However, the actual practice of the company is quite different; I put forward the following details for all localities, alumni and enterprises to observe clearly. Here are the details of the matter.
1. Refuse to pay the promised salary after joining the company; When signing the contract, the company cheated on the grounds of purchasing social security, refused to fill in the promised salary, but unilaterally and privately filled the reduced salary into the contract; Later, he repeatedly asked the company for a contract, but he refused it for various reasons; (The company didn't provide payroll, but there was bank card transfer as evidence.)
2. The company promises to include room and board, but the expenses will be borne by itself, on the grounds that the cost is high and no subsidy will be given; (as evidenced by the payroll)
I won't pay social security after signing the contract. After many times of communication in the later period, I paid several hundred yuan of social security with the lowest base in Changxing County. (as evidenced by the number of months of social security payment)
The company promised five insurances and one gold, but I still didn't pay the provident fund until I was forced to transfer my previously agreed job. And the whole company has no provident fund; (The evidence is conclusive)
5. The company goes out collectively every year, which requires employees to bear a certain proportion of expenses; Even if you don't leave, you will be forcibly deducted from your salary; (The evidence is conclusive)
6. Because the company can't provide professional systematic training, we arranged off-campus training for four months, and the actual training cost was nearly 1.6 million, which required employees to bear 1.6 million; And during the period, the accommodation is borne by itself, and the salary is directly halved; Therefore, during the training period, apart from the five risks of basic accommodation, I only get more than two thousand yuan a month; Because I broke my contract at that time and missed the school move, I borrowed a lot of tuition from my friends during my study (only a single-parent hemiplegic father in my family could not support me). After graduation, I was penniless and accepted the arrangement of the company with grievances.
7. After the training, I went back to the company to report for work and communicated with the company in the hope that I could fulfill my original promise after going to work, but the company refused.
Admit, for example, the issue of provident fund, the relationship is rigid; The company forced me to work in the suburb of Changxing County, Huzhou City, regardless of the previous commitment (commitment to work in Hangzhou branch after the training, and five insurances have been transferred to Hangzhou during the training period); It is unacceptable for individuals to deduct wages, postpone social security payment, refuse to pay provident fund, bear a certain proportion of annual travel expenses, bear most of training fees, and take care of themselves. However, forcibly changing the previously agreed work place is the personal bottom line, and it is unacceptable for the company to refuse to abide by the prior agreement. 8. I didn't become a regular employee when I left my job, and I was still on probation. The company asked me to refund the training fee, salary, social security and year-end bonus during my previous work, totaling 45,000 yuan. The repayment agreement forced me to leave my job for personal reasons, because there was basically no extra money during the training period except accommodation and medical expenses, and the company asked me to pay it off within one year; Otherwise, it is required to compensate for the threat of signing a contract of 654.38+10,000 yuan. In addition, it is unreasonable for me to bear the accommodation and training fee 10000 yuan during the training period. In addition, during the three-year service of the company, I was deeply deceived by the company's unfulfilled provident fund, accommodation and other issues. Long-term depression, suffering from gastrointestinal diseases and depression, taking gastrointestinal Chinese medicine and antidepressants for several months. At that time, I didn't intend to entangle with the company and left here as soon as possible. In order to go back to my hometown for illness first, I signed a company loan and left;
But when I left, the company lied and cheated on the grounds of copying my diploma, and then forcibly detained it. Later, I asked the local county labor department for help many times, but it was fruitless. The local labor inspection brigade thinks that it is reasonable for General Manager Qin (the boss of the company, Qin Bing) to detain the graduation certificate. When talking about the need for a diploma to find a job, he said that he could sue a professional lawyer himself. During asking for help from the county labor inspection brigade, he didn't even call the company to verify the situation and avoid the matter. I wonder if there is a pledge diploma in the repayment agreement.
But promise to send it to me when I use it, and refuse not to send it later.
9. Up to now, the company has detained my diploma for three months, which has seriously affected my job search; I didn't have an interview with some companies that I met many times and explicitly asked to bring the original diploma to the interview. During the interview, I contacted Qin Bing, the boss of Changxing Taibo Electronics Company, many times. He insisted on detaining and refusing to return the documents, and threatened to sue me and demanded the return of all expenses. He refused to communicate and bother me, that is, he refused to return his diploma and couldn't find a job. He also threatened to sue me and demanded to repay his salary, social security and training fees, which led to a vicious circle.
10. The salary paid by the company is very strange, for example, the internship salary is 7000 yuan (after deduction), but it is paid in two ways. Pay a part in the form of basic salary first, from which several hundred yuan will be deducted, and another 5,000 yuan will be paid by bank card transfer ~
Now, in view of the unreasonable practices of the company, especially when I have explicitly agreed in writing to return the company's training fees within one year, I still forcibly detain my diploma by deception, which has seriously affected my job search and caused things to fall into an extremely vicious circle; Additional terms and conditions:
1. When I left my job, I was still on probation; Workers terminate their labor in accordance with relevant regulations or agreements.
Relationship, enterprises can not claim compensation for training fees. The Measures for Compensation for Violation of the Labor Law on Labor Contracts stipulates that if a worker terminates the labor contract in violation of the provisions or the labor contract, causing losses to the employer, the worker shall compensate the training expenses paid by the employer. According to the Reply of the General Office of the former Ministry of Labor on Handling the Basis of Dissolving the Labor Contract within the Applicable Period, the employer shall provide training for the employees. If the employees propose to terminate the labor relationship with the unit, if it is during the probation period, the employer shall not ask the employees to pay the training fee; If the probation period expires, the employer may require the employee to pay the training fee during the contract period.
2. Resignation for non-personal reasons means that the company has repeatedly failed to abide by and fulfill the prior agreement; It's just unilateral.
Require workers to comply; For example, 65,438+10,000 workers are compensated for breach of contract, and they have no treatment or commitment to violate the rules; In the end, because the company forcibly changed the agreed work place, after many consultations and communication with the company, it was helpless to choose to leave; If an employee resigns because the company does not comply with the agreement, in fact, no compensation may be given.
3. Personally consulted the relevant lawyers and made it clear that the pre-agreed training fee does not include the basic salary, social security expenses and year-end bonus that should be paid to the workers during the period (refer to the following case);
In addition, it is extremely unreasonable for the company to change the salary privately, repeatedly violate the labor contract and refuse to give it to employees, forcibly change the previously agreed work place, and force employees to claim compensation for various expenses (individuals are willing to bear training fees or liquidated damages (the maximum amount is legal)), wages, social security, year-end bonuses, etc. * * * 45,000 yuan, long-term seizure of graduation certificate by fraudulent means, individuals can not find a job. Personally, I think the company is arrogant, despicable, unruly and seriously lacking in credit. I hope all alumni and enterprises from all walks of life can see it clearly ~
I recently communicated with the company.
