Chapter 1 General Provisions Article 1 In order to strengthen the fire protection design review and acceptance management of construction projects and ensure the quality of fire protection design and construction of construction projects, in accordance with the "Construction Law of the People's Republic of China" and "The People's Republic of China" *This regulation is formulated by laws and administrative regulations such as the Fire Protection Law of the People's Republic of China and the Regulations on Quality Management of Construction Projects. Article 2 These regulations shall apply to the fire protection design review and fire protection acceptance of special construction projects, as well as the fire protection acceptance filing (hereinafter referred to as the filing) and spot inspections of other construction projects.

The term “special construction projects” as mentioned in these regulations refers to the construction projects listed in Article 14 of these regulations.

The term "other construction projects" as mentioned in these regulations refers to construction projects other than special construction projects that require fire protection design in accordance with the national fire protection technical standards for engineering construction. Article 3 The competent department of housing and urban-rural development of the State Council is responsible for guiding and supervising the review and acceptance of fire protection design of construction projects nationwide.

The competent departments of housing and urban-rural construction of local people's governments at or above the county level (hereinafter referred to as the competent departments for fire design review and acceptance) shall be responsible for the fire protection design review, fire protection acceptance, filing and spot inspection of construction projects within their respective administrative regions in accordance with their duties. .

The fire protection design review, fire protection acceptance, filing and spot inspection of cross-administrative region construction projects shall be designated by the superior authority with the same authority as the fire protection design review and acceptance department in the administrative region where the construction project is located. . Article 4 The department in charge of fire protection design review and acceptance shall use information technology such as Internet technology to carry out fire protection design review, fire protection acceptance, filing and spot checks, establish and improve the credit management system for relevant units and practitioners, and continuously improve the level of government services. Article 5 The funds required by the competent department for fire protection design review and acceptance to implement fire protection design review, fire protection acceptance, filing and random inspections shall be implemented in accordance with the "Administrative Licensing Law of the People's Republic of China" and other relevant laws and regulations. Article 6 The department in charge of fire protection design review and acceptance shall promptly inform the fire protection agency of the fire protection acceptance, filing and spot inspection status, and share with the fire protection agency the building plan, fire protection facility layout plan, fire protection facility system diagram and other information. Article 7 Staff engaged in the review and acceptance of fire protection design of construction projects, as well as employees in construction, design, construction, project supervision, technical services and other units, shall have corresponding professional and technical capabilities and regularly participate in vocational training. Chapter 2 Responsibilities and Obligations of Relevant Units for Fire Protection Design and Construction Quality Article 8 The construction unit shall bear primary responsibility for the fire protection design and construction quality of construction projects in accordance with the law. Design, construction, project supervision, technical service and other units shall bear the main responsibility for the fire protection design and construction quality of construction projects in accordance with the law. Employees in construction, design, construction, project supervision, technical service and other units shall bear corresponding personal responsibilities for the fire protection design and construction quality of construction projects in accordance with the law. Article 9 The construction unit shall perform the following fire protection design and construction quality responsibilities and obligations:

(1) It shall not express or imply that the design, construction, project supervision, technical service and other units and their employees violate the construction project laws regulations and national engineering construction fire protection technical standards, reducing the quality of fire protection design and construction of construction projects;

(2) Apply for fire protection design review and fire protection acceptance of construction projects in accordance with the law, handle the filing and accept random inspections;

< p>(3) For construction projects that implement project supervision, the quality of fire protection construction shall be entrusted to supervision in accordance with the law;

(4) Entrust design, construction, and project supervision units with corresponding qualifications;

(5) In accordance with the engineering fire protection design requirements and contract stipulations, select qualified fire protection products and building materials, building components and equipment that meet fire protection performance requirements;

(6) Organize relevant units to conduct completion acceptance of the construction project At the same time, inspect whether the construction project meets the fire protection requirements;

(7) Timely transfer the fire protection related files of the construction project to the archives management agency in accordance with the law. Article 10 The design unit shall perform the following fire protection design and construction quality responsibilities and obligations:

(1) Design in accordance with construction project laws and regulations and national engineering construction fire protection technical standards, and prepare fire protection design documents that meet the requirements, The mandatory provisions of the national engineering construction fire protection technical standards shall not be violated;

(2) The fire protection products and building materials, building components and equipment with fire protection performance requirements selected in the design documents shall indicate the specifications, Performance and other technical indicators are in line with national standards;

(3) Participate in the completion acceptance of the construction project organized by the construction unit, sign and confirm the implementation of the fire protection design of the construction project, and be responsible for the quality of the fire protection design of the construction project . Article 11 The construction unit shall perform the following fire protection design and construction quality responsibilities and obligations:

(1) In accordance with construction project laws and regulations, national project construction fire protection technical standards, and after passing the fire protection design review or meeting the project requirements Organize construction according to the required fire protection design documents, and shall not change the fire protection design for construction without authorization to reduce the quality of fire protection construction;

(2) Inspect fire protection products and meet fire protection performance requirements in accordance with fire protection design requirements, construction technical standards and contract agreements The quality of building materials, building components and equipment, use qualified products to ensure the quality of fire protection construction;

(3) Participate in the completion acceptance of construction projects organized by the construction unit, and sign and confirm the quality of fire protection construction of construction projects , and be responsible for the quality of fire protection construction in construction projects.
