Guidelines for changing the legal representative of medical institutions
1. Submit an application report for changing the legal representative. The report includes the following contents:
1. Change of legal representative reason.
2. Basic information of the new legal representative.
2. Submit the original and copy of the original legal representative’s ID card.
3. Submit the new legal representative: personal work resume, household register, ID card, non-employment certificate, no criminal record guarantee, no second-level medical accident within five years, and physical examination qualification form. The legal representative and person in charge of a clinic-type institution must also submit a "Physician Practice Certificate" and proof of continuous work in the same profession for more than 5 years.
4. Anyone who has any of the following circumstances shall not serve as the legal representative or main person in charge of a medical institution:
(1) Individuals who are serving a sentence or do not have full capacity for civil conduct ; (2) Medical staff who are employed in medical institutions, have retired due to illness, or are on leave without pay; (3) Medical staff who have suffered a Class II or above medical accident for less than five years;
(4) Those who have violated relevant laws , laws and regulations, medical personnel whose practice certificates have been revoked; (5) The legal representative or principal person in charge of a medical institution whose "Medical Institution Practice License" has been revoked.
5. Individuals who set up clinics must meet the following conditions at the same time:
(1) Pass the physician's professional technical examination and obtain the "Physician Practice Certificate";
(2) After obtaining the "Physician Practice Certificate" or physician title, engage in clinical work in the same specialty for more than five years;
(3) Other conditions stipulated by the health administrative departments of provinces, autonomous regions, and municipalities directly under the Central Government.
6. If a medical institution set up by a company or unit changes its legal representative, it must also submit copies of its business license, legal person registration certificate or relevant documents.
7. Submit copies of the "Medical Institution Practice License" and "Medical Institution Diagnosis and Treatment Subject Approval Form".
8. After the above information is reviewed and passed, the Medical Affairs Department will make an appointment with the original legal representative and the proposed new legal representative for an interview, and sign to confirm the changes. (The original legal representative and the proposed new legal representative must bring the original copies of the above information).
9. After the interview, fill out the "Medical Institution Application for Change Registration Form" (downloadable), fill it out as required and submit it to the Medical Affairs Department, and also submit a one-inch color photo of the new legal representative (person in charge) One piece.
10. The new legal representative needs to register for practice.
11. After approval, obtain the new "Medical Institution Practice License" and return the old license to the Medical Affairs Department.
