Defendant Shi, male, born on, Han nationality, native of _ _ _ _ _ _ _ _ _
Litigation request:
Requested the court to protect women's legal inheritance rights, and ordered the two defendants to return all the property legally inherited by the plaintiff, that is, one third of the total inheritance. A list of all the properties is attached.
Facts and reasons:
The father of plaintiff Shi is _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _
The plaintiff did her duty to support her father and gave her father 500 yuan living expenses every month for seven years after marriage. Not only that, but during his father's illness for more than a year, he bought food and medicine for his father, totaling 8,000 yuan. In the month when my father was seriously ill, I lived in my father's house all day and waited on him.
Articles 13 and 14 of People's Republic of China (PRC) Inheritance Law clearly stipulate that "men and women enjoy equal inheritance rights". Paragraph 2 of Article 10 also stipulates that "brothers and sisters" belong to the same succession order and enjoy equal inheritance rights. Accordingly, the plaintiff repeatedly asked the local villagers' committee and township government to help solve this inheritance dispute. However, due to the serious feudalism in the local area, some cadres were influenced by the idea of "son preference" and the concept of clan rights, and the dispute has not been resolved. Request the court to ensure the legal status and rights and interests of women on the basis of facts and laws, and order Shi _ _ _ _ and Shi _ _ _ _ to return the legal property that the plaintiff should inherit.
