Chapter I General Principles
Article 1 These Provisions are formulated in accordance with the Road Traffic Safety Law of the People's Republic of China and its implementing regulations and the Administrative Licensing Law of People's Republic of China (PRC). Article 2 The traffic administrative department of the public security organ shall be responsible for the implementation of these Provisions. The traffic administrative department of the public security organ of the municipality directly under the central government, the traffic administrative department of the city divided into districts or the traffic administrative department of the public security organ at the same level shall be responsible for handling the motor vehicle driving license business within their respective administrative areas. The scope for the traffic administrative department of the county-level public security organ to handle the motor vehicle driving license business shall be determined by the traffic administrative department of the provincial public security organ. Article 3 The vehicle management office shall follow the principles of openness, fairness and convenience in handling motor vehicle driving license business. Article 4 When handling the business of motor vehicle driving license, the vehicle management office shall accept the application of the applicant according to law, review the materials submitted by the applicant, and handle the motor vehicle driving license according to the prescribed procedures and time limit for those who meet the requirements. Those who apply for a motor vehicle driver's license shall truthfully submit the required information to the vehicle management office and truthfully declare the required matters. Article 5 The motor vehicle driver's license shall be issued and printed by the computer management system of motor vehicle driver's license, and the motor vehicle driver's license not issued and printed by the computer management system shall be invalid. The database standard and software of the computer management system for motor vehicle driver's license are unified throughout the country, which can completely and accurately record and store the whole process information of handling personnel's application acceptance, subject examination and motor vehicle driver's license issuance, and can transmit the relevant information to the national public security traffic management information system in real time. Article 6 The traffic administrative department of the provincial public security organ shall establish a homepage on the Internet, release information, and facilitate the people to consult the relevant provisions on handling motor vehicle driving licenses, and download and use relevant forms.
Chapter II Application for Motor Vehicle Driving License Section 1 Motor Vehicle Driving License Article 7 The following contents are recorded and annotated in the motor vehicle driving license: (1) Motor vehicle driver information: name, gender, date of birth, nationality, address, ID number (motor vehicle driving license number) and photo; (2) Endorsement of Vehicle Management Office: date of first license, license model code, effective start date, effective period, seal of issuing authority and file number. Article 8 Motorists are allowed to drive in the following order: large buses, tractors, city buses, medium buses, large trucks, small cars, small automatic cars, low-speed trucks, three-wheeled cars, ordinary three-wheeled motorcycles, ordinary two-wheeled motorcycles, mopeds, wheeled bicycles, trolleybuses and trams (Annex 1). Article 9 The validity period of a motor vehicle driver's license is divided into six years, ten years and long term. Tenth elderly people over the age of 60 are not allowed to drive large buses, tractors, city buses, medium-sized buses, large trucks, trolleybuses and trams; People over the age of 70 are not allowed to drive low-speed trucks, three-wheeled vehicles, ordinary three-wheeled motorcycles, ordinary two-wheeled motorcycles and wheeled bicycles. Section 2 Application Conditions Article 11 An applicant for a motor vehicle driver's license shall meet the following conditions: (1) Age requirement: 65,438+0. For those who apply for cars, small automatic cars and mopeds, 18 years old and under 70 years old; 2. Those who apply for low-speed trucks, tricycles, ordinary tricycles, ordinary motorcycles or wheeled motorcycles are at the age of 18 and under 60; 3. Apply for city buses, medium-sized buses, large trucks, trolleybuses or trams, aged 2 1 year, and under 50 years old; 4. Those who apply for tractor driver's license are over 24 years old and under 50 years old; 5. Those who apply for the quasi-driving model of large buses are over 26 years old and under 50 years old. (2) Physical condition: 1. Height: The applicant is allowed to drive buses, tractors, city buses, large trucks and trolleybuses with a height above 1.55cm. Enter oneself for an examination of medium-sized bus driving type, height150 cm; 2. Vision: those who