Notice of purchase restriction policy
According to the Notice of the General Office of the State Council on Further Improving the Regulation of the Real Estate Market (Guo Ban Fa [201]1No.) and the Implementation Opinions on Implementing the Notice of the General Office of the State Council on Further Improving the Regulation of the Real Estate Market (Sui Fu Ban [201) The relevant specific matters are hereby notified as follows:
1. The purchase of 1 apartment is restricted for households registered in this city (including buyers, spouses and minor children, the same below) and non-local households who can provide personal income tax payment certificates or social insurance payment certificates accumulated for more than 1 year in the first two years from the date of purchase (including new commercial housing and social insurance payment certificates) Households with registered residence in this city who already own two or more houses in this city, and families with non-registered residence who own 1 house and above, and who cannot provide personal income tax payment certificate or social insurance payment certificate accumulated in this city for more than 1 year within two years, are not allowed to buy houses.
Non-local registered personnel who meet the requirements of Opinions of Guangzhou Municipality and Guangzhou Municipal People's Government on Accelerating the Attraction and Training of High-level Talents (Sui Zi [20 10]No. 1No.) and do not own their own houses in Guangzhou can buy1apartment.
2. Overseas institutions and individuals purchase commercial houses in strict accordance with the Opinions on Regulating the Access and Management of Foreign Investment in the Real Estate Market (J.J. [2006] 17 1No.) and the Notice on Further Regulating the Purchase of Houses by Overseas Institutions and Individuals (J.J. [20 10] 186
3. During the period of purchase restriction, the purchaser must sign a contract for the sale of commodity housing and prove that he knows and implements the housing purchase restriction policy of our city. Domestic residents shall truthfully fill in the declaration form of family members, and real estate development enterprises and real estate brokerage institutions shall verify the declaration form of family members of buyers by checking the original documents such as household registration book and marriage certificate. If a real estate development enterprise finds that the purchaser provides false information to defraud the purchase price, it shall immediately terminate the sales contract with it; If the brokerage agency finds that the buyer provides false information to defraud the purchased house, it shall notify and assist the seller to terminate the sales contract. Real estate development enterprises, brokerage institutions and buyers collude to defraud the purchase price, and should be held accountable and exposed.
Four, the purchase to the real estate transaction registration department to apply for real estate transfer registration, should provide the following supplementary application materials:
(1) If the buyer is a resident of China, it is required to provide the original family member declaration form and commitment letter, the original household registration book and the original marriage certificate (or other marriage certificates such as unmarried certificate).
(2) If the purchaser is a domestic resident who is not registered in this Municipality, he/she shall also provide a personal income tax payment certificate or social insurance payment certificate that has been paid in this Municipality for more than 1 year in the previous two years from the date of purchase.
(3) If the buyer is an overseas individual (excluding Hong Kong, Macao and Taiwan residents and overseas Chinese), he/she must provide proof that he/she has worked in this city for more than 1 year, and promise in writing to buy commercial housing for self-occupation and that there is no other housing in China; Hong Kong, Macao and Taiwan residents and overseas Chinese must provide proof of working, studying and living in this city, and declare in writing that they will purchase commercial housing for their own occupation and promise that there will be no other housing in China.
(4) If the purchaser is a high-level talent who is not registered in this city, a valid certificate issued by Guangzhou Organization Department or Guangzhou Human Resources and Social Security Bureau shall be provided.
When the real estate transaction registration department handles the real estate transfer registration, if it finds that the purchaser provides false information to defraud the purchase price, it will not handle the housing registration and notify the relevant lending institutions of its behavior.
Five, since the date of this notice, all commercial housing transactions shall be carried out in accordance with the provisions of this notice, and the transaction time shall be determined according to the following standards:
(1) If the contract is signed online in the information system of the real estate administrative department of this Municipality, the time when the house purchase contract is signed online shall prevail;
(2) If the sales contract is signed in the form of non-online signing, the business acceptance (including pre-acceptance) time of the real estate transaction registration department shall prevail;
(three) the new commercial housing that is not included in the housing management system shall be based on the time when the pre-sale commercial housing contract is filed or registered in the real estate transaction registration department.
