Our country's law does not clearly stipulate which finger to use to fingerprint when signing a contract. In general, press the fingerprint with the thumb or forefinger of the right hand. Matters needing attention when signing a contract according to fingerprints;
1. Special inkpad or inkpad should be used to prevent inkpad or inkpad from accumulating on fingers and forming blurred fingerprints. Ink and ink can be red, blue or black.
The order of fingerprints is the index finger, thumb and middle finger of the right hand. If the finger of the right hand can't meet the requirements due to special circumstances, it can be replaced by the index finger, thumb and middle finger of the left hand in turn, and it is best to indicate it in the fingerprint.
3. In the process of stamping, put your finger flat on the relevant materials or documents to be stamped, and roll the stamp with your finger from left to right. The pressure of imprinting should be controlled by the temperature, so that the fingerprint line will be clearly left on the material or document. It is best to confirm the degree of inkpad or ink left on your fingers before stamping.
If the parties conclude a book contract by contract, they shall sign or seal it. If the parties press their fingerprints on the contract, the people's court shall determine that it has the same legal effect as the signature or seal. According to the relevant laws and regulations of our country, if the parties conclude a contract in the form of a contract, the contract will be established when both parties sign or seal it. Therefore, although there is no handprint on the IOUs or other contracts, they are all signed by the parties themselves. As long as it does not violate the provisions of national laws and regulations, the signed loan or contract is the true intention of the signatory. There are no two identical leaves in the world, and everyone's signature is as unique as everyone's fingerprint. Therefore, the debit note without fingerprints and the contract signature are also legally binding.
Article 490 of the Civil Code of People's Republic of China (PRC): If the parties conclude a contract in the form of a contract, the contract is concluded when the parties sign, seal or fingerprint it. Before signing, sealing or fingerprinting, one party has fulfilled its main obligations, and the contract is established when the other party accepts it.
A contract shall be concluded in written form as stipulated by laws, administrative regulations or agreed by the parties. If the parties do not do this in writing, but one party has fulfilled its main obligations and the other party accepts it, the contract is established.
