6.2. Except for the contents in 6. 1, the clarification or modification of the tender documents issued by the tenderer in written form are all part of the tender documents and are binding on both the tenderer and the bidder.
6.3. The bidder is deemed to be fully familiar with all kinds of situations related to the performance of the contract where the project subject to tender is located, including natural environment, climatic conditions, labor force and public facilities. , not described in this tender document.
6.4. The bidder shall carefully read all items, formats, terms and technical requirements in the bidding documents. If the bidder fails to submit all the information as required in the bidding documents or the bidding documents fail to respond substantially to the bidding documents in all aspects, it is the risk of the bidder and may lead to the rejection of his bid.
7. Clarification of bidding documents

8. Modification of bidding documents

10. Language and measurement of bidding documents
10. 1. The bidding documents submitted by the bidder and all correspondence and telegrams related to bidding between the bidder and the purchaser and the procurement agency shall be written in Chinese. The supporting documents and printed documents submitted by the bidder can be in another language, but the corresponding contents should be accompanied by Chinese translation. 10.2. Unless otherwise specified in the tender documents, the units of measurement in the tender documents and all documents between bidders and purchasers and procurement agencies are all legal units of measurement in People's Republic of China (PRC).

12. Bid quotation
12. 1. All goods and services provided by the bidder shall be quoted in RMB.
12.2. The bidder's bid quotation shall include all the expenses for completing this project. The bidder is responsible for the accuracy of the quotation, and any omission or false report is the risk of the bidder.
12.3. Only one quotation is allowed for each kind of goods, and any alternative quotation will not be accepted.
12.4. The bidder's quotation is fixed during the execution of the contract and shall not be changed for any reason.
12.5. The total bid price shall include the quotations of all standard goods, accessories and spare parts (if any), as well as direct and indirect costs such as transportation, insurance, installation and commissioning, acceptance, after-sales service, insurance, taxes and vehicle purchase tax.
13. Format and signing of bidding documents
13. 1. The bidding documents shall be compiled according to the contents specified and required in the Instructions to Bidders, and the bidding documents submitted by bidders must use the bidding document format provided by the bidding documents without exception (the format can be extended according to the same format).
13.2. All bidding documents should be printed and filled in on A4 paper, and the handwriting in the filled-in part should be neat and clear.
13.3. The bidder shall prepare an original bid document and two copies (if the bidder participates in bidding for more than two packages, each package shall prepare the bid document separately), and both the original and the copies shall be bound into volumes. Each bid document shall be clearly marked with "original" or "copy". If the original and the copy are inconsistent, the original shall prevail. A copy of the bid document may be a copy of the original.
13.4. The bidder shall fill in the full name of the bidder in the appropriate position of the bidding documents according to the requirements of the bidding documents, affix the seal of the bidder and sign the full name of the legal representative or the agent entrusted by the legal representative.
13.5. If the bidding documents are modified, they shall be signed by the legal representative of the bidder or the agent entrusted by the legal representative.
14. Bid bond
14. 1. The bidder shall submit the bid bond according to the time and amount specified in the invitation to bid, and the bid bond is an integral part of its bid.
14.2. The bid bond shall be in any of the following forms: telegraphic transfer, bank check, bank draft or cash.
14.3. The bid bond is to protect the procurement agency and purchaser from losses caused by the bidder's behavior. When the procurement agency and purchaser suffer losses due to the bidder's behavior, they may confiscate the bidder's bid bond according to Article 14.6 of the Instruction.
14.4. Any bid that fails to submit the bid bond in accordance with Article 14. 1 and 14.2 of the Instructions will be regarded as unresponsive and rejected.
14.5. The bid bond of the unsuccessful bidder will be returned to the bidder within five (5) working days after the letter of acceptance is issued. The bid bond of the winning bidder will be returned within five (5) working days after the winning bidder signs the contract according to Article 30 of the Instruction.
14.6. In any of the following circumstances, the bid bond will be confiscated:
14.6. 1 The bidder withdraws its bid within the bid validity period specified in the tender documents;
14.6.2 The bid documents do not provide authentic and effective certification materials;
14.6.3 The bidder defrauded the bid by other means;
14.6.4 The winning bidder fails to sign the contract according to Article 30 of the Instruction;
14.6.5 The winning bidder fails to pay the bid-winning service fee to the procurement agency as required;
14.6.6 disobeying the bidding discipline and unreasonably disturbing the bidding order of government procurement.
15. bid validity period
15. 1. The bid shall remain valid for ninety (90) days after the specified bid deadline. Bids whose validity period does not meet the requirements will be regarded as non-responsive and rejected.
Four. Submission of bid documents
16. Sealing and marking of bid documents
16. 1. For the convenience of bidding, the bidder shall submit the bid opening list separately when submitting the bidding documents, and indicate the words "Bid Opening List" on the envelope. For the convenience of inspection, the bidder shall submit the power of attorney of the legal representative separately.
