Local regulations adopt the names of laws, regulations, procedures, rules and detailed rules. Article 3 The Provincial People's Congress and its Standing Committee may, on the premise that different constitutions, laws and administrative regulations are in conflict, formulate local regulations according to the following circumstances:
(a) the national law stipulates that the provincial people's congress or its standing committee shall formulate local regulations for the implementation of this law;
(two) in order to ensure the implementation of the Constitution, laws and administrative regulations, according to the actual situation of this province, it is necessary to formulate local regulations;
(three) in order to adjust the social relations in all aspects of political, economic and social life in this province, it is necessary to formulate local regulations;
(four) in order to meet the needs of the province's reform and opening up and socialist modernization, local regulations should be formulated. Article 4 The people's congresses and their standing committees of the cities where the provincial people's government is located and the larger cities approved by the State Council may, on the premise that different constitutions, laws, administrative regulations and local regulations of this province are in conflict, formulate local regulations according to the specific conditions and actual needs of this city, and submit them to the Standing Committee of the provincial people's congress for approval before implementation. Article 5 Autonomous County People's Congress has the right to formulate autonomous regulations and separate regulations in accordance with the political, economic and cultural characteristics of local ethnic groups, which shall be implemented after being submitted to the Standing Committee of the Provincial People's Congress for approval. Chapter II Proposal of Draft Local Regulations Article 6 When the people's congresses of provinces, cities where the provincial people's governments are located, and large cities and autonomous counties approved by the State Council hold meetings, the presidium, standing committees, special committees, people's governments at the corresponding levels, people's courts and people's procuratorates may submit draft local regulations to the people's congresses at the corresponding levels, and the presidium shall decide to submit them to the people's congresses for deliberation. Or submit it to the relevant special Committee for deliberation and report, and the presidium will consider and decide to submit it to the General Assembly for voting.
Ten or more deputies to the people's congress may jointly submit a draft local law to the people's congress at the corresponding level, and the presidium shall decide whether to include it in the agenda of the meeting, or submit it to the relevant special committee for deliberation and put forward opinions on whether to include it in the agenda of the meeting, and then the presidium shall decide whether to include it in the agenda of the meeting. Article 7 The meeting of directors of the standing committees of the people's congresses of provinces, cities where the provincial people's governments are located and large cities approved by the State Council may submit draft local regulations to the standing committees of the people's congresses at the corresponding levels for deliberation at the meeting of the standing committees.
People's governments, people's courts, people's procuratorates and special committees of people's congresses may submit draft local regulations to the Standing Committee of the people's congress at the corresponding level, and the meeting of directors shall decide to submit them to the meeting of the Standing Committee for deliberation, or submit them to the relevant special committees for deliberation and report before submitting them to the meeting of the Standing Committee for deliberation.
Five or more members of the Standing Committee of the People's Congress may jointly submit a draft local regulation to the Standing Committee at the corresponding level, and the meeting of directors shall decide whether to submit it to the meeting of the Standing Committee for deliberation, or submit it to the relevant special committee for deliberation and report before deciding whether to submit it to the meeting of the Standing Committee for deliberation. Article 8 When submitting a draft local regulation to the People's Congress or the Standing Committee, it shall submit a written report signed by the principal responsible person of the proposing organ or all the sponsors, and attach an explanation of the draft regulation and relevant reference materials. Chapter III Deliberation of Draft Local Regulations Article 9 The people's congress or the plenary session of the Standing Committee shall hear explanations of the draft local regulations.
The person in charge of the organ proposing the draft local regulations or the drafting unit entrusted by it and the sponsor shall explain the draft local regulations to the meeting. Tenth people's Congress or the plenary session of the Standing Committee shall, after hearing the explanation of the draft local regulations, be deliberated by delegations, group meetings and joint group meetings respectively, or submitted to the relevant special committees for deliberation.
When deputies and members consider the draft local regulations, the relevant person in charge shall attend the meeting, listen to opinions and answer questions. Eleventh deputies and members shall discuss and demonstrate the necessity, feasibility, legality, scientificity and standardization of the draft local regulations. Article 12 The draft local regulations preliminarily considered at the meeting of the Standing Committee shall be issued to the relevant state organs, social organizations, teaching and research institutions and the Standing Committee of the people's congresses at lower levels for extensive consultation and necessary revision, and shall be considered and adopted at the next or subsequent meeting of the Standing Committee. Article 13 The draft local regulations deliberated by the People's Congress may be discussed and passed at one time, or the Standing Committee may be authorized to amend and consider and pass them, unless there are special provisions in the law.
