After the building is completed, the parties concerned shall apply to the Bureau of Land and Resources for the certificate of state-owned land use right, and then submit a cadastral questionnaire according to the provisions of Article 9 of the Land Registration Measures, which shall be signed by their neighbors for confirmation. If a neighbor refuses to sign, he can explain the situation to the Bureau of Land and Resources and deal with it according to the procedure of breach of contract and default:
1. According to the Regulations on Urban Cadastral Survey promulgated and implemented by 1993, if one party defaults, the following measures shall be taken according to different situations: if one party defaults, its land boundary shall be determined by the boundary pointed by the other party; If both parties are absent due to breach of contract, the land boundary shall be determined by the surveyor according to the current boundary and local customs; Deliver the demarcation results in writing to the default absentee.
If there is any objection, an application for redrawing must be made within 15 days, and all expenses for redrawing shall be borne by me. If no application is filed within the time limit, the two dividing lines will take effect automatically. If the demander fails to sign and seal the cadastral survey form after demarcation, it shall be handled with reference to the above provisions. Therefore, the neighbor refuses to sign the ownership boundary agreement, and the Land and Resources Bureau can handle the state-owned land use right certificate for the applicant according to the above provisions and the default demarcation procedures.
2. The specific operation steps are as follows:
The Bureau of Land and Resources shall serve the notice of on-site demarcation to the applicant and neighbors 4 days before the on-site demarcation. On the day of the demarcation, if everyone attends the demarcation and signs without objection, it will be handled according to normal procedures; If the neighbors are absent or refuse to sign without reason, the demarcation result shall be subject to the applicant's demarcation, and the Land and Resources Bureau will serve a confirmation of the demarcation result to the absent demander. If there is any objection to the demarcation result, it shall apply for re-demarcation within 15 days from the date of receiving the confirmation of the demarcation result, and bear the relevant expenses. If it is not submitted within the time limit, the previous demarcation result will automatically take effect, and the Bureau of Land and Resources will handle the state-owned land use right certificate for the applicant on this basis.
3. In order to properly handle the neighboring relations and try to resolve conflicts and disputes, the Bureau of Land and Resources should give full play to the mediation function and urge both parties to resolve them through consultation. Before going through the default demarcation procedure, the Bureau of Land and Resources will organize all parties to be present, fully listen to their opinions, and find out the reasons for refusing the visa, so as to handle disputes in time and protect the legitimate rights and interests of the parties.
