One: the formal process of renting a house

1. Both parties sign the lease contract.

2. The landlord can check the tenant's ID card (which can be confirmed by the Public Security Bureau) and ask for a copy as an attachment to the contract.

3. The tenant should check the owner's property right certificate (which can be confirmed to the local real estate exchange), the owner's ID card (which can be confirmed to the public security bureau) and the combination of the two certificates (that is, the owner of the property right certificate is consistent with the ID card), and ask for a copy as an annex to the contract.

4. The signature of the contract (owner) is the same as the owner of the property right certificate. If it is not the same, you need a power of attorney from the owner.

5. When handling the sharing contract, the owner needs to agree to rent it.

6. If the homeowner asks for a deposit, please also check the above documents. The deposit generally does not exceed 20% of the monthly rent.

Two: considerations for renting a house:

1. Don't trust the owner who can't provide the property right (original).

2. Don't believe that the title certificate and ID card are not the same number.

3. Confirm the ID number with the local public security bureau.

4. Ask the neighborhood committee (or neighbors) about the landlord. Check whether the description is the same as the owner.

5. If the owner asks to pay the annual rent or a large deposit, the situation should be especially careful.

Three: After renting a house, it is best for both parties to register the real estate lease.

In order to facilitate management and protect the rights and interests of the parties, China currently implements a registration and filing system for housing lease contracts. According to the Regulations of Shanghai Municipality on Housing Lease, the parties involved in housing lease shall, within 15 days after the signing of the lease contract, go to the district or county real estate transaction center where the house is located with the lease contract and related materials for registration and filing. However, the housing lease contract within the scope of state-owned farms in Shanghai shall be registered and filed at the real estate transaction registration and acceptance office (hereinafter referred to as the farm system acceptance office) set up by the Municipal Real Estate Bureau.

When handling the registration formalities, the following materials shall be submitted:

1, real estate license or other ownership certificate; If it is leased to migrant workers, it shall also be accompanied by a public security license issued by the public security department;

2. The lessor's personal identification certificate or the registration certificate of the enterprise or other organization; If there is a * * * house for rent, it shall also submit the certificate that other * * * people agree to rent it; If the lease is entrusted, the entrustment contract shall be submitted; If it is rented as an agent, submit the certificate that the owner of the house entrusts the agent;

3. When the lessee goes through the registration formalities, it shall submit the personal identity certificate or the registration certificate of the enterprise or other organization. Whether it is the lessor or the lessee, China citizens living abroad should submit a valid passport of the People's Republic of China in their personal identity certificates; Individuals from Hong Kong and Macao must submit passports of Hong Kong and Macao residents to and from the Mainland; Individuals in Taiwan Province Province shall be submitted to mainland travel permit for taiwan residents; Overseas enterprises and other organizations shall submit notarized or certified registration certificates.

If one party to a house lease contract requests registration, and the other party refuses to cooperate, the party requesting registration and filing can handle the registration and filing with the lease contract and the materials that one party should submit, and the real estate trading center or the farm system acceptance office shall accept it.
