article 24 the bid evaluation Committee shall, according to the bidding documents, review and list all the bidding deviations of the bidding documents item by item.
bidding deviation can be divided into major deviation and minor deviation.
Article 25 The following situations are major deviations:
(1) The bid security is not provided as required in the tender documents or the provided bid security is defective;
(2) The bid documents are not signed and stamped by the authorized representative of the bidder;
(3) The completion period of the project subject to tender specified in the tender documents exceeds the time limit specified in the tender documents;
(4) obviously does not meet the requirements of technical specifications and standards;
(5) The packaging methods, inspection standards and methods of the goods specified in the bidding documents do not meet the requirements of the bidding documents;
(6) the tender documents are accompanied by conditions unacceptable to the tenderer;
(7) does not meet other substantive requirements specified in the tender documents.
in case of any of the above circumstances, the bid documents shall be deemed as failing to make a substantial response to the bidding documents, and shall be invalidated according to Article 23 of these Provisions. Where there are other provisions on major deviations in the tender documents, such provisions shall prevail.
article 26 minor deviation refers to the fact that the bidding documents substantially respond to the requirements of the bidding documents, but there are omissions or incomplete technical information and data in some places, and the correction of these omissions or incompleteness will not cause unfair results to other bidders. Minor deviation will not affect the validity of the bidding documents.
the bid evaluation Committee shall require bidders with slight deviations in writing to make corrections before the end of bid evaluation. If the bidder refuses to make corrections, the slight deviation may be quantified against the bidder in the detailed evaluation, and the quantification standard shall be stipulated in the tender documents.
