Fraud of public or private property amounting to more than 3,000 to 10000 constitutes a crime of fraud, and criminal responsibility shall be investigated in accordance with Article 266 of the Criminal Law. If the amount of defrauding public or private property does not reach the standard of investigating criminal responsibility, the administrative illegal responsibility shall be investigated in accordance with Article 49 of the Law on Public Security Administration Punishment. If the illegal and criminal acts of fraud have been completed, they should also undertake to return stolen goods or compensate the victims.
2. Theft, fraud, looting, looting, extortion or intentional destruction of public or private property shall be detained for more than 5 days 10 days, and a fine of not more than 500 yuan may be imposed. If the circumstances are serious, they shall be detained for more than 10 days and less than 100 yuan.
3. Property obtained in violation of public security administration shall be recovered and returned to the infringed person. If there is no infringer, it shall be registered, auctioned or disposed of in accordance with the procedures prescribed by the state. The proceeds are turned over to the state treasury.

Whoever swindles a large amount of public or private property shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention or public surveillance, and shall also or only be fined. If the amount is huge or there are other serious circumstances, he shall be sentenced to fixed-term imprisonment of not less than 3 years 10 years and fined. If the amount is especially huge or there are other particularly serious circumstances, he shall be sentenced to fixed-term imprisonment of not less than 10, life imprisonment, and shall also be fined or confiscated.
4. All the property obtained from the crime shall be confiscated or ordered to make restitution. The lawful property of the victim shall be returned in time. Prohibited articles or personal property used for committing crimes shall be confiscated, and the confiscated property and fines shall be turned over to the state treasury, and shall not be used for other purposes or disposed of by themselves.
