1. The only evidence of drunk driving is the result of blowing test or blood test.
The Threshold and Test of Blood and Breath Alcohol Content of Vehicle Drivers stipulates that a driver whose alcohol content in 1ml of blood reaches 2mg and less than 8mg is deemed as drunk driving, and over 8mg is deemed as drunk driving
Second, the relevant provisions of the Procedures of Public Security Organs for Handling Criminal Cases of Drunk Driving:
Article 8 Breath Alcohol Test If the traffic police find that a motor vehicle driver is suspected of drunk driving during road duty enforcement
. The breath alcohol test shall print the written test results, which shall be signed by the parties concerned, signed or sealed by the
police. If the parties object to the test results or refuse to sign, the traffic police shall indicate it on the written test report < P >.
Article 9 Conditions for Blood Sampling If a party is suspected of driving a motor vehicle after drinking, he shall take a blood sample to test the alcohol content in his body:
(1) The breath alcohol test result meets or exceeds the drunk driving standard;
(2) disagreeing with the breath alcohol test results;
(3) refusing to cooperate with breath alcohol test and other methods;
(4) traffic accidents.
Article 1 Blood sampling procedures Blood samples shall be taken in accordance with the following procedures:
(1) At least two traffic policemen shall take the person concerned to a medical institution or a qualified inspection and appraisal institution or send personnel from the above-mentioned institutions to take blood samples, and supervise the whole process of blood sampling.
(2) Blood sampling should be carried out by professionals as required, and the traffic police should inform the blood sampling personnel to take two blood samples, and should not
disinfect the skin with alcohol drugs. Anticoagulant should be added to the blood samples, which should be packaged in clean and dry containers < P > and marked with the name of the person to be drawn and the time of blood drawing, and sealed in paper bags, one for filing and one for inspection. The sealed bag should
indicate the name of the person to be drawn, the drawing time and the purpose of the blood sample, and should be signed by the person to be drawn, signed by the traffic police and the blood drawing personnel or stamped with
. If the person who has been drawn blood or the person who has drawn blood refuses to sign or seal, the traffic police shall indicate it.
(3) Fill in the "Registration Form for Taking Blood Samples from the Clients", indicating the reasons, time, place and surname
of the person to be taken blood, and sign or seal it by the traffic police.
(4) The blood samples taken should be sent for inspection in time. If they cannot be sent for inspection in time, they should be kept at low temperature.