16.2. The bidder shall seal the original and all copies of the bidding documents in separate envelopes, and mark the words "original" and "copy" on the envelopes. Then all the envelopes are encapsulated in the outer envelope.
16.3. The outer envelope shall be marked with the words "[project name] bidding document", "project number", "it shall not be opened before [bid opening time]" and "bidder's name and address".
16.4. The inner envelope should be sealed, and the seal can be stamped with the bidder's seal; The seal and riding seam of the outer envelope shall be stamped with the bidder's seal (or official seal).
16.5. If it is not sealed and marked according to the above provisions, the purchaser and the procurement agency will not be responsible for the wrong bid or early unsealing of the bidding documents. Therefore, the bid documents unsealed in advance will be rejected by the procurement agency and returned to the bidder.
17. Bidding deadline
17. 1. The bidder shall submit the original and all copies of the bid documents to the bid opening place no later than the deadline specified in the invitation for bid.
17.2. If the purchaser and the procurement agency decide to extend the bidding deadline as appropriate, all rights and obligations of the procurement agency, the purchaser and the bidder bound by the bidding deadline shall be extended to the new deadline.
18. Late submission of bid documents
18. 1. The purchaser and procurement agency will reject and return the bid documents received after the specified deadline.
19. Modification and cancellation of bidding documents
19. 1. A bidder may modify or withdraw its bid after submitting its bid documents, but the purchaser and the procurement agency must receive a written notice of modification or withdrawal before the specified bid deadline.
19.2. The notice of amendment or withdrawal of the bidder shall be signed by the legal representative or authorized agent of the legal person or stamped with the official seal of the bidder, sealed, marked and sent according to Article 16 of the Instruction.
19.3. A bidder shall not withdraw his bid after the deadline for bidding, otherwise his bid bond will be confiscated according to Article 14.6 of the Instruction.
19.4. After the bid deadline, the bidder shall not make any modification to its bid.
V bid opening, evaluation and calibration
20. Bid Opening
20. 1. The procurement agency shall organize public bid opening according to the date, time and place specified in the invitation to bid. The bidder shall send an authorized representative to participate in the bid opening, and the representative of the bidder who participates in the bid opening shall present a valid identity document and a legal person power of attorney and sign and register to prove his attendance. If there is no valid ID card or the ID card does not match, the bid will be rejected.
20.2. At the time of bid opening, the bidder or its elected representative shall check the sealing condition of the bid documents. The purchaser and the procurement agency shall check the legal person power of attorney of the bidder and the client's identity certificate (original) present at the meeting, and after confirming that it is correct, unpack and sing the bid, and publish the contents of the "Bid Opening List" in each bid document and other contents deemed appropriate by the purchaser. Only discounts and statements read out at the time of bid opening are considered in bid evaluation. Except for returning the late bid intact according to Article 18 of the Instruction, no bid shall be rejected when opening bids.
20.3. The unopened and unopened bid documents will be returned to the bidder intact. The bid documents after bid opening will not be returned.
20.4. The procurement agency is responsible for the record of bid opening. The bid opening record needs to be signed by the bidder's representative for confirmation.
2 1. Composition of bid evaluation committee and bid evaluation method
2 1. 1. The bid evaluation is the responsibility of the bid evaluation committee established by the procurement agency in accordance with relevant laws and regulations. The members of the jury are composed of a buyer's representative and four representatives randomly selected from the expert database of XXXXXXXX government procurement office.
2 1.2. The bid evaluation committee will conduct bid evaluation according to the bid evaluation method determined in the tender documents. The evaluation of bid documents by the bid evaluation committee is divided into preliminary examination and bid evaluation.
2 1.3. The comprehensive evaluation method was adopted in this bid evaluation, with a full score of 100. See Chapter IV Bid Evaluation Methods and Criteria for details.
22. Preliminary examination of bid documents
22. 1. The Bid Evaluation Committee will review whether the bidding documents are complete, whether the overall arrangement is orderly, whether the signing of the documents is qualified, whether the bidder has submitted the bid bond, and whether there is any calculation error.
22.2. Arithmetic errors will be corrected as follows: If the numerical value expressed in words is inconsistent with the numerical value expressed in figures, the numerical value expressed in words shall prevail; Other calculation errors shall be borne by the bidder. If the bidder does not accept the correction of his mistakes, his bid will be rejected.
22.3. Irregularities, inconsistencies or irregularities that do not constitute substantial deviation in the bid documents can be accepted by the bid assessment committee, but such acceptance cannot damage or affect the relative ranking of any bidder.
22.4. Before the detailed bid evaluation, the bid evaluation committee shall examine whether each bid document substantially responds to the requirements of the tender documents. The substantially responsive bid shall conform to the key terms, conditions and specifications required by the tender documents, and there shall be no major deviation. Deviations, reservations or objections to key clauses will be regarded as substantial deviations. The Bid Evaluation Committee decides that the responsiveness of the bid is only based on the true and correct contents of the bid documents themselves, not on external evidence, unless the bid documents contain untrue and incorrect contents.
