Chapter I General Provisions
Article 1 In order to further strengthen the management of accounting work, standardize the management and use of bank seals reserved by depositors, effectively prevent risks, and ensure the safety of banks and customers' funds, these Measures are formulated in accordance with the Measures for the Administration of RMB Bank Settlement Accounts formulated by the People's Bank of China, the Detailed Rules for the Implementation of the Measures for the Administration of RMB Bank Settlement Accounts and the Operating Rules for Basic Accounting Business of China Bank formulated by the Head Office.
Article 2 The term "reserved seal" as mentioned in these Measures refers to the right certificate of the depositor when opening a bank settlement account in a bank, and it is also the audit basis for the deposit bank to handle the payment settlement.
Article 3 The reserved seal management of transactions such as the transfer of current funds, the transfer of valuable documents and important blank vouchers within the system, and the reserved seal management of foreign currency accounts shall be implemented with reference to these Measures.
Article 4 Branches and branches that use computer printing systems must formulate corresponding management measures in accordance with the provisions of these Measures and report them to the provincial bank (financial office) for the record.
Article 5 These Measures shall apply to business institutions and management banks at all levels in this province.
Chapter II Basic Provisions on Reserved Seal
Article 6 Where the depositor is a unit, the reserved bank seal shall be the official seal or special financial seal of the unit plus the signature or seal of the legal representative (person in charge of the unit) or its authorized agent. If the depositor is an individual, the reserved signature shall be personal signature or seal.
Article 7 The name of the depositor's official seal or special financial seal in the reserved signature of a bank shall be consistent with the account name of the bank settlement account applied for and the depositor's name recorded in the account opening certificate, except for the following circumstances:
(1) Temporary deposit account opened for capital verification of registered capital. The name of the account is the name indicated in the Notice of Pre-approval of Enterprise Name issued by the administrative department for industry and commerce or the approval of relevant government departments. The name of the official seal or special financial seal reserved in the bank seal is the name of the investor agreed by the depositor and the bank in the bank settlement account management agreement.
(2) If the name of the official seal or special financial seal in the reserved bank signature can be abbreviated according to law, the account name shall be consistent with it, and the abbreviation shall be clearly agreed in the bank settlement account management agreement.
(3) For a bank settlement account opened by an individual industrial and commercial household without a store name, the official seal or special financial seal in the reserved seal shall be the word "self-employed" plus the signature or seal of the manager specified in the business license.
Article 8 When an individual opens a personal bank settlement account with a reserved seal, the name of the personal settlement account shall be the same as that in the valid identity certificate provided.
Article 9 For the transfer of funds within the system, the reserved seal shall be the administrative seal or business seal of the institution plus the signature of the person in charge or business supervisor. For the allocation of valuable documents and important vouchers in the system, the reserved seal is the official seal of the institution's administration or business, plus the signature of the person in charge or business supervisor and the signature of the warehouse keeper.
Article 10 The signature card shall be kept in triplicate, one for the customer, one for the special folder together with the account opening information, and one for the signature card administrator.
If comprehensive teller system management or centralized processing of bill exchange is implemented, the number of reserved signature cards can only be increased after corresponding management measures are formulated.
Article 11 The reserved seal shall be clear and easy to identify and check. The signature on the reserved seal can be signature, seal or signature plus seal. Zhu Mo must be used for reserved seals, and atomic seals are not allowed.
Article 12 A special person must be appointed to be responsible for the storage and use of seals. Reservation, change and withdrawal of the seal must be reviewed by the class teacher and approved on the relevant business vouchers.
Chapter III Acceptance and Use of Reserved Seal
Article 13 Accept the application. According to the Regulations on Account Management of the People's Bank of China, an "application for opening an account" and a seal card are issued to the passbook account that applies for opening a checking account and is withdrawn by seal.
