The law has stipulated that the exemption clause in the contract signed by both parties about "personal injury or property loss caused by intentional or gross negligence" is invalid. The relationship between the two parties has been made clear, that is, there is no labor contract relationship. If there is any infringement dispute, they should bear the responsibility according to their respective fault degree.

It is suggested that the other party should learn the company's factory rules and regulations and the main safety rules before entering the factory, and everyone should sign the learning record. Moreover, the company will warn and announce places with potential safety hazards. In this way, the company has fulfilled its reasonable obligation to inform and can be exempted from liability in the event of infringement disputes.

(1) Causing personal injury to the other party;

(2) Causing property losses to the other party due to intentional or gross negligence.

Article 6 The principle of fault liability If the actor infringes upon the civil rights and interests of others due to his fault, he shall bear the tort liability.

Article 26 If the infringer is also at fault for the occurrence of the damage, the liability of the infringer may be reduced.

Article 27 If the damage is intentionally caused by the victim, the actor shall not be liable.