apply for buses, tractors, city buses, medium-sized buses, large trucks, trolleybuses and trams have naked vision or corrected vision of more than 5.0 on the logarithmic visual acuity chart. Apply for other quasi-driving models, and the naked eye vision or corrected vision of both eyes reaches above 4.9 on the logarithmic visual acuity chart; 3, color discrimination: no red and green color blindness; 4, hearing: two ears are 50 cm away from the tuning fork to distinguish the direction of the sound source; 5. Upper limbs: the thumbs of both hands are sound, the other fingers of each hand must be sound, and the motor functions of limbs and fingers are normal; 6. Lower limbs: normal motor function. To apply for driving a manual transmission car, the unequal length of the lower limbs shall not exceed 5 cm. To apply for driving an automatic car, the right lower limb should be sound; 7. Trunk and neck: no motor dysfunction. Article 12 No one may apply for a motor vehicle driver's license under any of the following circumstances: (1) Suffering from diseases such as organic heart disease, epilepsy, Meniere's disease, dizziness, hysteria, tremor paralysis, psychosis, dementia, nervous system diseases affecting limb activities and other diseases that hinder safe driving; (two) drug addiction, drug injection, long-term use of dependent psychotropic drugs have not been quit; (three) the motor vehicle driver's license has been revoked for less than two years; (4) having his motor vehicle driver's license revoked for escaping after a traffic accident; (five) the driver's license has been revoked according to law for less than three years; (6) Other circumstances stipulated by laws and administrative regulations. Thirteenth people who apply for a motor vehicle driver's license for the first time can apply for a motor vehicle driver's license for city buses, large trucks, small cars, small automatic cars, low-speed trucks, three-wheeled cars, ordinary three-wheeled motorcycles, ordinary two-wheeled motorcycles, mopeds, wheeled self-propelled vehicles, trolleybuses and trams. If you apply for a motor vehicle driver's license for the first time in your temporary residence, you can apply for a motor vehicle driver's license for small cars, small automatic cars, low-speed trucks and three-wheeled cars. Article 14 Anyone who holds a motor vehicle driver's license and applies for increasing the number of quasi-driving models shall not get full marks in this scoring cycle and the latest scoring cycle before the application. (a) to apply for increasing the quasi-driving type of medium-sized buses, tractors and large buses, and to obtain the quasi-driving type driving qualification of small cars, small automatic cars, low-speed trucks or three-wheeled vehicles for more than three years, and there is no record of full marks in the last two consecutive scoring cycles before the application; Or have obtained the driving qualification of city buses and large trucks for more than one year, and there is no record of full marks in the latest scoring cycle before the application. (two) to apply for the increase of tractor drivers, and to obtain the driving qualification of medium-sized passenger cars or large trucks for more than three years, and there is no record of full marks in the last two consecutive scoring cycles before the application; Or have obtained the driving qualification of a large bus for more than one year, and there is no record of full marks in the latest scoring cycle before the application. (3) Those who apply for increasing the permitted driving type of large passenger cars have obtained the driving qualification of medium-sized passenger cars or large trucks for more than five years, and there is no record of full marks in the last three consecutive scoring cycles before the application; Or have obtained tractor driving qualification for more than two years, and there is no full score record in the latest scoring cycle before application. The quasi-driving models that can be applied for in the temporary residence are small cars, small automatic cars, low-speed trucks and three-wheeled cars. Article 15 Under any of the following circumstances, it is not allowed to apply for increasing the permitted driving types of large buses, tractors and medium-sized buses: (1) Those who are fully or mainly responsible for the deaths caused by traffic accidents; (2) Driving a motor vehicle after being drunk; (3) Driving a motor vehicle after drinking alcohol in this scoring cycle and three consecutive scoring cycles before application; (four) in this scoring cycle and the last three consecutive scoring cycles before the application, driving a motor vehicle over the prescribed speed by more than 50%, and the motor vehicle driver's license has not been revoked. Sixteenth holders of military and armed police motor vehicle driver's licenses, or holders of overseas motor vehicle driver's licenses, meet the requirements of these provisions, you can apply for a motor vehicle driver's license