Article 14 Review procedures. After receiving the Application Form for Opening an Account and the seal card submitted by the applicant, the head teacher should carefully examine whether the address, telephone number, seal opening date and other contents filled in the seal card are complete and true, and whether the reserved seal stamped is in line with the provisions of Article 7 and Article 8. Whether the back of the reserved seal card for company account is stamped with the official seal of the company, and whether the back of the reserved seal card for personal account is signed by an individual. Check that the account opening information is correct, sign the seal card and give it to the teller to open an account.
Article 15 After opening an account, the teller shall fill in the account number on the signature card. After the business seal administrator seals the two cards retained by the bank, one seal card is retained together with the account opening information, one seal card is retained by the seal card keeper, and one seal card is returned to the customer.
Sixteenth seal card keeper is responsible for the daily payment business inspection. In general, it must be printed diagonally. Large cash withdrawals from corporate accounts of 654.38+10,000 yuan and above, personal accounts of 50,000 yuan and above, or transfer payments from corporate accounts of 200,000 yuan and above and personal accounts of 654.38+10,000 yuan and above must be printed diagonally. After review and printing, the reviewer and reviewer shall sign and seal the payment voucher seal at the lower right.
Chapter IV Preservation and Transfer of Reserved Seal
Article 17 The management of the seal card follows the principle of "whoever uses it, who keeps it and who is responsible", and the business institution shall designate a special person to keep it. When in use, it should be placed in the line of sight of the custodian or in the surveillance video.
Article 18 When the keeper of the seal card temporarily leaves his post during business hours, he shall box and lock the seal card; At the end of business, the signature card should be boxed and locked, unpacked together with the cash tail box or kept in the safe. The keeper of the seal card shall not lend the seal card he keeps to others for use.
Nineteenth seal card keeper shift, short-term leave and transfer, according to the relevant provisions of the handover work. When handling the handover, you need to register the teller handover register and indicate the number of signature cards; The receiver should carefully count the number of signature cards, and then go through the receiving procedures; At the time of handover, the second-level or above supervisor is responsible for supervising the handover.
Twentieth long-term transfer to the special account of the seal card should be taken out separately and stored in a special folder.
Chapter V Alteration of Reserved Seal
Article 21 When applying for replacing the reserved official seal or special financial seal, a unit depositor shall issue a written application for changing the seal, the original reserved official seal or special financial seal and other relevant certification materials to the bank where the account is opened.
Where a corporate depositor applies for replacing the reserved official seal or special financial seal, and cannot provide the original reserved official seal or special financial seal due to the loss of the official seal or special financial seal, it shall issue the original seal card, account opening permit, original business license, judicial department certificate and other relevant supporting documents to the account opening bank.
Twenty-second unit depositors to apply for replacement of the reserved official seal or special financial seal, can be handled directly by the legal representative or the person in charge of the unit, can also entrust others to handle.
Directly handled by the legal representative or the person in charge of the unit, in addition to the corresponding supporting documents and written applications, the identity certificate of the legal representative or the person in charge of the unit shall also be issued.
Entrust others to handle, in addition to the corresponding documents and written application, it shall also issue the identity certificate of the legal representative or person in charge of the unit and the power of attorney issued by it, as well as the identity certificate of the authorized person.
Twenty-third unit depositors to apply for the replacement of the reserved personal signature, can be handled directly by the legal representative or the person in charge of the unit, can also authorize others to handle.
If it is handled directly by the legal representative or the person in charge of the unit, a written application with the official seal of the unit and the identity certificate of the legal representative or the person in charge of the unit shall be issued.
If it is entrusted to others, it shall issue a written application with the official seal of the unit, the identity certificate of the legal representative or person in charge of the unit, the power of attorney issued by it and the identity certificate of the authorized person. If the identity certificate of the legal representative or the person in charge of the unit cannot be issued, a written application with the official seal of the unit, the power of attorney issued by the unit and the identity certificate of the authorized person shall be issued.
Article 24 Where an individual applies for changing the reserved seal, he shall issue a written application for the original seal of the lip cover, the original seal of the reserved seal and a valid personal identity document. An individual applying for changing the reserved seal must be handled by the depositor himself.
