I. How to sign the business license electronically
Signature of electronic business license is as follows:
1. Sign your name on white paper, take photos with your mobile phone and send them to your computer, or scan them.
2. Open the reader;
3. Click Open Document to open the picture, drawing or document file you want to add. The file has been changed to PDF format;
4. Click the PDF signature at the top of the toolbar. If not, click Create Signature to start creating your own electronic signature.
Business license is a certificate issued by the administrative department for industry and commerce to industrial and commercial enterprises and individual operators to engage in certain production and business activities. Its format shall be uniformly stipulated by the State Administration of Market Supervision.
The registered items include: name, address, person in charge, amount of funds, economic composition, business scope, business mode, number of employees, business period, etc. Business licenses are divided into originals and duplicates, which have the same legal effect.
The original shall be placed in a prominent position in the company's domicile or business premises, and the business license shall not be forged, altered, leased, lent or transferred.
Without a business license, industrial and commercial enterprises or individual operators are not allowed to start business, engrave official seals, sign contracts, register trademarks or advertise, and banks are not allowed to open accounts.
Second, the basic function of electronic signature
From the definition of electronic signature, we can see two basic functions of electronic signature:
1. Identify the signer
2. Indicate the signer's approval of the content.
The law fully considers the technical neutrality when defining electronic signature, and extracts the provisions on electronic signature according to the basic functions of signature. It is considered that all electronic technical means that meet the basic functions of signature can be considered as electronic signature. From the definition of electronic signature and digital signature, we can see the difference between them: electronic signature is put forward from the legal point of view and is technology-neutral, and any electronic technical means that meets the basic functions of signature can be called electronic signature; Digital signature is put forward from a technical point of view, which requires the use of cryptographic technology. The main purpose is to confirm the source and integrity of the data unit.
Remind that electronic signature is a broad concept, and digital signature can be regarded as an implementation of electronic signature, which provides higher functions than the basic requirements of electronic signature.
Third, the principle of electronic signature.
Due to the diversity of electronic signature forms, its reliability, authenticity and stability may vary greatly due to the different technical schemes adopted, resulting in its legal effect not at the same level. "Functional equivalence principle" can solve this problem well, and there are three basic modes:
First, only electronic signatures that meet certain conditions have the same legal effect as traditional signatures;
Secondly, based on the stability, reliability and authenticity of electronic signatures, different patterns and characteristics of electronic signatures have different legal effects;
Third, the electronic signature that meets the corresponding requirements can have the same legal effect as the traditional signature, regardless of the specific technical scheme. Taking this as the basis to judge whether the electronic signature has legal effect, it reduces the unstable influence of the diversity of electronic technology on the effectiveness of electronic signature.