corresponding to the quasi-driving model. Section 3 Application, Examination and Certification Article 17 A person who applies for a motor vehicle driver's license shall apply to the vehicle management office in accordance with the following provisions: (1) If he lives at the domicile, he shall apply at the domicile; (two) living in the temporary residence, you can apply in the temporary residence; (three) active servicemen (including armed police) to apply in their place of residence; (4) An application by an overseas person at his place of residence; (five) to apply for increasing the number of quasi-driving models, an application shall be made at the place where the motor vehicle driver's license is issued. Article 18 To apply for a motor vehicle driver's license for the first time, an application form for a motor vehicle driver's license shall be filled in and the following documents shall be submitted: (1) the identity certificate of the applicant; (2) physical condition certificate issued by medical institutions at or above the county level or at the regimental level. Article 19 To apply for increasing the number of quasi-driving models, a motor vehicle driver's license shall be submitted in addition to the application form for motor vehicle driver's license and the documents specified in Article 18. Article 20 When applying for a motor vehicle driver's license, a person holding a motor vehicle driver's license of the army or the armed police force shall fill out an application form for a motor vehicle driver's license and submit the following documents and vouchers: (1) the applicant's identity certificate, and the certificate of demobilization, transfer to other jobs and retirement issued by the army or the armed police force; (2) A certificate of physical condition issued by a medical institution at or above the county level or at the regiment level; (3) Motor vehicle driving licenses of the army and the armed police force. Article 21 When an overseas motor vehicle driver's license holder applies for a motor vehicle driver's license, he shall fill in an application form for motor vehicle driver's license and submit the following documents and vouchers: (1) the identity certificate of the applicant; (2) A physical condition certificate issued by a medical institution at or above the county level; (3) Motor vehicle driver's license. If it is not expressed in Chinese, a Chinese translation shall also be issued. Article 22 When applying for a motor vehicle driver's license, foreign embassies and consulates in China personnel and personnel of representative offices of international organizations in China shall fill out an application form for a motor vehicle driver's license and submit the following documents and vouchers: (1) the identity certificate of the applicant; (2) Motor vehicle driver's license. If it is not expressed in Chinese, a Chinese translation shall also be issued. Twenty-third vehicle management office to meet the conditions for applying for a motor vehicle driver's license, it shall accept and arrange an examination for the applicant within 30 days. Article 24 Examination subjects are divided into road traffic safety laws and regulations and related knowledge examination subjects (hereinafter referred to as "subject 1"), venue driving skills examination subjects (hereinafter referred to as "subject 2") and road driving skills examination subjects (hereinafter referred to as "subject 3"). The examination order is in accordance with subject 1, subject 2 and subject 3. Only by passing the exam of the previous subject can you take the exam of the latter subject. For the first time to apply for a motor vehicle driver's license or increase the number of quasi-driving models, the vehicle management office shall issue a driving skill certificate within three days after passing the examination. The driving skill certificate is valid for two years. Applicants should complete the examinations of subject 2 and subject 3 within the validity period. Twenty-fifth examination subjects and eligibility criteria are unified throughout the country (Annex 2). The structure and basic question types of the subject 1 examination question bank are formulated by the Ministry of Public Security, and the traffic management department of the provincial public security organ establishes the examination question bank of this province (autonomous region or municipality directly under the Central Government) according to the local actual situation. The examination items of subject 2 include: pile test, fixed-point parking and starting on the ramp, side parking, passing through unilateral bridge, driving in a curve, right-angle turning, passing through a width-limiting door at a speed limit, passing through continuous obstacles, adding or subtracting 100 meters, and rolling the road. The basic items of the subject 3 exam include: getting ready to get on the bus, starting, driving in a straight line, changing lanes, crossing the intersection, pulling over, crossing the crosswalk, crossing