bear the same level of accommodation, meals, transportation and other services booked by tourists during the period of suspended tourism services. Wait for necessary expenses and pay the tourist a liquidated damages of 30% of the total travel expenses.
5. When disputes arise with tourists, travel agencies should take active measures to prevent the losses from expanding, otherwise they should bear responsibility for the expanded losses.
Article 21 Disclaimer
1. If the personal or property rights of tourists are damaged due to reasons such as third-party infringement that cannot be attributed to the travel agency, the travel agency will not be liable for compensation. responsibility. 2. 3. During the travel process, if air, ship, or railway operators lose or damage tourists’ checked luggage, tourists shall claim compensation from the above operators, and travel agencies shall fulfill their obligation to assist. Article 28 Dispute Resolution
If a dispute arises during the performance of this contract, it shall be resolved by both parties through negotiation, or a complaint may be made to the relevant departments such as the Tourism Quality Supervision and Management Office, Consumer Association, etc. with jurisdiction; through negotiation; Or if the complaint cannot be resolved, you may file a lawsuit with the People's Court at the place where the contract was signed, or apply for arbitration in accordance with the arbitration agreement or arbitration clauses separately reached.

1. If a tourist signs a contract on behalf of other tourists, the tourist is obliged to provide them with the matters agreed in this contract (including attachments and supplementary agreements). If the tourist fails to perform the above obligations, resulting in a dispute between the tourist it represents and the travel agency, and the travel agency is held civilly liable, the travel agency will bear civil liability.