Article 25 After receiving the depositor's application for changing the seal and the relevant supporting materials, the class teacher shall review the changed materials according to the provisions of Articles 7, 8, 21 to 24, and examine whether the depositor's application for changing the seal is stamped with the old and new seals as required, whether the manager is a legal person or holds a power of attorney from a legal person, and verify that he has given his opinions and signed it, and indicate the cancellation date on the old seal card kept by the bank, requiring the applicant to indicate the opening date on the new seal card.
Article 26 After receiving the changed new seal card submitted by the class teacher, the custodian of the seal card should check whether the old and new seals are connected, whether the elements are complete, and whether the new seal card is put into the seal book for daily seal check.
Twenty-seventh bills issued by the unit before the new seal is put into use and within the time limit for presenting payment shall be inspected according to the old seal. After the old seal card is kept for 10 days (postponed in case of holidays), it will be stamped with the "invalid" seal, one of which will be bound with the voucher and the other with the account opening information.
Chapter VI Handling of Reserved Seal when Closing an Account
Article 28 When a depositor applies for closing a bank settlement account, he shall fill in the Application for Closing a Bank Settlement Account and submit it to the bank where the account is opened. Where a depositor applies to cancel the unit bank settlement account, it shall affix the official seal of the unit; Personal signature shall be added to the application for cancellation of personal bank settlement account. The head teacher should carefully examine whether the name, account number, seal and seal card of the account cancellation person on the Application for Closing a Bank Settlement Account are consistent. After examination, please add comments on the account cancellation application form and submit it to the seal card administrator for follow-up procedures.
Article 29 The custodian of the seal card shall, according to the application for account cancellation reviewed by the head teacher, extract the seal card of the intended account cancellation. After verification, he shall indicate the date of account cancellation on the old seal card and submit it to the front desk teller for account cancellation procedures.
Thirtieth tellers in accordance with the provisions of the cancellation procedures, the cancellation certificate should be attached with a seal card, invalid important blank vouchers and cancellation application; A copy of the account opening information should be kept.
Chapter VII Inspection and Supervision of Reserved Seal
Article 31 Management banks at all levels shall strengthen the management and guidance of reserved seals of banks within their jurisdiction, and regularly or irregularly check the management of reserved seals to ensure the normal and standardized operation of reserved seals. The inspection contents include the acceptance and use of the seal, the storage and transfer of the seal, the change and cancellation of the seal, etc. , find the problem and correct it in time.
Article 32 The duty of the head teacher to supervise the seal:
1. Be responsible for reviewing the compliance and legality of the seal card management in the activation, replacement and cancellation of the seal of the unit.
2. Be responsible for supervising and inspecting whether the ticket printer has done a good job of checking the edges and corners in the process of printing checks. It is strictly forbidden to check the seal only by impression and experience, handle the transfer and settlement business for customers without seal, and do not use the real reserved seal for verification.
Third, it is responsible for monitoring the ideological trends of employees, strengthening ideological education, improving the consciousness of accountants in implementing systems and methods in seal management, and preventing business managers from operating illegally.
Four, responsible for the safety situation education, typical case education, so that employees can keep abreast of the new trend of criminals using seals to commit crimes and maintain high vigilance.
Article 33 Supervision of seals of branches:
First, the class teacher checks whether the signature card is signed when auditing. Check whether the change procedures of the signature card in the account opening information are in compliance.
2. Check whether the account name on the balance sheet of the signature card and check is consistent with the original account name.
Three, supervise whether the signature card is managed by a special person, and whether the teller goes through the handover procedures in accordance with the regulations when he is on vacation or changing his guard.
Four, random video check whether the signature card is used within the scope of the video gun, whether the nuclear printer is true, and whether there is any false nuclear printing phenomenon.
Chapter VII Supplementary Provisions
Article 34 These Measures shall be formulated, interpreted and revised by * *. Secondary branches may formulate relevant implementation rules according to these Measures.
Article 35 These Measures shall come into force as of June 6, 2005.
