What is the root cause of its formation?

First, the legal punishment is too light, and there are no detailed and clear legal provisions on criminal cases of violence against minors in the criminal law.

In recent years, the law is unable to deal with the frequent incidents of juvenile violence. China's criminal law stipulates that minors who have reached the age of 16 should bear criminal responsibility for committing crimes, and those who have reached the age of 14 but under the age of 16 should only bear criminal responsibility for eight serious violent crimes such as intentional homicide. As for those who are under the age of 14, they will not bear criminal responsibility.

In fact, underage violence is widespread all over the world, and it is not unique to China, but the sentencing is different. As a lawyer said, "Some countries judge criminal responsibility not only by age, but also by crime. Ten-year-olds may also face criminal responsibility. In contrast, the illegal cost of young people in China is very low. " Perhaps this is the fundamental reason why the perpetrators are unscrupulous.

Second, improper family education methods promote psychological distortion of minors.

After the minor violence, in the process of investigation and evidence collection, it is not difficult to find that most of the perpetrators have different degrees of absence in family education. Some minors are single-parent families, lacking the normal care of their parents, and developing a withdrawn and violent character; Some of them are also victims of domestic violence, who have long suppressed and endured their parents in classmates or other minors; Some are only children, spoiled by their parents and elders, and have developed a paranoid personality of arrogance. When some students' wishes can't come true, they have the motive of revenge.

Research shows that adolescent children are impulsive and unstable. Due to parents' doting and improper education, it is easy to get narrow-minded, selfish, willful and self-centered. Therefore, in family education, parents should first overcome abnormal psychological factors and get out of the misunderstanding of family education. In the process of education, we should respect and restrain children and give them a free development, independent learning and healthy and upward educational atmosphere. Don't cause the sad result of material doting but spiritual destruction, let real care be integrated into children's young hearts. Secondly, we should strengthen contact with schools, communicate with teachers in time, adopt correct educational methods, always care about children, understand their psychological needs and life needs, be good at observing whether their behavior is abnormal, and nip their violent tendencies in the bud.

Third, the school legal education is not perfect, and educating students to know the law only stays on a slogan.

Perhaps, we are in the foggy period of education. While we are clamoring for quality education, we are still inseparable from the embarrassing situation dominated by achievements. Schools pay too much attention to children's grades, which leads to a serious lack of legal education, which leads to most students knowing nothing about the law, and some students don't realize that their actions have constituted serious consequences of violent crimes.

Behind the escalation of underage violence, it is warning our school to strengthen education in moral education, legal system and safety. Rome was not built in a day. While we call for moral return, schools must improve the education and punishment mechanism in time. Those who cause trauma to others should not only be punished verbally, warned and admonished, but also be severely punished according to the nature and severity of the incident. If the circumstances are serious, rape will never be tolerated. Let them know that the wrong behavior will be severely punished by laws and regulations.

Fourth, the indifference of bystanders encourages the arrogance of the perpetrators.

Although the violence of minors is disgusting, the indifference of onlookers is even more chilling. Some even take photos with their mobile phones and watch the fun with an entertaining attitude, including many adults. The perpetrators are young and ignorant. Shouldn't adults stop their violent behavior? Don't let that helpless heart despair when the child is bullied and attacked.

In fact, the indifference of China people seems to have long been commonplace. When you face fierce gangsters, you may be indifferent to protect yourself. However, when you face those underage children, you are still indifferent. What kind of mentality do you have? Perhaps the existence of you, a cold bystander, has increased the prestige of the perpetrators and given them reasons for violence.

5. Affected by bad social environment and media violence.

Teenagers' self-awareness and personality are in the growth stage, and both psychology and physiology are in the development stage. They are not yet fully mature and have not yet formed a correct outlook on life. Most of their behavior comes from imitating others. The appearance of bad role models in society directly affects the mental health of minors and their attitudes towards life and life. Therefore, we should guard against the risk of social moral decline, create a clean and upright social environment, and establish a correct value orientation for minors. At the same time, society and relevant departments should control the spread of violent culture. At present, the factors of violence in the media cannot be underestimated. With the popularity of intelligent terminals, a large number of cyber violence has caused great psychological harm to minors and lured them into the abyss of breaking the law.

Juvenile violence should no longer be ignored, and a set of feasible schemes, systems or regulations should be formulated according to its uniqueness to stifle this increasingly serious violent tendency.
