Civil Service Recruitment Regulations (Trial)

Chapter 1 General Provisions

Article 1. In order to regulate the recruitment of civil servants and ensure the basic quality of newly recruited civil servants, these regulations are formulated in accordance with the Civil Service Law.

Article 2: These regulations apply to non-leadership civil servants employed by agencies at all levels to serve as chief clerk or below and other equivalent positions.

Article 3: The recruitment of civil servants shall adhere to the principles of openness, equality, competition and merit selection, and shall adopt a method of combining examination and inspection in accordance with the standards of both ability and political integrity.

Article 4 The recruitment of civil servants must be within the prescribed establishment quota and there must be corresponding vacancies.

Article 5 The recruitment of civil servants shall be carried out in accordance with the following procedures:

(1) Publication of recruitment announcement;

(2) Registration and qualification review;

(3) Examination;

(4) Inspection and physical examination;

(5) Publicity, approval or filing.

When necessary, the civil service authorities at or above the provincial level may adjust the above procedures.

The recruitment procedures for civil servants in special positions can be simplified with the approval of the civil service department at or above the provincial level.

Article 6: When recruiting civil servants in ethnic autonomous areas, appropriate consideration will be given to applicants from ethnic minorities in accordance with laws and relevant regulations. Specific measures shall be determined by the civil service departments at or above the provincial level.

Article 7 The civil service administrative department and the recruitment agency shall take measures to facilitate citizens to apply for the examination.

Chapter 2 Management Organization

Article 8 The central administrative department for civil servants is responsible for the comprehensive management of the recruitment of civil servants nationwide. Specifically, it includes:

(1) Formulating regulations for the recruitment of civil servants;

(2) Formulating regulations and policies for the recruitment of civil servants;

(3) Guiding and supervising local governments Recruitment of civil servants in agencies at all levels.

The central civil service department is responsible for organizing the recruitment of civil servants in central agencies and their directly affiliated agencies.

Article 9 The provincial-level civil servants’ administrative departments are responsible for the comprehensive management of the recruitment of civil servants within their respective jurisdictions. Specifically include:

(1) Implement national laws, regulations, rules and policies regarding the recruitment of civil servants;

(2) Formulate policies for the recruitment of civil servants within the jurisdiction in accordance with the Civil Service Law and these regulations Implementation Measures;

(3) Responsible for organizing the recruitment of civil servants in agencies at all levels within the jurisdiction;

(4) Guiding and supervising the recruitment of civil servants in agencies at all levels below the districted city level ;

(5) Undertake the work related to the recruitment of civil servants entrusted by the central civil servants department.

When necessary, the provincial civil service administrative department may authorize the civil service administrative department of the districted municipality to organize the recruitment of civil servants within its jurisdiction.

Article 10 The civil service administrative departments at all levels below the districted city level shall be responsible for the relevant work on the recruitment of civil servants within their respective jurisdictions in accordance with the provisions of the provincial civil servant administrative departments.

Article 11: The recruitment agency shall, in accordance with the requirements of the civil servants’ administrative department, undertake the work related to the recruitment of civil servants within its own agency.

Chapter 3 Recruitment Plan and Recruitment Announcement

Article 12 The recruitment agency shall propose the positions, quotas and application qualifications for recruitment based on the vacancies and job requirements, and formulate recruitment plans plan.

Article 13 The recruitment plans of central agencies and their directly affiliated agencies shall be reviewed and approved by the central civil service department.

The recruitment plans of provincial agencies and their directly affiliated agencies shall be reviewed and approved by the provincial civil servants department. The application procedures and approval authority for recruitment plans of agencies below the districted city level shall be stipulated by the provincial civil service administrative department.

Article 14 The civil service authorities at or above the provincial level shall formulate recruitment work plans in accordance with relevant laws, regulations, rules and policies.

When the administrative department of civil servants at the districted municipal level is authorized to organize the recruitment of civil servants within its jurisdiction, its recruitment work plan shall be submitted to the administrative department for civil servants at the provincial level for review and approval.

Article 15: The civil service administrative department shall formulate recruitment announcements based on the recruitment work plan and release them to the public. The recruitment announcement shall state the following contents:

(1) Recruitment agency, recruitment positions, quotas and application qualifications;

(2) Registration methods, time and place;< /p>

(3) Application materials that need to be submitted;

(4) Examination subjects, time and location;

(5) Other matters needing attention.

