If the parties to the accident think that the accident liability determination is illegal and reasonable, they need to apply to the higher authorities for review within three days from the date of receiving the accident confirmation, which will take effect after the expiration. Therefore, the signing of the accident certificate has a great influence on the interests of the parties.

Traffic accident responsibility identification process:

1, please ask the traffic police to arrive at the scene after the traffic accident;

2. After the traffic police arrive at the scene, they will conduct on-site disposal and on-site investigation. If the perpetrator escapes, the traffic accident responsibility confirmation will be issued by the public security organ within 10 days from the date of seizure, and the traffic accident responsibility confirmation will be issued by the public security organ within 10 days upon the written application of the party concerned;

3. After the traffic police arrive at the scene, they will conduct on-site disposal and on-site investigation. If the perpetrator does not escape, there is no need for inspection and identification, and the public security organ will issue a traffic accident responsibility confirmation within 10 days. If a party refuses to accept the conclusion of the traffic management department, it shall apply for re-appraisal within 3 days, and the public security organ shall issue a traffic accident responsibility confirmation. If the party concerned is still dissatisfied, it shall apply for review within 3 days. The public security traffic management organ at the next higher level shall either maintain the original decision or order it to re-investigate and confirm, and the original case-handling unit shall re-issue the confirmation within 10 days.

To sum up, the traffic administrative department of the public security organ shall determine the responsibility of the parties according to the role played by their actions in road traffic accidents and the severity of their faults.

If the parties reach an agreement through self-negotiation, they shall make and sign a self-negotiation agreement on road traffic accidents. The self-negotiation agreement on road traffic accidents shall specify the time, place, weather, name of the parties, driver's license number or ID number, contact information, motor vehicle type and license plate number, insurance company, insurance certificate number, accident form, collision location, responsibilities of the parties, etc.

Article 73 of the Road Traffic Safety Law of the People's Republic of China

The traffic administrative department of the public security organ shall, according to the on-site inspection, inspection, investigation and relevant inspection and appraisal conclusions of the traffic accident, make a traffic accident identification in time as evidence for handling the traffic accident. The traffic accident certificate shall state the basic facts, reasons and the responsibilities of the parties, and shall be served on the parties.
