According to the "Notice on Matters Concerning the Establishment of Labor Relations" (Ministry of Labor and Social Affairs [2005] No. 12)
The employer has not signed a labor contract with the employee, and it is determined that there is a labor dispute between the two parties. You can refer to the following vouchers when doing so:
(1) Wage payment vouchers or records (employee wage payment roster), records of payment of various social insurance premiums; (2) Payments issued by the employer to workers "Work permit", "service permit" and other documents that can prove identity;? (3) Recruitment records such as "registration form" and "application form" filled out by workers;
(4) ) Attendance records;
(5) Testimonies of other workers, etc.
Among them, the employer bears the burden of proof for items (1), (3), and (4).
