Similarities and differences between handwritten signature and digital signature

Is there any difference between digital signature and our common paper signature? Digital signature needs to be realized by using the technology in the field of public key encryption. Digital signature is very different from handwritten signature, and the valid signature copy in digital signature is a valid signature. The copy signature of the handwritten signature is invalid.

Second, the specific overview of digital signature

The so-called digital signature (also known as public key digital signature and electronic signature) is a kind of common physical signature similar to that written on paper, but it is realized by using the technology in the field of public key encryption to identify digital information. A set of digital signatures usually defines two complementary operations, one for signing and the other for verification.

Third, the conditions of digital signature.

In financial and commercial systems, many enterprises need to sign or seal documents to prove their authenticity for future inspection. However, when using computer network to transmit information, it is obviously impossible to sign by hand. In computer, we can use digital signature and use public key to realize digital signature, thus replacing traditional signature.

In order for digital signatures to replace traditional signatures, the following three conditions must be met:

(1) The receiver can verify the sender's signature on the message;

(2) The sender cannot deny the signature of the message;

(3) The receiver cannot forge the signature of the message.

Fourthly, the confirmation of digital signature.

Confirmation of digital signature is a process of checking the digital signature by referring to the original information and a given public password, and then determining whether the digital signature created by using the private password of the same information is consistent with the referenced public password. By using the same hash function as the digital signature, a new hash function result of the original information can be calculated to confirm the data signature. Then, using the public password and the new hash function result, the verifier can check whether the digital signature is signed with the corresponding private password, and whether the newly calculated hash function result matches the original hash function result value converted into the digital signature during the signing process.

The confirmation software will recognize the digital signature as "confirmed" in the following cases:

(1) The signer's private password is used to sign the information, while the public password is used to confirm the digital signature, because the public password only confirms that the signer signed the digital signature with the private password. In fact, the public password has confirmed that the signature is made by the private password;

(2) The information has not been changed, and a conclusion can be drawn by comparing the hash function result calculated by the confirmer with the hash function result of the digital signature.

People's Republic of China (PRC) electronic signature method

Article 2 The term "electronic signature" as mentioned in this Law refers to the data contained in a data message to identify the identity of the signer and show that the signer approves its contents.

The term "data message" as mentioned in this Law refers to information generated, sent, received or stored by electronic, optical, magnetic or similar means.

Article 3: In civil activities, the parties may agree to use or not use electronic signatures and data messages.

A document in the form of electronic signature or data message agreed by the parties shall not be denied its legal effect just because it is in the form of electronic signature or data message.

The provisions of the preceding paragraph shall not apply to the following documents:

(a) involving marriage, adoption, inheritance and other personal relationships;

(two) involving the cessation of water supply, heating, gas supply and other public utilities services;

(3) Other circumstances in which electronic documents are not applicable as stipulated by laws and administrative regulations.

Thirteenth electronic signatures meet the following conditions at the same time, as reliable:

(1) When the electronic signature production data is used for electronic signature, it belongs to the exclusive rights of the electronic signer;

(2) When signing, the electronic signature production data is only controlled by the electronic signer;

(3) Any changes to the electronic signature after signature can be found;

(4) Any changes to the content and form of the data message after signature can be found.

The parties can also choose to use electronic signatures that meet their agreed reliable conditions.

Article 14 A reliable electronic signature has the same legal effect as a handwritten signature or seal.
