According to relevant laws and regulations, the Law on the Protection of Illegally Obtaining Minors adds the stipulation that tobacco products are not allowed to be sold around schools and kindergartens, and entrusts the tobacco monopoly administrative department with new tasks: strictly implement the new requirements for the establishment of tobacco sales outlets, strengthen the management of tobacco monopoly retail licenses, and do a good job in retail license access. Second, it is clear that it is necessary to supervise and inspect illegal activities such as selling cigarettes to minors and not setting up signs that do not sell cigarettes to minors in a prominent position. In addition, the newly revised Law on the Protection of Minors clearly includes e-cigarettes in the category of cigarettes, which provides a legal basis for the tobacco monopoly administrative department to perform its duties. The Law on the Protection of Minors explicitly prohibits the sale of cigarettes to minors, and business operators should set up signs in a prominent position not to sell cigarettes to minors. Before the implementation of the newly revised Law on the Protection of Minors, tobacco monopoly bureaus at all levels will organize a comprehensive survey of licensed households around ordinary primary and secondary schools, special education schools, secondary vocational schools, specialized schools and kindergartens in the region, and carry out policy interpretation and publicity work. After the implementation of the newly revised Law on the Protection of Minors, there will be no new retail licenses around ordinary primary and secondary schools, special education schools, secondary vocational schools, specialized schools and kindergartens, and the existing cigarette retail outlets will not be extended when they expire. Tobacco monopoly bureaus at all levels will organize special inspections, strengthen the clean-up and rectification of e-cigarette sales points around ordinary primary and secondary schools, special education schools, secondary vocational schools, specialized schools and kindergartens, and carry out market inspections and administrative penalties according to laws and regulations.
Legal basis: Article 59 of the Law of People's Republic of China (PRC) on the Protection of Minors. Schools and kindergartens shall not set up cigarette, wine and lottery sales points around. It is forbidden to sell cigarettes, alcohol, lottery tickets or pay lottery bonuses to minors. Operators of tobacco, alcohol and lottery tickets shall set up signs in a prominent position not to sell tobacco, alcohol and lottery tickets to minors; If it is difficult to determine whether they are minors, they shall be required to show their identity documents. No one is allowed to smoke or drink alcohol in schools, kindergartens or other public places where minors concentrate their activities.