23. Clarification of bid documents
23. 1. In the process of bid evaluation, in order to facilitate the review, evaluation and comparison of bid documents, bidders will be required to clarify their bid documents separately, but bidders are not allowed to seek, provide or allow any modification to the bid price and other substantive contents. Requests for clarification and replies shall be submitted in writing.
23.2. If the quotation in the tender documents is inconsistent with the bid opening list of public bidding, the public bidding shall prevail.
23.3. The bidder's explanation or reply to the clarification question shall be submitted to the agency in written form, which shall be signed by the bidder's legal representative or its authorized agent or stamped with the official seal of the bidder.
23.4. The clarification document of the bidder is an integral part of its bid documents.
24. Evaluation of bid documents
24. 1. The Bid Evaluation Committee will only evaluate the bids that are determined to substantially respond to the requirements of the bidding documents according to the provisions of Chapter IV of this bidding document.
24.2. The bid evaluation is based on the tender documents. According to the bid evaluation methods and standards specified in Chapter IV of this tender document, all bids with substantial response are evaluated and scored, and the recommended bid winning order is determined.
24.3. Basic conditions for winning the bid:
24.3. 1 The bidding documents fully respond to the substantive requirements in the bidding documents;
24.3.2 Good contract execution ability and after-sales service commitment;
24.3.3 The person with the highest comprehensive bid evaluation score.
25. Calibration
25. 1. The Bid Evaluation Committee shall submit a written bid evaluation report according to the evaluation results of the bidding documents, and recommend 2-3 qualified bid-winning candidates to the purchaser according to the provisions of the bidding documents and the order of scores from high to low. The purchaser shall determine the winning bidder in the recommended ranking order.
25.2. Only when the winning candidate gives up the bid for special reasons or cannot perform the contract due to force majeure, the winning candidate with lower ranking in the bid evaluation can be replaced by the winning bidder in turn.
26. Confidentiality and other preventive measures
26. 1. From beginning to end, the bid evaluation committee and relevant personnel shall not disclose to the bidder or other irrelevant personnel all relevant information about the review, clarification, evaluation and comparison of the bid documents and the intention to award the bid.
26.2. In the process of bid evaluation, any activity that the bidder tries to influence the tenderee, tendering agency and bid evaluation committee to obtain bid evaluation information will lead to the rejection of its bid and bear corresponding legal responsibilities.
26.3. The Bid Evaluation Committee will not explain the reasons for not winning the bid to the unsuccessful suppliers, nor will it return the bid documents.
Award of intransitive verb contract
27. Letter of acceptance
27. 1. The procurement agency issued a bid-winning announcement on the XXXXXXXX government procurement network in China. And issue a letter of acceptance to the winning bidder in written form, which has legal effect once it is issued.
27.2. The procurement agency shall notify other unsuccessful bidders within five working days after the bid-winning notice is issued, and return their bid bond; The winning bidder shall return the bid bond within five working days after signing the contract.
27.3. The letter of acceptance will serve as the basis for signing the contract.
28. Sign a contract
28. 1. After receiving the letter of acceptance, the winning bidder shall send its authorized representative to the designated place to sign the contract within three (3) days (the representative shall hold the official authorization certificate of the winning bidder) for business negotiation and sign the contract within thirty (30) days.
28.2. The tender documents, the bid documents of the winning bidder and relevant clarification documents are the basis for signing the contract.
28.3. The winning bidder shall submit the performance bond to the purchaser before signing the contract as stipulated in the tender documents. If the winning bidder fails to submit the performance bond as required, the purchaser and the procurement agency will be disqualified from winning the bid. In this case, the purchaser and the procurement agency can award the bid to the next successful candidate.
28.4. If the bidder fails to sign the contract according to the above provisions, the purchaser and the procurement agency will cancel the qualification of winning the bid and confiscate its bid bond. If the losses caused to the purchaser exceed the bid bond, it shall also compensate for the excess and bear corresponding legal responsibilities according to law; Once the bidder wins the bid, after signing the contract through business negotiation, it is not allowed to subcontract without permission, otherwise it will be regarded as a breach of contract and the contract will be automatically terminated.
29. Agency service fee
29. 1. The winning bidder shall pay the agency service fee to the procurement agency in accordance with the provisions of the State Planning Commission's documents JJ [2002] 1980 and NDRC [2003]857.
30. Provisions on performance bond
30. 1. The winning bidder shall submit the performance bond to the purchaser and deposit it in his account according to the amount specified in the schedule before the tender documents as a prerequisite for signing the contract.
30.2. In case of breach of contract, the performance bond will be confiscated, and if the losses caused to the purchaser exceed the amount of the performance bond, compensation shall be made according to law.
