(1) If it is necessary to summon an illegal suspect for investigation, with the approval of the person in charge of the case-handling department of the public security police station or the public security organ at or above the county level, use a summons card to summon him;

(2) An illegal suspect found by the people's police at the scene may be summoned orally after presenting his work certificate, and the process, time and departure time of the illegal suspect shall be indicated in the interrogation record;

(3) If a summons card is used for summons, the illegal suspect shall fill in the arrival time and the time for ending the inquiry and verification on the summons card and sign it;

(4) The public security organ shall promptly ask and verify the summoned illegal suspect, and the time for asking and verifying shall not exceed eight hours. If the case is complicated and the illegal act may be punished by administrative detention according to law, the time for inquiry and verification shall not exceed 24 hours.

2. Legal basis: Article 35 of the People's Police Law of the People's Republic of China.

Those who refuse or obstruct the people's police from performing their duties according to law shall be given administrative penalties for public security. The specific behavior is as follows:

(a) openly insulting the people's police who are performing their duties;

(2) obstructing the investigation and evidence collection by the people's police;

(3) refusing or obstructing the people's police from entering the relevant residence or place in pursuit, search, rescue and other tasks;

(four) deliberately set up obstacles for police cars to perform emergency tasks such as emergency rescue, rescue, pursuit and security;

(five) other acts of refusing or obstructing the people's police from performing their duties.

Whoever commits the acts listed in the preceding paragraph by violence or threat, which constitutes a crime, shall be investigated for criminal responsibility according to law.

Second, the procedure of summoning.

1, in the process of fire control law enforcement, law enforcement officers should fill in the "summons card" report, report to the leadership for approval, and issue the "summons card".

2. Law enforcement officers shall deliver the summons card to the summoned person according to law = the summoned person shall sign or seal the receipt of the summons card and indicate the date of receipt.

3. If the summoned person refuses to accept the summons or evades the summons without justifiable reasons, he shall be forced to summon according to law with the approval of the leader.

4. After being summoned to the case, the summoned person shall conduct interrogation and verification in time, and make an interrogation record, and each interrogation time shall not exceed 24 hours.

5. If violation of relevant laws and regulations is found on the spot, the undertaker may verbally summon relevant personnel. When announcing the oral summons, the undertaker shall explain the reasons for the summons and record the oral summons in the interrogation record.
