Electronic bidding documents have legal effect. According to Article 2 of the Measures for Electronic Bidding, these Measures are applicable to electronic bidding activities in People's Republic of China (PRC), including all or part of bidding transactions, public services and administrative supervision activities completed in the form of data messages. This means that the bidding activity in the form of data message has the same legal effect as the bidding activity in the form of paper.
In addition, the electronic version of the bid documents with electronic signature is legally binding on the bidder, and its legal effect is equivalent to that of the paper version of the bid documents. However, it should be noted that if the electronic version of the bid documents without electronic signature is inconsistent with the paper version, the paper version shall generally prevail.