Chapter 4 Registration and Qualification Review

Article 16 To apply for civil servants, one must meet the following qualifications:

(1) Possess the People's Republic of China *** Nationality of the People's Republic of China;

(2) Aged over 18 years old and under 35 years old;

(3) Support the Constitution of the People's Republic of China;

(4) Have good conduct;

(5) Have the physical condition to perform duties normally;

(6) Have the working ability that meets the job requirements;

(7) Have a college degree or above;

(8) Qualifications required for the proposed position specified by the civil servants department at or above the provincial level;

(9) ) Other conditions stipulated by laws and regulations.

The conditions listed in items (2) and (7) of the preceding paragraph may be appropriately adjusted with the approval of the civil servants' administrative department at or above the provincial level.

Civil service authorities and recruitment agencies shall not set application qualifications that are irrelevant to job requirements.

Article 17 The following persons are not allowed to apply for the civil service examination:

(1) Those who have been criminally punished for crimes;

(2) Those who have been dismissed from public service ;

(3) There are other circumstances that prohibit employment as civil servants under legal provisions.

Article 18 Applicants shall not apply for positions listed in Article 68 of the Civil Servant Law with the recruitment agency civil servants.

Article 19 Applicants shall submit application materials to the recruitment agency, and the application materials submitted by applicants shall be true and accurate.

The recruitment agency will review the application based on the qualifications and confirm whether the applicant is qualified within the specified time.

Chapter 5 Examination

Article 20 The civil servant recruitment examination shall be conducted in the form of written examination and interview. The examination content shall be set according to the basic abilities that civil servants should possess and different job categories.

Article 21 The written examination includes public and professional subjects. Public service subjects are uniformly determined by the central civil service department. Professional subjects are set by the civil service departments at or above the provincial level as needed.

Article 22 After the written examination, the recruitment agency shall determine the candidates for interview in descending order based on the written examination scores in accordance with the regulations of the civil servants' departments at or above the provincial level.

Interviews shall be organized and implemented by the civil service administrative departments at or above the provincial level, or may be entrusted to recruitment agencies or authorized civil servant administrative departments at the districted municipal level to organize and implement the interviews.

The content and methods of interviews shall be stipulated by the civil servants’ departments at or above the provincial level.

The interview should consist of a panel of interviewers. The interview examiner panel is composed of people with interview examiner qualifications. The identification and management of the qualifications of interview examiners shall be the responsibility of the civil service departments at or above the provincial level.

Article 23 When hiring civil servants for special positions, other evaluation methods may be used with the approval of the civil servants' administrative department at or above the provincial level.

Chapter 6 Inspection and Physical Examination

Article 24: Recruitment agencies shall, in accordance with the regulations of the civil service departments at or above the provincial level, rank applicants in descending order based on their test scores. Determine candidates for inspection and review and inspect their qualifications.

Article 25 The review of application qualifications mainly verifies whether the applicant meets the prescribed application qualifications and confirms whether the information and materials submitted during registration are true and accurate.

Article 26 The content of the inspection mainly includes the applicant’s political ideology, moral character, ability and quality, study and work performance, compliance with laws and regulations, integrity and self-discipline, and whether there is a need for avoidance.

An inspection team shall be formed during the inspection, and the inspection team shall consist of two or more persons. The inspection team should listen to opinions extensively, be comprehensive, objective and fair, and write inspection materials truthfully.

Article 27 The physical examination shall be organized by the civil service departments at or above the districted city level, and shall be implemented by the recruitment authorities.

The items and standards of physical examination shall be implemented in accordance with unified national regulations.

Physical examinations shall be conducted at medical institutions designated by the civil service departments at or above the districted city level. After the physical examination is completed, the examining doctor shall review the physical examination results and sign, and the medical institution shall stamp the official seal.

If the recruitment agency or the applicant has any doubts about the results of the physical examination, he or she may request a reexamination in accordance with regulations. When necessary, the civil service departments at or above the districted city level may require physical examination subjects to re-examine.