the school district, crossing the bus stop, overtaking, turning around and driving at night. Subject 2, subject 3 exams are conducted in a combination of compulsory and selective examinations, and the selected items are randomly selected according to different modes. Article 26 When applying for a motor vehicle driver's license for the first time or increasing the types of vehicles allowed to drive, the applicant shall meet the following requirements when making an appointment for examination subject 2: (1) If the applicant is allowed to drive an automobile, a small automatic car, a low-speed truck, a tricycle, an ordinary tricycle, an ordinary two-wheeled motorcycle, a moped, a wheeled motorcycle and a trolley bus, he shall make an appointment for the examination ten days after obtaining the driving skills admission ticket; (two) to apply for large buses, tractors, city buses, medium-sized buses and large trucks, and make an appointment for the test 20 days after obtaining the driving skills admission ticket. Article 27 When applying for a motor vehicle driver's license for the first time or increasing the types of vehicles that are allowed to drive, the applicant shall meet the following requirements when making an appointment for examination subject 3: (1) When applying for permission to drive low-speed trucks, three-wheeled vehicles, ordinary three-wheeled motorcycles, ordinary two-wheeled motorcycles, mopeds, wheeled bicycles, trolleybuses and trams, the applicant shall make an appointment for the examination within 20 days after obtaining the driving skills admission ticket; (two) to apply for small cars and small automatic cars, and make an appointment for the test within 30 days after obtaining the driving skills admission ticket; (three) to apply for medium-sized passenger cars and large trucks, and to make an appointment for the examination within forty days after obtaining the driving skills admission ticket; (four) to apply for large buses, tractors and city buses, and make an appointment for the test within 60 days after obtaining the driving skills admission ticket. Twenty-eighth for the first time to apply for a motor vehicle driver's license or to apply for an increase in the number of quasi-driving models, the motor vehicle management office will issue a motor vehicle driver's license after the applicant has passed the examination of subjects one, two and three. To apply for increasing the number of quasi-driving models, the original motor vehicle driver's license shall be withdrawn. Twenty-ninth holders of military and armed police motor vehicle driver's license to apply for motor vehicle driver's license of large buses, tractors, medium-sized buses and large trucks, should take the examination of subject 1 and subject 3; Apply for other quasi-driving motor vehicle driving licenses, and directly issue motor vehicle driving licenses. Demobilized, transferred to other jobs or discharged from the army, the motor vehicle driver's license of the army and the armed police force shall also be recovered. Thirtieth to apply for a motor vehicle driver's license with an overseas motor vehicle driver's license, you should take the exam subject 1. To apply for a motor vehicle driver's license for large buses, tractors, medium-sized buses and large trucks, subjects 3 should also be tested. Foreign embassies and consulates in China personnel and representatives of international organizations in China who apply for motor vehicle driving licenses shall issue motor vehicle driving licenses in accordance with the principle of diplomatic reciprocity. Thirty-first each subject is tested once, and you can take a make-up exam. If the make-up exam is still unqualified, the subject exam will be terminated. Applicants can reapply for the examination, but the examination dates of subject 2 and subject 3 should be reserved within 20 days. Within the validity period of the driving skill certificate, the scores of subjects that pass the examination are valid. Thirty-second exam results should be announced on the spot, and make transcripts. If the examination fails, the reasons for the failure shall be explained. Thirty-third exam transcripts should be signed by the applicant and invigilator. Unsigned motor vehicle driver's license shall not be issued. Personnel engaged in the examination work shall hold the examiner's certificate issued by the traffic management department of the provincial public security organ. Thirty-fourth candidates who cheat in the exam will be disqualified from the exam, and the scores of other subjects that have passed the exam will be invalid. Chapter III Replacement, reissue and cancellation of certificates
