People's Republic of China (PRC) Electronic Signature Law is regarded as the first real legislation in the sense of China's e-commerce law. Since 1996, when the United Nations promulgated the Model Law on Electronic Commerce, electronic commerce legislation has been in full swing all over the world. Some countries have enacted electronic commerce laws or transaction laws, some countries have enacted electronic signature laws or digital signature laws, and some countries have adopted two legislative methods. However, China's e-commerce legislation was finally promulgated under the guidance of the national informatization strategy, which can be said to be a long-awaited move by the industry and has also received great attention from relevant enterprises and even government departments.
Known as "the first true information law in China", the electronic signature has the same legal effect as the traditional handwritten signature and seal. "Electronic Signature Law" is an important step to promote the development of e-commerce and eliminate the obstacles to the development of e-commerce in China. Although public opinion generally believes that the Electronic Signature Law will greatly promote the rapid development of e-commerce in China, in the face of "obstacles" such as the security of online transactions and the connection of related laws, relevant experts believe that the symbolic significance of the Electronic Signature Law at this stage is greater than the actual significance.
