1. Conditions for handling:
1. The insured person complies with China's family planning laws and regulations.
2. Maternity leave (or family planning operation holiday) was in the state of normal insurance payment last month.
II. Required materials:
If the employer applies for maternity allowance from the social security agency to which the insured belongs:
1. Fill in the Application Form for Maternity Allowance by Foshan City Units.
2. If the employer changes during the maternity leave without interruption of payment, the maternity allowance will be issued to the employer at the time of delivery and the employer after the change during the maternity leave according to the salary payment during the maternity leave.
3. If the employer changes during maternity leave without interruption of payment, if the employer at the time of delivery has been cancelled during maternity leave, and there is a successor, the individual will apply for the maternity allowance of the cancelled unit, and the successor will apply for the maternity allowance of the successor.
4. if the insured employee does not enjoy the treatment of maternity medical expenses in the current birth, the original medical certificate of the medical institution shall be provided.
5. if the employer does not have a corporate account or the corporate account cannot be used, and it needs to be transferred to the corporate account or other "corporate accounts" of the company, the employer shall provide a description of the situation (without a template, write it by itself) and stamp it for confirmation.
6. For individual industrial and commercial households without unit seal, the application materials provided must be signed by the operator and printed with the operator's fingerprint.
if the employer fails to advance the maternity allowance without justifiable reasons, the insured should first go to the labor arbitration department or ask the employer to advance the maternity allowance through judicial channels.
if the employer still refuses to advance the maternity allowance, and the individual applies for the maternity allowance, he/she can show the certification materials issued by the relevant departments that the employer has not advanced the maternity allowance (note: the relevant certification materials issued after seeking help from the labor arbitration department or through judicial channels), and fill out the Foshan Personal Application Form for Maternity Allowance. When the second birth does not enjoy the treatment of maternity medical expenses, it is also necessary to provide the original medical certification materials of medical institutions.
if the conditions for payment of benefits are met, the social security agency will issue the Notice of Foshan Individual Entities Applying for Maternity Allowance to the employer based on the proof that the employer has not paid maternity allowance in advance to verify the payment of maternity leave wages of the insured. If the verification is consistent with the personal commitment, the social security agency will pay the allowance to the account provided by the individual within 3 days after verification. If the verification is inconsistent with the personal commitment, the relevant application materials will be returned.
If the business license of the employer is revoked, the employer is ordered to close down, or it is cancelled, and the employee applies for maternity allowance:
Fill in the Application Form for Individual Maternity Allowance in Foshan City, and provide the original or photocopy of the certification materials that the employer has cancelled. When the second birth does not enjoy the treatment of maternity medical expenses, it is also necessary to provide the original medical certification materials of medical institutions.
III. Handling process:
Generally, the application is made by the employing unit. If the employing unit stops its operation due to objective reasons and has no successor or fails to advance the maternity allowance without justifiable reasons, it can be made by the employee himself.
application by the company: if the employee participates in maternity insurance and the employer has paid the maternity allowance (i.e. salary) to him, the employer will apply to the social insurance agency for a one-time payment of the maternity allowance within 3 years from the day after the employee gives birth or performs family planning operation.
Personal application: Under any of the following circumstances, the employee can apply for maternity allowance directly to the social insurance agency where the employee is insured within 3 years after the maternity leave or family planning operation leave ends:
1. During the period when the employee enjoys maternity leave or family planning operation leave in accordance with relevant laws and regulations or after the holiday ends, the employer stops operating and fails to receive maternity allowance due to objective reasons such as revocation of business license, closure or cancellation, and there is no successor unit.
2. The employer fails to advance the maternity allowance without justifiable reasons.

Legal basis:
Article 56 of the Social Insurance Law of the People's Republic of China * * * Employees may enjoy maternity allowance in accordance with state regulations under any of the following circumstances:
(1) Female employees enjoy maternity leave when giving birth;
(2) Enjoy family planning operation leave;
(3) other circumstances stipulated by laws and regulations.
The maternity allowance is calculated and paid according to the average monthly salary of the employees in the employing unit of the previous year.