Thirty-fifth motor vehicle drivers shall, within ninety days before the expiration of the motor vehicle driving license, apply to the vehicle management office where the motor vehicle driving license is issued. When applying, an application form for a motor vehicle driver's license shall be filled in, and the following documents and vouchers shall be submitted: (1) Identification certificate of the motor vehicle driver; (2) Motor vehicle driving license; (3) A certificate of physical condition issued by a medical institution at or above the county level or at the regiment level. Thirty-sixth motor vehicle drivers who move out of the jurisdiction of the original vehicle management office shall apply for replacement at the vehicle management office; Motor vehicle drivers living outside the jurisdiction of the vehicle management office may apply to the vehicle management office for a new card. When applying, an application form for a motor vehicle driver's license shall be filled in, and the identity certificate of the motor vehicle driver and motor vehicle driver's license shall be submitted. Article 37 Motor vehicle drivers who have reached the age of 60 and hold the quasi-driving type of large buses, tractors, city buses, medium-sized buses and large trucks shall apply for motor vehicle driving licenses for small cars and small automatic cars at the vehicle management office where the motor vehicle driving licenses are issued; A motor vehicle driver who has reached the age of 70 and holds an ordinary three-wheeled motorcycle or an ordinary two-wheeled motorcycle shall apply for a motor vehicle driver's license for a moped at the vehicle management office where the motor vehicle driver's license is issued. When applying, an application form for a motor vehicle driver's license shall be filled in, and the documents and vouchers specified in Article 35 shall be submitted. Motor vehicle drivers who voluntarily reduce the types of vehicles that are allowed to drive shall fill in the Application Form for Motor Vehicle Driving License and submit the documents and vouchers specified in Items (1) and (2) of Article 35. Article 38 Under any of the following circumstances, the driver of a motor vehicle shall, within 30 days, apply to the vehicle management office where the motor vehicle driver's license is issued: (1) The driver's information recorded in the motor vehicle driver's license has changed within the jurisdiction of the vehicle management office; (2) The motor vehicle driving license is damaged beyond recognition. When applying, an application form for a motor vehicle driver's license shall be filled in, and the identity certificate of the motor vehicle driver and motor vehicle driver's license shall be submitted. Thirty-ninth in accordance with the provisions of Article 35 to Article 38, the motor vehicle management office shall issue a new motor vehicle driver's license within three days. Among them, in line with the provisions of Article 36, Article 37 and Article 38, the original motor vehicle driver's license shall also be withdrawn. Article 40 If a motor vehicle driver's license is lost, the driver of the motor vehicle shall apply to the vehicle management office where the motor vehicle driver's license is issued for a replacement. When applying, an application form for a motor vehicle driver's license shall be filled in, and the following documents and vouchers shall be submitted: (1) Identification certificate of the motor vehicle driver; (2) A written statement on the loss of the motor vehicle driver's license. If it meets the requirements, the vehicle management office shall reissue the motor vehicle driver's license within three days. Article 41 A motor vehicle driver may entrust an agent to handle the business of replacing or reissuing a motor vehicle driver's license. When an agent applies for a motor vehicle driver's license, it shall submit the identity certificate of the agent and the application form for motor vehicle driver's license signed by the driver and the agent. The vehicle management office shall record the agent's name, unit name, identity document name, identity document number, residence address, postal code and contact telephone number. Forty-second motor vehicle drivers in any of the following circumstances, the vehicle management office shall cancel their motor vehicle driver's license: (1) dead; (two) physical condition is not suitable for driving a motor vehicle; (3) applying for cancellation; (4) The guardian has lost the capacity for civil conduct and applied for cancellation; (five) the motor vehicle driver's license has not been renewed for more than one year; (six) over 60 years of age or holding a large bus, tractor, city bus, medium-sized bus, large truck, trolleybus, trams, and did not submit proof of physical condition within one year after the end of a scoring cycle; (seven) at the age of 60 or above, the motor vehicle driver's license is only trolley buses or trams, or at the age of 70 or above, and the motor vehicle driver's license is only low-speed trucks, tricycles and wheeled bicycles; (eight) the motor vehicle driver's license is revoked or the driver's license is revoked according to law. In any of the circumstances from Item (5) to Item (8), if the motor vehicle driver's license is not recovered, the motor vehicle driver's license shall be declared invalid.
