1. Parents: If the parents of the elderly are alive, the property of the elderly will be inherited by the parents. If only one parent is alive, the parent inherits all the property; If both parents are alive, the property shall be divided equally according to the legal succession order.
2. Brothers and sisters: If the parents of the elderly have died, the property of the elderly will be inherited by their brothers and sisters. If the elderly have multiple brothers and sisters, the property shall be divided equally according to the legal succession order.
3. Grandparents: If the parents, brothers and sisters of the elderly have died, the property of the elderly will be inherited by the grandparents. If only one of the grandparents is alive, the grandparents inherit all the property; If both grandparents are alive, the property shall be divided equally according to the legal succession order.
4. Uncle: If the parents, brothers, sisters, grandparents of the elderly all die, then the property of the elderly will be inherited by the uncle. If an old man has more than one uncle, the property shall be divided equally according to the legal succession order.
It should be noted that in China, the right of inheritance is legal, so the elderly can't leave all or part of their property to non-legal heirs through wills. If the old man has no will, his property will be distributed according to the above legal succession order. If the old man has a will, but the contents of the will violate the law, then the will will be regarded as invalid.
Legal basis:
Article 1 127 of the Civil Code of People's Republic of China (PRC) is inherited in the following order:
(1) First order: spouse, children, parents;
(2) The second order: brothers and sisters, grandparents and grandparents.
After the inheritance begins, the successor in the first order inherits, and the successor in the second order does not inherit; If there is no successor in the first order, it is inherited by the successor in the second order.