Chapter 7 Publicity, Approval or Recording

Article 28 The recruitment agency shall select the best candidates and propose a list of candidates based on their test scores, inspection status and physical examination results. Announce to the public.

The publicity period is seven days. The content of the announcement includes the name of the recruitment agency, the name and gender of the person to be recruited, the admission ticket number, the school of graduation or work unit, the supervisory phone number, and other matters specified by the civil servants department at or above the provincial level.

After the public notice period, if there are no problems or if the reported problems do not affect the recruitment, the approval or filing procedures will be handled in accordance with the prescribed procedures; if there are serious problems and there are substantive evidence, they will not be hired; if there are serious problems reported, , but if it is difficult to verify at the moment, the employment will be suspended until the verification and conclusion are made before deciding whether to hire.

Article 29: The lists of personnel proposed to be recruited by central agencies and their directly affiliated agencies shall be submitted to the central civil servants department for record; the lists of personnel proposed to be employed by local recruitment agencies at all levels shall be reported to the provincial or districted municipal civil servants supervisor Department approval.

Article 30 The probation period for newly hired civil servants is one year. During the probation period, the recruitment agency will inspect the newly hired civil servants and arrange necessary training. Those who pass the probationary period will be appointed; those who fail to pass the probationary period will be cancelled. If the central agency cancels the recruitment, it shall be reported to the central civil service department for record. The approval authority for cancellation of employment by local agencies at all levels shall be stipulated by the provincial civil servants department.

Chapter 8 Discipline and Supervision

Article 31 The recruitment of civil servants must be subject to supervision. The civil service administrative department and the recruitment authority shall accept reports in a timely manner and handle them in accordance with their management authority.

Article 32 Personnel engaged in recruitment work who are under the circumstances listed in Article 70 of the Civil Servant Law shall recuse themselves.

Article 33 If any of the following circumstances occurs, the civil servants’ department at or above the provincial level or the civil servants’ department at the districted city level shall order corrections or declare them invalid, depending on the circumstances; Personnel who are responsible and directly responsible shall be criticized and educated, transferred from the employed job, or given sanctions according to the seriousness of the case; if a crime is constituted, criminal responsibility shall be investigated in accordance with the law:

(1) Failure to comply with the prescribed establishment quotas and Recruiting according to job requirements;

(2) Recruiting without following the prescribed qualifications and procedures;

(3) Promulgating or changing recruitment policies without authorization, causing adverse effects Influenced;

(4) Engaging in malpractice for personal gain and serious circumstances in the recruitment work.

Article 34 If a person engaged in recruitment falls into any of the following circumstances, the civil servants department or the unit where he/she works shall, depending on the seriousness of the case, criticize and educate, transfer from the recruitment post, or impose sanctions; constitute Anyone who commits a crime shall be held criminally responsible in accordance with the law:

(1) Leaking test questions and other confidential information on admissions; (2) Taking advantage of work convenience to falsify test results or other recruitment work Relevant information;

(3) Taking advantage of work convenience to assist applicants in cheating on exams;

(4) Resulting in re-opening of the recruitment process due to work dereliction of duty;

(5) Other behaviors that violate employment disciplines.

Article 35: Applicants who violate recruitment disciplines will be criticized and educated respectively, their qualifications for examinations, inspections and physical examinations will be revoked, and they will not be admitted or their employment will be cancelled, depending on the severity of the case. Among them, those who commit fraud and other serious violations of recruitment disciplines will not be allowed to apply for the civil service examination within five years. If a crime is constituted, criminal liability shall be pursued in accordance with the law.

Chapter 9 Supplementary Provisions

Article 36 The employment of staff other than service personnel by agencies (units) governed by the Civil Servant Law shall be governed by these regulations.

Article 37 The funds required for the recruitment of civil servants shall be included in the fiscal budget and guaranteed.

Article 38 The Organization Department and the Personnel Department of the Central Committee of the Communist Party of China are responsible for the interpretation of these regulations.

Article 39 These regulations shall come into effect on the date of promulgation. The "Interim Regulations on the Recruitment of National Civil Servants" (Renfa [1994] No. 1) promulgated on June 7, 1994 and the "Measures for the Recruitment of People's Police in Public Security Organs" (Renfa [1996] No. 84) promulgated on September 10, 1996 ) are abolished at the same time.