Chapter IV Scoring and Verification
Article 43 The cumulative scoring cycle of road traffic safety violations (i.e. scoring cycle) is 12 months, with a full score of 12, which is counted from the date when the motor vehicle driver's license is obtained for the first time. According to the severity of road traffic safety violations, the scores of a score are: 12, 6, 3, 2, 1 (Annex 3). Forty-fourth motor vehicle drivers should be punished and scored at the same time for road traffic safety violations. Motor vehicle drivers who have scored more than two illegal acts at a time shall calculate and accumulate scores respectively. Article 45 If a motor vehicle driver refuses to accept the punishment for road traffic safety violations and changes or cancels the original punishment decision according to law after applying for administrative reconsideration or bringing an administrative lawsuit, he shall change or cancel the corresponding score. Article 46 The traffic administrative department of the public security organ shall announce to the public the inquiry methods for the scores of motor vehicle drivers' illegal acts, so as to facilitate the inquiry. Article 47 If a motor vehicle driver reaches 12 points in a scoring cycle, he shall go to the traffic management department of the public security organ in the place where the motor vehicle driver's license is issued or where the illegal act is committed for 7 days to receive education on road traffic safety laws, regulations and related knowledge. After the motor vehicle driver receives education, the vehicle management office shall take the subject one examination within twenty days. If the driver of a motor vehicle reaches 12 for more than two times in a scoring cycle, the vehicle management office shall also pass the examination of subject 1 within 10 days. Article 48 Drivers of motor vehicles who have reached the age of 60 or who are allowed to drive buses, tractors, city buses, medium-sized buses, large trucks, trolleybuses and trams shall have a physical examination once a year, and submit relevant physical condition certificates issued by medical institutions at or above the county level or at the regiment level within/0/5 days after the end of the scoring period.
Chapter V Supplementary Provisions
Article 49 Where there is an agreement between countries on mutual recognition of motor vehicle driving licenses, it shall be handled in accordance with the agreement. If the relevant agreements signed between countries involve motor vehicle driving licenses, they shall be implemented in accordance with the agreements. Fiftieth motor vehicle driver's license style and specifications shall conform to the safety industry standards of People's Republic of China (PRC) and People's Republic of China (PRC). The format of driving skill certificate shall be stipulated by the Ministry of Public Security. Article 51 The application and use of tractor driver's license shall be stipulated separately. The model and specification of tractor driver's license shall conform to the provisions of the Motor Vehicle Driver's License of the People's Republic of China and the safety industry standard of People's Republic of China (PRC). Article 52 The meanings of the following terms in these Provisions: (1) Identity certificate means: 1. The identity certificate of a resident is a resident identity card; The identity certificate of the temporary population is the "Resident Identity Card" and the residence and temporary residence certificate issued by the public security organ; 2. The identity certificate of active servicemen (including armed police) is "Resident Identity Card"; 3. The identity certificate of overseas personnel refers to their entry identity certificate and residence certificate; 4. The identity certificates of foreign embassies and consulates in China personnel and personnel of representative offices of international organizations in China are valid identity documents issued by the Ministry of Foreign Affairs. (2) Address means: 1. The resident address is the address recorded in the resident identity card; 2. The address of active servicemen (including armed police) is the address recorded in the resident ID card; 3. The address of the overseas personnel is the address recorded in the residence certificate; 4. The addresses of foreign embassies and consulates in China personnel and personnel of representative offices of international organizations in China shall be subject to the addresses recorded in the valid identity documents issued by the Ministry of Foreign Affairs. Article 53 The terms "above" and "below" mentioned in these Provisions include this number. The "three days", "five days", "seven days", "ten days" and "fifteen days" mentioned in these Provisions refer to working days, excluding holidays. Article 54 These Provisions shall come into force as of April 6, 2007. The Regulations on the Application and Use of Motor Vehicle Driving License (Order No.71of the Ministry of Public Security) promulgated on April 30, 2004 shall be abolished at the same time. After the entry into force of these Provisions, if the provisions previously formulated by the Ministry of Public Security are inconsistent with these Provisions, these Provisions shall prevail.
