If it is a personal injury, it is recommended that after filing a lawsuit, you apply to the court to entrust a professional organization to conduct an appraisal, which requires ID cards, medical records and other materials.
Refer to the "Civil Procedure Law of the People's Republic of China"
Article 76 The parties may apply to the People's Court for appraisal on specialized issues of ascertaining facts. If a party applies for an appraisal, the two parties shall negotiate to determine a qualified appraiser; if the negotiation fails, the people's court shall appoint it.
If the party concerned has not applied for appraisal, and the people's court deems that appraisal is necessary for a specialized issue, it shall entrust a qualified appraiser to conduct appraisal.
Article 77 The appraiser has the right to know the case materials needed for the appraisal, and may question the parties and witnesses when necessary.
The appraiser shall submit a written appraisal opinion and sign or seal the appraisal letter.
If it is a traffic accident:
1. Personal injury cases should be reported to the relevant departments first. If you want to have a disability appraisal, you must apply to the traffic police department. After the patient's treatment period due to a traffic accident expires, he or she can entrust a qualified agency to conduct an appraisal on his own or through the public security and traffic management department. However, you must first apply to the public security and traffic management department. That's right. You can also go to the institution you want to appraise to check the specific requirements of the institution. Generally, they will not be different from local regulations.
2. The time for disability identification is at the end of treatment, and generally there should be a discharge diagnosis certificate. The end of treatment does not necessarily mean that the injury is completely healed.
3. Those who require injury or disability assessment must bring their identity documents and complete and authentic medical materials related to the identification (including medical records, imaging materials (X-rays, CT films, MRI films, etc.) and other clinical test results, etc.), those who are required to be assessed as disabled in a traffic accident must also bring a traffic accident liability certificate issued by the traffic police handling the case.
